Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Parcel I: Lots 2, 3, 4, 5, 6, 7, and 8 as shown on the recorded Plat of Tuxedo Park First Addition to the City of South Bend, Portage Township, St. Joseph County, Indiana, together with the strip of land 35 feet in width, more or less, running along the entire East side of said Lot 8 from the North line of Jefferson Boulevard, North to the South line of Marshall Street, being the same and identical strip of land which was formerly known as 26`h Street and which was heretofore vacated as a public street by action of the Board of Public Works and Safety under Vacation Resolution No: 2824, St. Joseph County, Indiana; and Parcel II: Lots 21, 22, and 23 as shown on the recorded Plat of Swanson Park, Second Addition, City of South Bend, Portage Township, St. Joseph County, Indiana, as recorded in Plat Book 18, Page S in the Office of the Recorder of St. Joseph County, Indiana. be and the same is hereby established as "PHC" Profession/Health Care District. The Area Plan Commission at its public hearing on March 18, 2003, took the following action: IIpon a motion by Lloyd Taylor, being seconded by John McNamara and carried, the proposed ordinance initiated by the Area Plan Commission to zone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care District, property located at the northeast corner of Bast Jefferson Boulevard and Tuxedo Drive, City of South Bend is sent to the Common Council with a favorable recommendation with the understanding that there will be a 25 foot setback with screening from Marshall Street with the exception of any existing building encroachment= a 25 foot setback with screening from the east property liner that the access from Holiday Drive will be closeds and that any new buildings will not be over two stories in height. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Byorn JWB:sr Attachment Serving South Bend, Lakeville, New Carlisle, North Liberty, Osceola, Roseland and St. Joseph County, Indiana STAFF REPORT March 10, 2003 Initiated by the Area Plan Commission 2191-03 Location: the northeast corner of East Jefferson Boulevard and Tuxedo Drive City of South Bend RESTED ACTION: The petitioner is requesting a zone change from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care District to allow permitted uses in the "PHC" Professional/Health Care District. EXISTING LAND USE: The property contains a vacant hosptial building and its associated buildings. SURROUNDING LAND USE AND ZONING: Located to the north and west are single family homes zoned "A" Residential, "A" height and area; located to the south is a church zoned "A" Residential, "A" height and area, and multi-family buildings zoned "B" Residential, "B" height and area; and located to the east is a multi-family complex zoned "A" Residential, "A" height and area. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings initiated by the Area Plan Commission. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation. This rezoning will bring the property's zoning into conformance with the current use and will provide for the future redevelopment of this property. WILSON ST.
