A RESOLUTION OF THE SOUTH BEND. REDEVELOPMENT AUTHORITY
APPROVING THE TRANSFER OF PROPERTY
TO THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the South Bend Redevelopment Authority (the
Authority) is the owner of the .following described improvements to
real property situated in St. Joseph County, Indiana:
A pedestrian tunnel and all accessions and fixtures
thereto beneath St. Joseph Street, connecting the
College Football Hall of Fame and Century Center,
all in South Bend, St. Joseph County
(hereinafter referred to as the Improvements) and;
WHEREAS, the Authority desires to transfer the Improvements to
the City of South Bend in consideration of the payment by the City
to the Authority of the sum of Six Hundred Thousand Dollars
(.$600,000.00); and
WHEREAS, the City desires to acquire the Improvements from the
Commission upon these terms and conditions; and
WHEREAS, I.C. 36-7-14.5 which governs the operations of the
Authority fails to establish procedures governing the purchase
and/or sale of property by the Authority; but
WHEREAS pursuant to its Resolution 33, adopted March 8, 1991,
the Authority determined to operate in accordance with the
procedures set forth at I.C. 36-1-11-8 with regard to the purchase
and sale of property from or to another governmental entity; and
WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend,
acting by and through the Board, may exchange or transfer property
with another governmental entity upon terms and conditions agreed
upon by the two (2) entities as evidenced by the adoption of
substantially identical resolutions of each entity.
NOW, THEREFORE, BE' IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT AUTHORITY AS FOLLOWS:
1. That the transfer of the following described
improvements to real property situated in St. Joseph County,
Indiana by the South Bend Redevelopment Authority to the. City of
South Bend, Indiana:
A pedestrian tunnel and all accessions and fixtures
thereto beneath St. Joseph Street, connecting the
College Football Hall of Fame and Century Center, all
• in South Bend, St. Joseph County
for the sum of Six Hundred Thousand Dollars ($600,000.00) and
pursuant to the terms set forth above, shall be, and hereby is,
approved.
2. That the approval of the transfer of title to the
Improvements from the Authority to the City is conditioned upon the
adoption of a resolution substantially similar in its terms to the
terms of this resolution. by the City of South Bend, Board of Public
Works.
3. That the President and Secretary of the Authority are
hereby authorized and directed to execute a quitclaim deed and/or
such other documents evidencing the- transfer of title to the
Improvements by the Authority to the City upon the receipt by the
Authority .from the City of the sum of Six Hundred Thousand Dollars
($600, 000.00) .
4. That this Resolution shall be in full force and effect
upon its adoption.
ADOPTED at a special meeting of the South Bend Redevelopment
Authority held on December ~a , 1995, at 1308 County-City
Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
