GAMMON Approved and signed by me ig1tr_ 7,776-1 /7(74't44-1-- Mayor BILL NO. 103-85 ORDINANCE NO. 74j - $' AN ORDINANCE AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED BUILDINGS STATEMENT OF PURPOSE AND INTENT: To provide minimum standards to safeguard life, public safety and welfare, and real and personal property by regulating the design and construction of buildings and structures in the City of South Bend and to bring the Municipal Code into conformity with State statutes and regulations governing the construction and alteration of buildings and structures, certain amendments and additions to the South Bend Municipal Code, Chapter 6 , entitled Buildings, are required. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. Chapter 6 , Article 2 of the South Bend Municipal Code is amended at Section 6-5 (a) as follows: Section 6-5 (a) . The following rules, regulations and codes are hereby adopted by reference as fully as if set forth herein to govern the erection, construction, enlargement, alteration, repair, moving, improving, removing, conversion, demolition, equipping, using, occupying or maintenance of buildings and structures in the City: (1) Construction Rules and Regulations, Volume I , 1980 Edition of the State of Indiana (675 IAC 2) originally published as (3 IR 2148) which identifies, amends and incorporates therein the Uniform Building Code, 1979 Edition, and the Uniform Building Code Standards, 1979 Edition. (2) Indiana Electrical Code, 1984 Edition, (675 IAC 17) originally published as (8 IR 1010) which identifies, amends and incorporates therein the National Electrical Code, 1984 Edition. (3) Indiana Plumbing Rules, 1981 Edition, (675 IAC 5) originally published as (4 IR 2398) which identifies, amends and incorporates therein the Uniform Plumbing Code, 1979 Edition. (4) Indiana Mechanical Rules, 1981 Edition, (675 IAC 7) originally published as (4 IR 1828) which identifies , amends and incorporates therein the Uniform Mechanical Code, 1979 Edition. (5) One and Two Family Dwelling Code, 1984 Edition (675 IAC 3-2) originally published as (7 IR 1870) which identifies, amends and incorporates therein the Council of American Building Officials One and Two Family Dwelling Code, 1983 Edition. !Gl T,,Ai nr, l7`norrry rnnccrvaI-inn enArl _ 1 9R4 F 1ifinn • (7) Indiana Swimming Pool Rules , 1982 Edition, (675 IAC 9) originally published as (5 IR 1829) under that title. (8) Indiana Standard for Permanent Installation of Manufactured Homes , (675 IAC 3-3) originally published as (6 IR 1729) under that title. SECTION II. Chapter 6 , Article 4 , of the South Bend Municipal Code is amended at Section 6-10 (b) (1) (D) as follows: Section 6-10 (b) (1) (D) . Maintenance Technician: A person who is employed on a permanent basis to keep the premises of a commercial business establishment or multi-family residential establishment in good repair. SECTION III . Chapter 6 , Article 4, of the South Bend Municipal Code is amended at Section 6-10 (b) (2) (C) as follows: Section 6-10 (b) (2) (C) . Registration shall be for a term from January 1 or the date of initial registration and shall be renewed each year by January 1 . SECTION IV. Chapter 6 , Article 8 of the South Bend Municipal Code is amended at Section 6-37 by deleting subsections a and b in their entirety and adopting new subsections a and b, which shall read as follows: Section 6-37 (a) - Adoption by Reference. The first edition of the BOCA Basic National Existing Structures Code, 1984 promulgated by the Building Officials and Code Administrators International, Inc. , is hereby adopted by reference as fully as if set forth herein to govern existing buildings and structures in the City, except for the additions or deletions which are specified in this section. At least two (2) copies of the BOCA Basic National Existing Structures Code, 1984, shall be kept in the Department for public inspection. (b) Additions , Modifications and Deletions. The provisions of the BOCA Basic National Existing Structures Code, 1984 , adopted by subsection (a) shall be modified, added to or deleted so that the following articles, sections or subsections shall read as follows : (1) Section ES-100 . 1 Title: These regulations shall be known as the Existing Structure Code of the City of South Bend, Indiana, hereinafter referred to as the Existing Structures Code. (2) Sections ES 107 , 108 , 109 , 110 , 111 and 112 shall be deleted in their entirety. (3) The definitions for the following words shall be deleted in Article 2 : Dwellings , Dwelling Unit, Family, Hotel, Junk Vehicle, Motel, Multi-Family Dwellings , Public Nuisance, Rooming House, Rooming Unit, and Rubbish and each of the above words shall be defined as provided in the relevant section of the South Bend Municipal Code. (4) Sections ES 301 . 7 , 301 . 10 , 301 . 10 . 1 and 301 .10 .2 shall be deleted in their entirety. • (6) Section ES 701. 3 shall be modified to read: All doors in the required means of egress shall be readily openable from the inner side. Delete without the use of keys. (7) Article 9 shall be deleted in its entirety. SECTION VIII. Mathews Building Commissioner August 9, 1985 South Bend, Common Council Members 4th Floor County-City Building South Bend, IN 46601 Dear Council Members: The attached ordinance includes several amendments to Chapter 6 , Buildings, of the South Bend Municipal Code. One of the amendments lists the update editions of the codes required by the State of Indiana. These codes include the Electrical, Plumbing, Energy, Construction Rules and Regulations, and One and Two Family Dwelling Code. The 1984 BOCA Existing Structures Code replaces the 1978 BOCA Code and is used by the inspectors when inspecting substan- tial structures. Amendments to the Plumbing section of the Code would change the registration date of plumbing contractors from August to January to be consistent with other city registration requirements. The defini- tion of Maintenance Technician would be redefined to only require the registration of maintenance technicians who do plumbing repair work in businesses or multi-family residential establishments and not industrial or manufacturing businesses.
