WAYNE STREET, IN THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED by the Conuuon Council of the City of South Bend, Indiana: SECTION I . Ordinance No . 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the Zoning classification of the following described real estate in the City of South Bend, St . Joseph County, State of Indiana Lot Numbered One Hundred Thirty-six (136) , as shown on the recorded plat of Whitcomb & Keller' s Sunnymede 1st Add. , to the City of South Bend be and the same is hereby established as "A" Residential, "A" Height and Area. SECTION II . Wayne Street, City of South Bend Gentlemen: The above referenced ordinance initiated by Councilman Beverlie Beck was legally advertised August 9 and August 10, 1985. The Area Plan Commission gave it a public hearing on August 20, 1985, at which time the following action was taken: Upon a motion by Willie Morgan, being seconded by John Leszczynski and unanimously carried, the proposed ordinance initiated by Councilman Beverlie Beck to zone from "B" Residential , "A " Height and Area to "A" Residential, "A" Height and Area, property located at 1102 E. Wayne Street, City of South Bend is sent to the Common Council with a favorable recommendation The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Wayne Street, South Bend REQUESTED ACTION: The petition requests that the above noted property be rezoned from "B" Residential, "A" Height and Area to "A+" Residential, "A" Height and Area. EXISTING LAND USE: There is a single-family home on the property. SURROUNDING LAND USE AND ZONING: Located to the north across Wayne Street is a single-family home zoned "A" Residential ; to the east is a single-family home zoned "A" Residential ; to the south is an office of the Y.M.C.A. zoned "B" Residential ; and to the west across Eddy Street is a medical office zoned "B" Residential . SITE PLAN: A site plan is not required for rezoning petitions initiated by the Common Council . Johnson Area Plan Commission Room 1140 County-City Building South Bend, Indiana 46601 Dear Mr. Johnson: The rezoning of the property at 1102 E. Wayne St. at the corner of Eddy and Wayne St. is of great concern to our neighborhood. At the present time cars are parked on Wayne St. while clients are using the offices on the west side of Eddy St. If this property on the east side should become an office, I can easily see the street in front of our homes filling up with parkers. Also there are many small children in the first half block of Wayne St. and additional traffic could be hazardous. I am enclosing a copy of the petition signed by 197 South Bend residents who believed, when they signed the original petition earlier this year, that this house had been rezoned along with the other properties. I ask that you please support this ordinance and help keep this residential neighborhood in the state for which it was originally planned. Sincerely yours, t (Mrs.) Richard S. PETITION FOR REZONING Counterpart No. We, the undersigned residents and voters of the City of South Bend, Indiana, hereby petition the Mayor of the City of South Bend, the South Bend Common Council, and the St. Joseph County Area Plan Commission to approve an Ordinance amending the Zoning Ordinance of the City for property located on the east side of Eddy Street, be- tween Jefferson Boulevard on the North and School Field on the South, in South Bend, Indiana, from "B" Residential "A" Height and Area to "A" Residential "A" Height and Area. We firmly believe that it is imperative to maintain the strong and stable residential neighbor- hood which has existed for years on the East side near the central area of the City of South Bend. This Petition may be circulated in several counterparts and all such counterparts are to be considered as constituting one Petition. Name Address
