P 744 I B 9 >2) f-----_______ ?-' Mayor ORDINANCE NO. 7s-7 :7-s110' ORDINANCE AMENDING CHAPTER TWO, ARTICLE 13 OF THE SOUTH BEND MUNICIPAL CODE BY ADDING AN ADDITIONAL ECONOMIC DEVELOPMENT TARGET AREA THERETO, COMMONLY KNOWN AS THE SOUTH BEND CENTRAL DEVELOPMENT AREA STATEMENT OF PURPOSE AND INTENT: The 1983 Indiana General Assembly amended I .C. 36-7-12 to provide at I .C. 36-7-12-38 for the designation of economic development target areas by the Common Council upon favorable recommendation of the Economic Development Commission. The South Bend Common Council, on November 14, 1983 adopted Ordinance No. 7267-83 declaring as Economic Development Target Areas three areas declared as redevelopment areas by the South Bend Redevelopment Commission prior to March 31, 1983 . The three redevelopment areas that were declared to be Economic Development Target Areas on November 14, 1983 have been combined and expanded by the South Bend Redevelopment Commission into a redevelopment area known as the South Bend Central Development Area. The South Bend Economic Development Commission has recommended favorably the designation of the South Bend Central Development Area within the City of South Bend as an Economic Development Target Area. NOW THEREFORE, BE IT ORDAINED BY THE SOUTH BEND COMMON COUNCIL, as follows: SECTION I . The Common Council finds the designation of said South Bend Central Development Area as an Economic Development Target Area to be of economic benefit to the City of South Bend and its citizens. SECTION II . The Common Council adopts the Finding of Facts adopted by the South Bend Redevelopment Commission on June 14 , 1985 as evidence that the South Bend Central Development Area has become undesirable or impossible for normal development and occupancy because of a lack of development, cessation of growth, deterioration of improvements or character of occupancy, age, obsolescence, substandard buildings, or other factors that have impaired values or prevent a normal development of property or use of property; SECTION III . Chapter 2 , Article 13 , of the South Bend Municipal Code shall be amended to delete in their entirety subsections (a) , (b) , and (c) , and to add a new subsection (a) , which shall read as follows: The area commonly known as the South Bend Central Development Area, a parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the point of intersection of the south right-of-way line of Sample Street with the west right-of-way line of Michigan Street; thence north along said west right-of-way line of Michigan Street to its intersection with the northerly line of the Conrail Railroad (formerly Penn Central) right-of-way; thence northwesterly along said northerly railroad right-of-way line to its intersection with the southerly projection of centerline of the first 14 foot alley lying west of Lafayette Boulevard; thence north along said projection and the centerline of said 14 foot alley to the south right-of-way line of Washington Street; thence west along said south right-of-way line to the east right-of-way line of William Street; thence north along said east right-of-way line to the north right-of-way line of Colfax Avenue; thence east along said north right-of-way line to the centerline of the first 14 foot alley lying west of Lafayette Boulevard; thence north along said centerline, in certain places being sometimes known as St. James Court, to the north right-of-way line of LaSalle Street; thence east along said north right-of-way line to the west right-of-way line of Michigan Street; thence north along said west right-of-way line to the westerly projection of the north line of Lot 111 in the Original Plat to the Town, now City of South Bend; thence east along said projection, the north line of said Lot 111 and its easterly projection to the centerline of the St. Joseph River; thence meandering northeasterly and northwesterly along said centerline to the westerly projection of the south right-of-way line of Corby Street; thence east along said projection and the south right-of-way line of said Corby Street to the centerline of the first 14 foot alley lying west of Hill Street; thence south along said centerline to the north right-of-way line of Crescent Avenue; thence southeasterly to the point of intersection of the south right-of-way line of said Crescent Avenue with the centerline of the first 14 foot alley lying west of said Hill Street; thence southeasterly, southwesterly and south along the centerline of said alley to the centerline of the first 14 foot alley lying north of Cedar Street; thence east along said centerline to the centerline of the first 14 foot alley lying east of Hill Street; thence south along said centerline to the south right-of-way line of Jefferson Boulevard; thence west along said south right-of-way line to the centerline of the St. Joseph River; thence southeasterly along said centerline to the easterly projection of the southerly right-of-way line of Monroe Street; thence southwesterly along said projection and the southerly right-of-way line of Monroe Street to the easterly right-of-way line of Lincolnway East (U.S. Highway #33) ; thence southeasterly along said easterly right-of-way line to the south right-of-way line of Sample Street; thence west along said south right-of-way line to the place of beginning. SECTION IV. Nothing herein shall affect the validity of any action taken under any previously designated Economic Development Target Areas known as the Central Downtown, the East Bank Development Area and the Monroe-Sample Development Area, which are now located within the above designated Economic Development Target Area. SECTION V. This Ordinance shall be in full force and effect from and after its passage and signature by the Mayor. I • • RESOLUTION NO. RESOLUTION OF THE SOUTH BEND ECONOMIC DEVELOPMENT COMMISSION DECLARING CERTAIN AREAS OF THE CITY OF SOUTH BEND TO BE ECONOMIC DEVELOPMENT TARGET AREAS. WHEREAS, I.C. 36-7-12 has been amended by the Indiana General Assembly to provide -for the designation of specific geographic areas in the City of South Bend to be Economic Development Target Areas; and WHEREAS, I.C. 36-7-12-38 requires the favorable recommendation by the Economic Development Commission to designate certain geographic territories in the City of South Bend as Economic Develpoment Target Areas; and WHEREAS, the Economic Development Commission, on October 21, 1983, declared three specific geographic territories of the City of South Bend to be Economic Development Target Areas pursuant to I .C. 36-7-12-38, such areas being declared redevelopment areas by the South Bend Redevelopment Commission prior to March 31, 1983 ; and WHEREAS, the three redevelopment areas that were declared to be Economic Develpoment Target Areas on October 21, 1983 have been combined and expanded into a redevelopment area known as the South Bend Central Development Area; and WHEREAS, the South Bend Economic Development Commission finds the designation of said South Bend Central Development Area as an Economic Development Target Area to be of economic benefit to the City of South Bend and its citizens; For purposes of increasing established economic development target areas for purpose of issuing economic development commission bonds for certain economic development facilities , the Economic Development Commission, on November 15 , 1985, passed a Resolution expanding the existing target area.
