GAMMON Approved and signed by me 3 ig &":6 /7 az, /' Mayor ORDINANCE NO. --7 (,,o 3 -- 8'b AN ORDINANCE TO VACATE THE NORTH-SOUTH STREET COMMONLY KNOWN AS GREENLAWN AVENUE, BETWEEN RUSKIN AND NORTHSIDE BOULEVARD LOCATED NEAR I.U.S.B. , AND A PORTION OF HILDRETH STREET. STATEMENT OF PURPOSE AND INTENT The vacation of the above described streets is for the purpose of initiating the first phase in the development of a landscaped quadrangle which will serve as the central core and unifying element of the IUSB campus around which future university development will occur. The new 5-story library complex will be developed as a focal point at the south terminus of the quadrangle. Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows : SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: THE NORTH-SOUTH STREET KNOWN AS GREENLAWN AVENUE (66-FOOT R.O.W. ) BETWEEN THE SOUTH R.O.W. LINE OF RUSKIN STREET AND THE NORTH R.O.W. LINE OF NORTHSIDE BLVD. , BOUNDED ON THE EAST BY THE INDIANA UNIVERSITY AT SOUTH BEND (IUSB) CAMPUS AND ON THE WEST BY LOTS 9-24, INCLUSIVE, OF MIKESELL'S ADDITION (IUSB PROPERTY) , THE HILDRETH STREET R.O.W. AND THE U.S. ARMY RESERVE CENTER (CITY PROPERTY) ; AND, THE EAST 190.11 FEET OF THE EAST-WEST STREET KNOWN AS HILDRETH STREET (40-60 FOOT R.O.W. ) BETWEEN AN EXTENSION OF THE WEST LOT LINE OF LOT 115 OF THE BELLEVUE ADDITION AND THE WEST R.O.W. LINE OF GREENLAWN AVENUE, BOUNDED ON THE NORTH BY LOT 115 OF THE BELLEVUE ADDITION, A VACATED 14-FOOT NORTH-SOUTH ALLEY AND LOT 21 OF MIKESELL'S ADDITION (ALL IUSB PROPERTY) AND ON THE SOUTH BY LOT 116 OF THE BELLEVUE ADDITION (IUSB PROPERTY) , A PUBLICLY DEDICATED 14-FOOT NORTH-SOUTH ALLEY AND LOT 22 OF MIKESELL'S ADDITION (IUSB PROPERTY) . hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: A. No property will be injuriously affected, since additional right-of-way will be provided and a cul-de-sac constructed at the east terminus of Hildreth Street and dedicated for public use. B. All Indiana University at South Bend (IUSB) property on both sides of the requested vacated Greenlawn Avenue and Hildreth Street R.O.W. 's will be beneficially affected by the development • SECTION IV. The purpose of the vacation of the real property is to: Initiate the first phase in the development of a landscaped quadrangle along and within the Greenlawn Avenue and Hildreth Street R.O.W. 's which will serve as the central core and unifying element of the IUSB campus around which future university development will occur. The quadrangle will be anchored by a new 5-story library complex at its south terminus. SECTION V. Wolfson, Chancellor, Indiana University at South Bend, 1700 Mishawaka Avenue, South Bend, Indiana, to vacate the following streets and alleys : The north/south leg ( 127 ' x 14 ' ) of which is bounded on the north by the south R.O.W. line of Hildreth Street , on the east by Lots 22 , 23 and 24 , inclusive , of Mikesell ' s Addition (IUSB property) , on the south by the U. S . Army Reserve Center (City property) and on the west by Lot 116 of the Bellevue Addition (IUSB property) ; The east/west leg (37 .5 ' x 14 ' ) of which is bounded on the north by Lot 116 of the Bellevue Addition (IUSB property) , on the east by the north/south leg of the alley, on the south by the U. For your information, a Public Hearing concerning these proposed vacations was held on February 11 , 1986 . As required by ordinance, owners whose property abut the proposed property to be vacated were notified of the Board' s Public Hearing date. Mr. Marty Kleva, Cole Associates , Inc . , was present on behalf of the Petitioner and informed the Board of Indiana University' s proposed use for the property to be vacated. Mr. Kleva addressed concerns regarding construction of a cul-de-sac at Hildreth Street and the dedication of right-of-way for a new alley. There was no one else present wishing to speak either for or against the Petitions and no written objections were filed with the Board. A copy of the excerpts of the minutes of the Public Hearing is attached for your information. Therefore, the Board of Public Works favorably recommends vacation of the above referred to alleys and streets contingent upon the completion of public improvements and construction and dedication of right-of-way prior to the vacation taking effect and subject to any and all utility easements .
