DUDA Approved and signed by me April 16, 20 03 City Clerk President of Common Council City Clerk Mayor Ordinance No. ~ ~ ~ ~' ~ ~3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 1, OF THE SOUTH BEND MUNICIPAL CODE OF BY THE INCLUSION OF NEW DI VISION I ENTITLED YOUTH ADVISORY COUNCIL STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend, Indiana, recognizes that the 2000 statistics of the U.S. Census Bureau indicate that 25.7°Io of St. Joseph County's population of 265,559 is under 18 years of age. It also shows that 82.4°10 of persons 25 years or older living in the county are high school graduates and that of that same age range 23.6010 have earned a Bachelor's degree or higher. The City of South Bend, Indiana, is the fifth largest city in the State of Indiana with a population of 107,789. The 2000 census data for the City of South Bend indicated that there are 7,532 male youth between the ages of 10 to 19 and that there are 7,226 female youth between the ages of 10 to 19 years of age. The South Bend Community School Corporation provides educational opportunities to 21,5000 students in kindergarten through the 12th grade, and serves an additional 5,000 adults in its adult education program. There are currently four (4) public high schools in the South Bend Community School Corporation with the following current student enrollments: Adams 1,568; Clay 1,604; Riley 1634; and Washington 1,274; as well as private high schools serving our city. South Bend Community School Corporation currently has nine (9) Intermediate Centers for grades 5-8. The City of South Bend also has six (6) private high schools located within its borders, namely St. Joseph High School with a high school student population of approximately 730, Trinity School with a high school student population of approximately 250, Community Baptist Christian School with a high school student population of approximately 85, the Christian Center with a high school student population of approximately 55, Ironwood Christian School with a high school student population of approximately 25, and The Rabbi Naffali Riff Yeshiva with a high school student population of approximately 40. There are many issues which arise in city government and in the South Bend community and its many neighborhoods that may be of interest to the youth. Such topics may include, but may not be limited to educational and recreational opportunities, as well as employment, social service and health care offerings. City government can directly benefit from the input of the youth in our community by developing a concept of positive youth involvement by providing opportunities to enhance citizenship skills of the youth and providing interaction with city governmental officials, agencies, boards, commissions and the legislative body. The creation of a Youth Advisory Council would provide a means for youth to positively connect with city government and provide an educational partnership with schools serving the educational needs of youth in the City of South Bend, Indiana. ~o~n, ~~~r~or~, ~ it or~a~i><t~b ~~ t.~¢ common ~toutt>riz of ~~ ~Lit~ o~ ~ottf.~j ~~tCb, ~ln~ia~na~, as follows: Youth Advisory Council Ordinance Page 2 Section I. The Common Council of the City of South Bend, Indiana, hereby amends Chapter 2, Article 1 of the Ma~nicipal Code of South Bend by the inclusion of the new Division I which shall read in its entirety as follows: DIVISION I. YOUTH ADVISORY COUNCIL. SEC. 2-12.1.1 YOUTH ADVISORY COUNCIL CREATED- PURPOSE. (a) A Youth Advisory Council is created for those of high school age, through the age of 21 years of age. A Youth Advisory Council is established to enhance citizenship skills and to serve the best interests of youth in the City of South Bend, Indiana. (b) A Junior Youth Advisory Council, under the supervision of the Youth Advisory Council, may be created no earlier than the Fall of 2004, to foster citizenship skills of youth of intermediate center age. The Youth Advisory Council would be required to prepare and file proper legislation for Common Council consideration, when it has determined that the Junior Youth Advisory Council should be created. Such Junior Youth Advisory Council would be representative of all public and private intermediate centers operating within the City of South Bend, Indiana. SEC. 2-12.1.2 MEMBERSHIP OF THE YOUTH ADVISORY COUNCIL. (a) The Youth Advisory Council shall be composed of not less than nineteen (19) members. Membership and shall represent the rich diversity of the city's youth with regard to gender, race, ethnic, socio-economic, and religious backgrounds Youth Council Advisory Council Members shall include: 1. One (1) Youth Member shall be appointed to represent each of the six (~ Councilmanic Districts, 2. One (1) Youth Member shall be appointed or elected to represent each public and private high school operating within the city limits of South Bend; and 3. Three (3) Youth Members shall be appointed to be at large members. (b) Upon passage of this ordinance, the Office of the City Clerk shall provide to each Council Member, the Mayor, and each High School Principal, Youth Advisory Council application forms which shall be completed by youth interested for consideration on the Youth Advisory Council. Said application forms shall be available and kept on file in the Office of the City Clerk during regular business hours. Additionally, application forms shall be made available on the City's website. (c) All youth interested for consideration shall obtain and complete in its entirety an application form and file it, along with two (2) written references from non-related adults, with the Office of the City Clerk. (d) The Office of the City Clerk, by the application deadline, shall assimilate all information and timely distribute copies of all applications and references to the appropriate offices for consideration. Youth tldvisory Council Ordinance Page 3 (e) Each District Common Council Member shall review all applications received from the Office of the City Clerk requesting consideration for appointment as the District Youth Council Member. All youth interested in representing a Councilmanic District must be a resident of the City of South Bend, Indiana. (f) The Mayor, in consultation with the three (3) At Large Common Council Members, shall review all applications received from the Office of the City Clerk requesting consideration for appointment as an At Large Youth Council Member. All youth interested in representing an At Large position must be a resident of the City of South Bend and must represent the rich diversity of the community. No more than one (1) At Large Youth Council Member may be a high school graduate and currently attending college. (g) Each high school represented by the Youth Advisory Council shall develop its own process for selecting/electing one (1) youth member to serve on the Youth Advisory Council. The Office of the City Clerk shall send to each Principal, Head of School, or Administrator all applications and references for consideration as soon as practicable after the filing deadline. (h) All Youth Advisory Council positions shall be filled by May 15th for the first year of the existence of the Youth Advisory Council, with all youth positions thereafter being completed by September lst. (i) The President of the Common Council and the Chairperson of the CounciI's Community Relations Committee shall appoint youth mentors of college and/or graduate school age who will provide assistance and guidance throughout the year to the Youth Advisory Council Members. The youth mentors shall interface with the legislative, administrative and educational liaisons identified in Sec. 2-12.1.5. SEC. 2-12.1.3 OFFICERS AND TERMS OF OFFICE OF THE YOUTH ADVISORY COUNCIL. (a) At the second meeting of the Youth Advisory Council held each calendar year, a Chairperson, Vice-Chairperson and Recording Secretary shall be selected. A listing of all Youth Advisory Council members by name, address, telephone number, email address, school, and year of education shall be submitted to the Office of the City Clerk by email for distribution to the Common Council, the Mayor, School Superintendents, the Principal of each high school, and the news media. Such listing shall include all officers by name and position. (b) Terms of office of Youth Advisory Council members shall be for one (1) year commencing September 1st, with reappointments of the same youth member permitted for one (1) additional year. (c) The Youth Advisory Council shalt meet monthly and shall maintain a record of their meetings. Such meeting minutes shall be submitted to the Office of the City Clerk by email for distribution to the Common Council, the Mayor, School Superintendents, the Principal of each high school and for posting on the City of South Bend's official website. Youth Advisory Council Ordinance Page 4 SEC. 2-12.1.4 DUTIES OF YOUTH ADVISORY COUNCIL MEMBERS (a) Each Youth Advisory Council Member shall be required to attend monthly meetings of the Youth Advisory Council, with one (1) excused absence permitted each yeaz. (b) Each Youth Advisory Council Member shall be required to attend not less than two (2) committee meetings of any Standing Committee of the South Bend Common Council, one (1) regular Common Council meeting, and one (1) school board meeting by the end of December of each year. (c) Each Youth Advisory Council Member shall be required to attend the 2nd Common Council meeting in January where the Mayor presents his or her annual State of the City Address. (d) Each Youth Advisory Council Member shall participate in the annual "Civic Day" activities occurring in February at the County-City Building. (e) The Youth Advisory Council may monitor other city boazds and commissions for issues related to youth and make recommendations for such boards or commissions consideration when deemed appropriate. SEC, 2-12.1.5 INITIATIVES RESPONSIBILITIES AND GOALS TO BE ADDRESSED BY THE YOUTH ADVISORY COUNCIL MEMBERS. (a) The Youth Advisory Council shall develop: 1. Mission Statement; 2. Committee structure if deemed necessary; 3. Composite of the youth in the high school or district he or she is representing; 4. Newsletters and other means of community with youth in the city; 5. Grant proposals; 6. Initiatives and Goals to be addressed, including but not limited to: I. Leadership opportunities; II. Civic responsibilities; III. Educational opportunities; I V. Youth perspectives on local issues; V. Working with the Indiana Youth Institute; YouEh Advisory Council Ordinance Page 5 VI. Creating a means of formal communication between city officials and youth in our community; VII. Creating a model for youth involvement; and VIII. Partnering with local, state, federal, and international organizations which focus on youth involvement and development. 7. Indicators of measuring success (b) The Youth Advisory Council shall interact with school and governmental officials for the creation of an official website which would be monitored and maintained by the City of South Bend in calendar years ending in odd-numbered years and by the South Bend Community School Corporation in calendar years ending in even-numbered years. (c) The Youth Advisory Council shall make recommendations to enhance participation of youth throughout the community, to improve communications with school and governmental entities, and to improve employment opportunities for youth in the community. (d) At the first Common Council meeting of each yeaz, the Youth Advisory Council shall address the Common Council under the "Special Business" portion to provide an annual report of its activities, initiatives and objectives. SEC. 2-12.1.6 LIAISONS TO THE YOUTH ADVISORY COUNCIL. (a) The Chairperson of the Common Council's Community Relations Committee shall be the legislative liaison to the Youth Advisory Council and be available for mentoring duties. (b) The Mayor shall designate one of his Administrative Assistants to be the Administrative liaison to the Youth Advisory Council and be available for mentoring duties. (c) The School Superintendent for the South Bend Community School Corporation shall designate at least one (1) high school principal to be the educational liaison to the Youth Advisory Council and be available for mentoring duties. (d) The Principal, Head of School or Administrator of each private high school shall designate one (1} individual from their high school to be the educational liaison to the Youth Advisory Council and be available for mentoring duties. Section II. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor and gal publication. First District Our city is fortunate to have a rich diversity of youth who are attending four (4) Charlotte D. Pfeifer public high schools and six (6) private high schools. The Youth Advisory Council Second District would provide new opportunities for the youth of our city to be positively involved. Some of these activities would be aimed at enhancing citizenship skills through Roland Kelly interaction with city governmental officials and its many boards and agencies. It Third District would also provide a vehicle to establish communication between high school students in all of the learning centers of our community. Karl King Fourth District The Youth Advisory Council (YAC) is proposed to have not less than nineteen (19) members. YAC would meet on a monthly basis and work closely with college age David Varner mentors and liaisons who represent the Mayor's Office, the Common Council, the Fifth District South Bend Community School Corporation and each of the private high schools.
