AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY
LOCATED IN 5200 BLOCK OF WEST LINDEN AVENUE
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
SECTION I. Ordinance No. 4990-68, as amended, which
ordinance is commonly known as the Zoning Ordinance of the City
of South Bend, Indiana, be and the same hereby is amended in
order that the zoning classification of the following described
real estate in the City of South Bend, St. Joseph County, State
of Indiana:
A part of the Northwest 1/4 of the Northeast 1/4 of
Section 8, Township 37 North, Range 2 East in Portage
Township, City of South Bend, St. Joseph County,
Indiana, described as follows:
Beginning at a point on the North line of said Section
490.00 feet North 90° 00 ' 00" East (assumed bearing)
of the Northwest corner of said Northeast 1/4 of
Section 8; thence South 00° 00 ' 00" East 533.28 feet;
thence South 89° 56' 15" East 10 .84 feet; thence
Easterly 143.17 feet along an arc to the left having a
radius of 683 .58 feet and subtended by a long chord
having a bearing of North 84° 03' 49" East and a
length of 142.91 feet; thence North 78° 03' 45" East
43 .64 feet; thence Northerly 219 .67 feet along an arc
to the right having a radius of 1203.395 feet and
subtended by a long chord having a bearing of North
05° 13' 46" West and a length of 219 .36 feet; thence
North 00° 00 ' 00" East 291.03 feet to the North line
of said Section, said point being 206 .00 feet North
90° 00' 00" West of the Northwest corner of Bellewood
3rd Unit, an addition to the City of South Bend
recorded in Plat Book 21, Page B-9 and B-9A,
December 16 , 1963 in the St. Joseph County Recorder's
Office; thence North 90° 00' 00" West along the North
line of said Section, 176 .07 feet to the point of
beginning and containing 2.1625 acres more or less,
being lots 174 thru 181 and the Easterly half of Lot
182 in the proposed plat of Mayflower 5th Unit to the
City of South Bend for which preliminary approval was
granted by the Area Plan Commission of St. Joseph
County, Indiana, March 21, 1972.

approximately One Hundred (100) members.
Note: Rezoning, as requested herein, was approved by
the Area Plan Commission and the Common Council
of the City of South Bend in the Fall of 1983.
Due to an unawareness on the part of the
Petitioner that the Ordinance was for one (1)
year only, the zoning reverted to "A"
Residential before construction could begin on
the subject real estate.

Re: A proposed ordinance and site development plan of The John Carroll Club of
South Bend, Inc. to zone from "A" Residential , "A" Height and Area to "C"
Commercial , "A" Height and Area, property located on the south side of
Linden Avenue approximately 490 feet east of Mayflower Road, City of South
Bend
Gentlemen:
The above referenced ordinance and site development plan of The John Carroll
Club of South Bend, Inc. was legally advertised February 7 and February 8,
1986. The Area Plan Commission gave it a public hearing on February 18, 1986,
at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by Rene
Vandewalie and unanimously carried, the proposed
ordinance and site development plan of The John Carroll
Club of South Bend, Inc. to zone from "A" Residential ,
"A" Height and Area to "C" Commercial , "A" Height and
Area, property located on the south side of Linden
Avenue approximately 490 feet east of Mayflower Road,
City of South Bend is sent to the Common Council with a
favorable recommendation subject to a Final Site
Development Plan
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

REQUESTED ACTION: The petitioners are requesting a zone change from
"A" Residential ` "A" Height and Area to "C"
Commercial , "A" Height and Area to allow for the
construction of a Knights of Columbus hall .
EXISTING LAND USE: The property is vacant.
SURROUNDING LAND USE AND ZONING: Located to the north across Linden Avenue is a
single-family home zoned "A" Residential ; to the
east across the proposed Summit Drive extension is
vacant property zoned "A" Residential ; to the
south is vacant property zoned "A" Residential ;
and to the west is vacant land zoned "C"
Commercial .
ACCESS:• Access to the site will be from Linden Avenue.
• DRAINAGE; The drainage will be accommodated via drywells.
DATA: The total site to be rezoned is 2. 16 acres. Of
that, the building will occupy 3`200 square feet ,
or 3. 4% of the site; the parking and drives will
occupy 11 `675 square feet, or 12. 4% of the site,
and 1 . 82 acres or 84.2% of the site will remain as
open space.
SITE PLAN; The site plan is preliminary.
AGENCY COMMENTS: The City Engineer made the following comments:
"1 . City sanitary sewer and water are
available to the site.
2. The drywpIls as shown are adequate.

3. The off street parking as shown, one per

• one hundred square feet exceeds the
• requirements for social/private clubs.
STAFF COMMENTS: A previous petition to rezone this site was filed
in 1983 and approved by the Common Council on
November 14, 1983, subject to a final site p\an.
That zoning was also for a Knights of Columbus
hall . A final site plan was never turned in and
the zoning approval expired on November 14' 1984.
