A RESOLIITION OF
THE SOIITH BEND REDEVELOPMENT AUTHORITY
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOUTH BEND, INDIANA
FOR THE IISE AND BENEFIT OF ITS DEPARTMENT OF REDEVELOPMENT
WHEREAS, the South Bend Redevelopment Authority (the "Authority") is
the owner of the certain real property situated in St. Joseph County,
Indiana and being more particularly described at Exhibit "A," attached
hereto (the "Real Property") and;
WHEREAS, I.C. 36-7-14.5 governs the operations of the Authority but
fails to establish procedures governing the purchase and/or sale of real
property by the Authority; and
WHEREAS pursuant to its Resolution 33, adopted March 8, 1991, the
Authority determined to operate in accordance with the procedures set
forth at I.C. 36-1-11-8 with regard to the purchase and sale of real
property from or to another governmental entity; and
WHEREAS, the City of South Bend, Indiana, on behalf of its
Department of Redevelopment, acting by and through its governing body
the South Bend Redevelopment Commission ("Redevelopment"), desires to
acquire the Real Property; and
WHEREAS, the Authority desires to transfer title to the Real
Property to Redevelopment; and
WHEREAS, pursuant to I.C. 36-1-11-8, Redevelopment may exchange or
transfer property with another governmental entity upon terms and
conditions agreed upon by the two (2) entities as evidenced by the
adoption of substantially identical resolutions of each entity.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
AUTHORITY AS FOLLOWS:
1. That the transfer of the Real Property situated in St. Joseph
County, Indiana, and more particularly at Exhibit "A," attached hereto
by the South Bend Redevelopment Authority to the South Bend, Indiana,
for the use and benefit of its Department of Redevelopment shall be, and
hereby is, approved, subject to the adoption by the South Bend
Redevelopment Commission of a resolution substantially similar in its
terms to the terms of this resolution.
2. That the President and Secretary, respectively of the
Authority, respectively, are authorized and directed to execute and
attest to the execution of a quitclaim deed conveying all of the right,
title and interest in and to the Real Property to the City of South Bend
for the use and benefit of its Department of Redevelopment

EXHIBIT A
Part of the Southeast Quarter (1/4) of Section 19 and a part
of the Southwest Quarter (1/4) of Section 20, all in Township
38 North, Range 2 East, German Township, City of South Bend,
St. Joseph County, .Indiana, described as follows:
Commencing at the Southeast corner of the Southeast Quarter
(1/4) of Section 19, Township 38 North, Range 2 East, also
being the Southwest corner at the Southwest Quarter (1/4) of
Section 20, Township 38 North, Range 2 East; thence North 00
degrees 14 minutes 09 seconds West on the East line of the
Southeast Quarter (1/4) of skid Section 19, also being the
West line of the Southwest Quarter (1/4) of said Section 20, a
distance of 49.67 feet to the point of beginning; thence
continuing North 00 degrees 14 minutes 09 seconds West on the
East line of the Southeast Quarter (1/4) of said Section 19,
and the West line of the Southwest Quarter (1/4) of said
Section 20, a distance of 20.33 feet to the Northerly right of
way of Nimtz Parkway; thence North 89 degrees 47 minutes 23
seconds West on said Northerly right of way line, a distance
of 228.02 feet to the Easterly line of a 30 foot easement for
storm drainage; thence .North 00 degrees 12 minutes 37 seconds
East on said Easterly line, a distance of 150.00 feet; thence
North 53 degrees 54 minutes 46 seconds East, a distance of
289.50 feet; thence South 36 degrees 25 minutes 21 seconds
East, a distance of 340.00 feet to the Northerly right of way
line of Nimtz Parkway; thence Southwesterly on said Northerly
right of way line, on a curve to the right having a radius of
710.00 feet, a delta of 17 degrees 45 minutes 13 seconds, a
chord distance of 219.12 feet bearing South 71 degrees 53
minutes 35 seconds West, an arc distance of 220.00 feet to the
point of beginning, being a part of Lot Numbered Four (4) as
shown on the recorded Plat of Blackthorn Corporate Office
Park, recorded October 7, 1994 in the Office of the Recorder
of St. Joseph County, Indiana, as Instrument No. 9438010.
