GAMMON Approved and signed by me _ a. 9 Mayor • ORDINANCE NO. 7(3V-te AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED IN THE 4500/4600 WEST BLOCK OF THE CLEVELAND ROAD EXTENSION, IN THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: A parcel of land being a part of the Northwest Quarter of Section 21 , Township 38 North, Range 2 East, in German Township, St. Joseph County, Indiana, and being more particularly described as follows : Commencing at the intersection of the west line of said Northwest Quarter with the northerly right-of-way line of the Indiana East-West Toll Road, said intersection being 337.19 feet northerly of the West Quarter Corner of said Section 21 , and being marked by a brass monument set in concrete; thence easterly 80.64 feet along said northerly right-of-way line along an arc to the right having a radius of 5879.58 feet and subtended by a chord of 80.64 feet bearing South 83 032120" East (all bearings in this description being relative to an assumed bearing of N90°00'00" East for the north line of said Northwest Quarter) to an iron pipe found in place; thence North 0°06103" East, parallel with and 80.50 feet easterly of said west line of the Northwest Quarter, a measured distance of 336.78 feet to a one inch square iron pipe set this survey marking the northwest corner of a parcel of land described in Deed Record 819, page 596, in the Office of the Recorder of St. Joseph County, Indiana, said corner being on the northerly right-of-way line of Cleveland Road and being the point of beginning for this description; thence continuing North 0 006103" East, a measured distance of 669.74 feet to a one inch square iron pipe set this survey at a point which is South 0 006103" West a distance of 1281 .30 feet from said north line of the Northwest Quarter; thence South 89°14 '27" East, along a southerly line of a parcel of land described as Tract "0" in Deed Record 765, page 529, in said Office of the Recorder, a measured distance of 561 .72 feet to an iron pipe found in place; thence South 0°05102" West, along a westerly line of said Tract "D" , a measured distance of 795.17 feet to a one inch square iron pipe set this survey marking the northerly right-of-way of said Cleveland Road; thence North 76°41125" West, along said northerly right-of-way line, being the northerly line of said parcel described in Deed Record 819, page 596, a measured distance of 577.18 feet to the point of beginning, containing 9.446 acres , more or less . be and the same is hereby established as "D" Light Industrial , "s" Height and Area. DATE RECEIVED BY THE AREA PLAN COMMISSION The Area Plan Commission of St. Joseph County, Indiana makes application and petitions the .Common Council of the City of South Bend, Indiana to amend the zoning ordinance as herein requested. 1 ) The property sought to be rezoned is located at: 22901 New Cleveland Road, which is on the North side of Cleveland Road, 2600 feet east of the intersection of Mayflower and Cleveland Roads. 2) Name and address of property owner: Trans Tech Properties P. 0. Box 3915 22901 Cleveland Road South Bend, Indiana 46619 3) At present no contingent purchasers have been identified. 4) It is desired and requested that this property be rezoned from "A" Residential , "A" Height & Area (Prior to Annexation, "C" Commercial in the County) to "D" Light Industrial , "A" Height & Area 5) This rezoning is requested to allow all uses permitted under the zoning district of "D" Light Industrial . 6) Attached is a copy of (a) legal description of the rezoning site; (b) a list of all property owners within 300 feet of the rezoning site. The Area Plan Commission gave it a public hearing on January 21, 1986 and February 19, 1986, at which time the following action was taken: Upon a motion by Chuck Sausman, being seconded by Joseph Serge, and unanimously carried, the proposed ordinance initiated by the Area Plan Commission to zone from "A" Residential , "A" Height and Area to "D" Light Industrial , "A" Height and Area, property located in the 4500/4600 block of the New Cleveland Road, City of South Bend is sent to the Common Council with a favorable recommendation The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. EXISTING LAND USE: The property contains the facilities of Trans Tech Electric, Inc. SURROUNDING LAND USE AND ZONING: Located to the north, east and west is vacant land zoned "R" Residential in St. Joseph County, and to the south across New Cleveland Road is the Indiana Toll Road. ACCESS: Access to the site is from New Cleveland Road. February 11 , 1986 STAFF COMMENTS: This petition was tabled at the Commission meeting of January 21 , 1984.
