AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 914 S. IRONWOOD DRIVE
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
SECTION I. Ordinance No. 4990-68, as amended, which ordi-
nance is commonly known as the Zoning Ordinance of the City of
South Bend, Indiana, be and the same hereby is amended in order
that the zoning classification of the following described real
estate in the City of South Bend, St. Joseph County, State of
Indiana:
North i of Lot 30, Original Plat of the Town
of River Park, South Bend, Indiana
be and the same is hereby established as ""T" Commercial,
""A"" height and area district.
SECTION II. This ordinance shall be in full force and
effect from and after its passage by the Common Council,
approval by the mayor, and legal publication.

RE: A proposed ordinance and site development plan of Sara J. Talbot and St.
Joseph Bank & Trust Company as trustee, to zone from "A" Residential, "A"
Height and Area to "C" Commercial, "A" Height and Area property located at
914 South Ironwood Drive, City of South Bend
Gentlemen:
The above referenced ordinance and site development plan of Sara J. Talbot and
St. Joseph Bank & Trust Company as Trustee, was legally advertised December 6
and December 7, 1985. The Area Plan Commission gave it a public hearing on
December 17, 1985, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by C. J.
Witz, and unanimously carried, the proposed ordinance
and site development plan of Sara J. Talbot and St.
Joseph Bank & Trust Company as trustee, to zone from
"A" Residential, "A" Height and Area to "C" Commercial,
"A" Height and Area property located at 914 South
Ironwood Drive, City of South Bend is sent to the
Common Council with a favorable recommendation subject
to a Final Site Development Plan
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

STAFF REPORT

REQUESTED ACTION: The petitioner is requesting a zone change from
"A" Residential , "A" Height and Area to
Commercial , "A" Height and Area. "C"
EXISTING LAND USE: The property contains a converted single-family
home formerly used as a medical office.
SURROUNDING LAND USE AND ZONING: Located to the north are commercial buildings
fronting on Mishawaka Avenue zoned "C" Commercial ;
to the east is a single-family home zoned "A"
Residential ; to the south is a single-family home
zoned "A" Residential ; and to the west across
ironwood, is a gas station zoned "C" Commercial
and a dental office zoned "A" Residential.
ACCESS: Access to the site for parking purposes will be
from the alley on the east side of the property.
DRAINAGE: The drainage has not been addressed by the
petitioner.
DATA: The total site to be rezoned is 5,445 square feet.
Of that, the building will occupy 1 , 160 square
feet, or 21.4% of the site, the parking and drives
will occupy 544 square feet, or 9.97. of the site,
and 3,741 square feet or 68.7% of the site will
remain as open space.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer made the following comments:
"1. City sanitary sewer and water is
available to 1/2 lot.
2. Lot is not wide enough for parking
layout as proposed. Must consider a
different layout.
3. If they plan on using the alley as
ingress/egress, then the alley must be
paved per City standards.
4. Storm water drainage must be addressed
for roof and paved areas at a rate of 30
gallons/100 square feet.

5. Should the alley ever be vacated, there
would be no access to the parking lot. "
The City Building Department noted that once
the property is rezoned to "C" Commercial , it
can no longer be used as a residential
dweliinu.
