A RESOLIITION OF
THE SOIITH BEND REDEVELOPMENT AUTHORITY
APPROVING THE TRANSFER OF REAL PROPERTY
TO THE CITY OF SOIITH BEND, INDIANA
FOR THE IISE AND BENEFIT OF ITS DEPARTMENT OF REDEVELOPMENT
WHEREAS, the South Bend Redevelopment Authority (the "Authority") is
the owner of the certain real property situated in St. Joseph County,
Indiana and being more particularly described at Exhibit "A," attached
hereto (the "Real Property" ) and;
WHEREAS, I.C. 36-7-14.5 governs the operations of the Authority but
fails to establish procedures governing the purchase and/or sale of real
property by the Authority; and
WHEREAS pursuant to its Resolution 33, adopted March 8, 1991, the
Authority determined to operate in accordance with the procedures set
forth at I.C. 36-1-11-8 with regard to the purchase and sale of real
property from or to another governmental entity; and
WHEREAS, the City of South Bend, Indiana, on behalf of its
Department of Redevelopment, acting by and through its governing body
the South Bend Redevelopment Commission ("Redevelopment"), desires to
acquire the Real Property; and
WHEREAS, the Authority desires to transfer title to the Real
Property to Redevelopment; and
WHEREAS, pursuant to I.C. 36-1-11-8, Redevelopment may exchange or
transfer property with another governmental entity upon terms and
conditions agreed upon by the two (2) entities as evidenced by the
adoption of substantially identical resolutions of each entity.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
AUTHORITY AS FOLLOWS:
1. That the transfer of the Real Property situated in St. Joseph
County, Indiana, and more particularly at Exhibit "A," attached hereto
by the South Bend Redevelopment Authority to the South Bend, Indiana,
for the use and benefit of its Department of Redevelopment shall be, and
hereby is, approved, subject to the adoption by the South Bend
Redevelopment Commission of a resolution substantially similar in its
terms to the terms of this resolution.
2. That the President and Secretary, respectively of the
Authority, respectively, are authorized and directed to execute and
attest to the execution of a quitclaim deed conveying all of the right,
• title and interest in and to the Real Property to the City of South Bend
for the use and benefit of its Department of Redevelopment
3. That this Resolution shall be in full. force and effect upon its
adoption.
ADOPTED at a regular meeting of the South Bend Redevelopment
Authority held on July 19, 1995, at 1308 County-City Building, 227 West
Jefferson Boulevard, South Bend, Indiana 46601.

Part of the Southwest Quarter (1/4) of Section 20 Township 38
North, Range 2 East, German Township, City of South Bend, St.
Joseph County, Indiana, described as follows:
Commencing at the Southwest corner of the Southwest Quarter (1/4)
of Section 20, Township 38 North, Range 2 East; thence North 00
degrees 14 minutes 09 seconds West on the West line of the
Southwest 1/4 of said Section 20, a distance of 49.67 feet to the
Northerly right of way line of Nimtz Parkway; thence Northeasterly
on said Northerly right of way line, on a curve to the left having
a radius of 710.00 feet, a delta of 20 degrees 46 minutes 47
seconds, a chord distance of 256.09 feet bearing North 71 degrees
53 minutes 35 seconds East, an arc distance of 220.00 feet to the
point of beginning; thence North 36 degrees 25 minutes 21 seconds
West, a distance of 340.00 feet; thence North 53 degrees 54 minutes
46 seconds East, a distance of 188.94 feet; thence South 47 degrees
45 minutes 49 seconds East, a distance of 341.31 feet to the
Northerly right of way line of Nimtz Parkway; thence Southwesterly
on said Northerly right of way line, on a curve to the right having
a radius of 710.00 feet, a delta of 20 degrees 46 minutes 47
seconds, a chord distance of 256.09 feet bearing South 52 degrees
37 minutes 35 seconds West, an arc distance of 257.49 feet to the
point of beginning, being a part of Lot Numbered Four (4} as shown
on the recorded Plat of Blackthorn Corporation Office Park,
recorded October 7, 1994 in the Office of the Recorder of St.
Joseph County, Indiana, as Instrument No. 9438010. Subject to
