AN ORDINANCE TO VACATE THE FOLLOWING-DESCRIBED
PROPERTY: (1) THE NORTH-SOUTH RIGHT-OF-WAY
BOUNDED BY JEFFERSON BOULEVARD ON THE NORTH AND
THE RIGHT-OF-WAY OF THE GRAND TRUNK WESTERN RAIL-
ROAD COMPANY ON THE SOUTH, BEING THE SAME 33-FOOT
RIGHT-OF-WAY RUNNING ALONG THE ENTIRE EASTERN
BOUNDARY OF FERNWOOD ADDITION TO THE CITY OF
SOUTH BEND, AS SHOWN ON THE PLAT THEREOF, RE-
CORDED JULY 12 , 1945, IN PLAT BOOK 15 , PAGE F
IN THE OFFICE OF THE RECORDER OF ST. JOSEPH
COUNTY, INDIANA AND (2) THE EAST-WEST STREET
KNOWN AS SUNNYMEDE AVENUE IN FERNWOOD ADDITION
TO THE CITY OF SOUTH BEND.
STATEMENT OF PURPOSE AND INTENT
Pursuant to IND. CODE §36-7-3-12 , the Common Council
is charged with the authority to hear all petitions to vacate
public ways or public places with the City.
The following ordinance vacates the above-described
public property:
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I . The Common Council of the City of South
Bend having held a public hearing on the petition to vacate the
following property:
1. The north-south right-of-way bounded by Jefferson
Boulevard on the north and the right-of-way of the Grand Trunk
Western Railroad Company on the south, being the same 33-foot
right-of-way running along the entire eastern boundary of Fernwood
Addition to the City of South Bend, as shown on the plat thereof,
recorded July 12 , 1945 , in Plat Book 15 , Page F, in the Office of
the Recorder of St. Joseph County, Indiana.
2. The east-west street known as Sunnymede Avenue in
Fernwood Addition to the City of South Bend, Indiana, hereby
determines that it is desirable to vacate said property.
SECTION II:. The City of South Bend hereby reserves
the rights and easements of all utilities and the Municipal City
of South Bend, Indiana, to construct and maintain any facilities ,
including, but not limited to, the following: electric, tele-
phone, gas, water, sewer, surface water control structures and
ditches, within the vacated right-of-way, unless such rights are
released by the individual utilities.
SECTION III. The following property may be injuriously
or beneficially affected by such vacating:
Holy Cross Health System Corporation
3606 East Jefferson Boulevard
South Bend, Indiana 46615
Lots five (5) through fifteen (15) , both inclusive,
as shown on the recorded plat of Fernwood Addition
to the City of South Bend, recorded July 12 , 1945 ,
in Plat Book 15, Page F, in the Office of the Re-
corder of St. Joseph County, Indiana.
SECTION IV. The purpose of the vacation of the real
property is to allow Holy Cross Health System Corporation to use
part of the same for access and parking in connection with its
offices at 3606 East Jefferson Boulevard, South Bend, Indiana,
and the expansion thereof, and that the other abutting property
owners may enjoy the use of the remaining parts thereof.
SECTION V. This ordinance shall be in full force and
effect from and after its passage by the Common Council and
approval by the Mayor.

CITY OF SOUTH BEND, INDIANA
WE, THE UNDERSIGNED, being owners of contiguous property,
hereby petition you to vacate the following property located in
the City of South Bend, Indiana:
1. The north-south right-of-way bounded by Jefferson
Boulevard on the north and the right-of-way of the Grand Trunk
Western Railroad Company on the south, being the same 33-foot
right-of-way running along the entire eastern boundary of Fernwood
Addition to the City of South Bend, as shown on the plat thereof,
recorded July 12, 1945 , in Plat Book 15 , Page F, in the Office of
the Recorder of St. Joseph County, Indiana.
2 . The east-west street known as Sunnymede Avenue bounded
on the west by the east right-of-way line of 35th Street and on the
east by the west line of Lots 10 and 15 of Fernwood Addition to the
City of South Bend, Indiana.
Vacation of the aforementioned property is requested so
that the petitioner, Holy Cross Health System Corporation, may use
part of the same for access and parking in connection with its
offices at 3606 East Jefferson Boulevard, South Bend, Indiana 46615 ,
and the expansion thereof, and that the other abutting property
owners may enjoy the use of the remaining parts thereof.
Attached to this petition is a list of names and addresses
of all abutting property owners and addressed, stamped envelopes
for all such abutting property owners .

Dear Members of the Council :
In accordance with Municipal Code Section 18-53 . 8 , a favorable
recommendation is being submitted to the Common Council
concerning the Vacation Petition filed by Attorney John B. Ford,
Jones , Obenchain, Ford, Pankow & Lewis , 1800 Valley American Bank
Building, South Bend, Indiana, on behalf of the Petitioning
Property Owners , Holy Cross Health System Corporation, 3606 East
Jefferson Boulevard, Louann Becker, 430 35th Street and Tamara L.
Mason, 3503 Sunnymede, South Bend, Indiana, to vacate the
north/south right-of-way bounded by Jefferson Boulevard on the
north and the right-of-way of the Grand Trunk Western Railroad
Company on the south, being the same 33-foot right-of-way running
along the entire eastern boundary of Fernwood Addition to the
City of South Bend, as shown on the Plat thereof, recorded July
12 , 1945 , in Plat Book 15 , Page F in the Office of the Recorder
of St . Joseph County, Indiana, and the east/west street known as
Sunnymede Avenue in Fernwood Addition to the City of South Bend.
For your information, a Public Hearing concerning this proposed
vacation was held on April 22 , 1986 . As required by ordinance,
owners whose property abut the proposed property to be vacated
were notified of the Board' s Public Hearing date.
Attorney John B. Ford, on behalf of the Petitioning Property
Owners , was present and spoke in favor of the vacation. There
was no one else present wishing to speak either for or against
the proposed vacation and no written objections were received by
the Board. A copy of the excerpts of the minutes of the Board' s
Public Hearing is attached for your information.
