AN ORDINANCE AMENDING CHAPTER 6 OF THE
SOUTH BEND MUNICIPAL CODE ENTITLED BUILDING
STATEMENT OF PURPOSE AND INTENT:
The Council finds it necessary to correct technical
errors in Ordinance No. 7616-86 .
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS :
SECTION I. Chapter 6, Article 2, Section 6-6 .5(d) (1) (e)
shall be amended to read as follows :
(e) The area of the subject property is not congested .
Congestion shall be defined as a condition where the ratio of the
total square footage of buildings and structures to the total
square footage of vacant land on the subject parcel and all
parcels abutting the subject property parcel is more than 1.15 :1 .
SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and the Indiana Fire Prevention and Building Safety
Commission and legal publication.

Dear Council Members:
On March 11 , 1986 , the South Bend Common Council passed a
bill amending Chapter 6 of the South Bend Municipal Code.
There are two errors in the recently passed building code
amendment. In Section 6-6 .5 (d) (1) (e) , the word vacant needs
to be deleted in the fourth line of section e and property
should be changed to parcel in the fifth line of that
section.
