ORDINANCE NO. `] C,y'S_- AN ORDINANCE AMENDING CHAPTER 20 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED "TRUCK ROUTES" STATEMENT OF PURPOSE AND INTENT: Because the Council considers the concerns of citizens and their desire to have a quality of life which is not impeded by commercial vehicle traffic and nuisance noise , the following ordinance updates truck route provisions, sets forth reasonable and responsible regulations for commercial vehicles in order to meet existing traffic demands . NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. Chapter 20, Article 8, is deleted in its entirety and shall read as follows : Article 8 . Truck Routes Section 20-106. Definitions . (A) As used in this article , the following terms shall mean: ( 1) "Truck" as the term is used in this section, is a vehicle with an overall length of twenty ( 20) feet or more, or over one ( 1) ton capacity, and includes semi-trailer trucks and either the tractor pulling the same , or the trailer itself. Truck includes every self-propelled commercial vehicle used for the transport of goods or property described as follows : (a) From a point outside the City through the City to a point outside the City; (b) From a point outside the City to a point within the City limits; or (c) From a point within the City limits to a point outside the City limits. (d) From a point within the City limits to a point within: the City limits. Section 20-107. Truck Routes . ( 1) No person shall operate an truck as defined in Section 20-106 within the corporate limits of the City of South Bend , except upon the following streets and parts of streets shown upon a map entitled "Schedule A-i" , incorporated herein by reference . At least two ( 2) copies of said map shall be on file in the Office of the Clerk for public inspection. Michigan St . from Western to City Limits (Johnson Road) Route 15 U.S. 31-33 (Michigan St . ) from the North City Limits (Rhodes) to the South City Limits (Johnson Road) (2) Trucks traveling from a point outside the City through the City to a point outside the City shall enter the City and proceed to the point within the City which is their destination in accordance with the shortest combination of State or Federal highways, City truck routes as shown upon a map entitled "Schedule A-1" . (3) Trucks traveling from a point outside the City to a point within the City limits shall follow State or national highways , City truck routes as shown on "Schedule A-1" from the point upon such routes which is nearest to their point of beginning . They shall not travel upon any other public streets of the City, except as provided in this article . ( 4) Trucks traveling from a point within the City limits to a point outside the City limits shall proceed from the point within the City, which is their starting point, to the City limits by the shortest combination of State and Federal highways , City truck routes shown upon "Schedule A-1 ." ( 5) Trucks traveling from a point within the City limits to another point within the City limits shall proceed from the point within the City which is their starting point, to the nearest truck route or State and Federal highway, as shown upon "Schedule A-1." 20-108. Restrictions . (a) No person shall drive truck upon any public streets not designated as a truck route in "Schedule A-1" of the City at any time ; provided that such trucks may be permitted upon such other public streets of the City, upon the direction of a City or State police officer, to follow a marked and established City detour, or to obtain necessary emergency mechanical repairs . ( b) All trucks as defined in this article shall proceed by the shortest combination of State and Federal highways , City truck routes shown upon "Schedule A-1," and shall be prohibited from driving upon any other City streets unless said vehicle is in the process of delivering or picking up goods . A written bill of lading or similar document must be produced by the driver if stopped while driving on a City street which is not designated as a City truck route as shown in "Schedule A-1," or detour route to verify such pickup or delivery. ( c) All trucks within the City as defined in this article when finished delivering or picking up goods shall return to the nearest truck route by the most direct route . This includes such trucks which have additional destinations within the City. Shortcuts on non-truck routes are expressly prohibited . (d) No person shall stop, stand or park a truck as defined in this article on any street, other than for the expeditious loading or unloading of freight, except in cases of emergency when such truck is broken down and unable to move , and except also in the event a moving van is loading or unloading furniture and household goods, or the furniture and equipment and goods, wares and merchandise of a business in either of which events the operator of such truck will have a reasonable time in which to complete his loading or unloading and move his truck. 20-109 Exceptions. The provisions of this article do not apply to vehicles operating upon tracks or carrying passengers for hire, operating by or under a permit or license of the Public Service Commission of the State or of the Interstate Commerce Commission of the United States. Section 20-109. 5. Signs . The Bureau of Traffic and Lighting is hereby authorized to cause all streets and portions thereof established and designed by this Article as truck routes to be clearly marked or signposted at their intersections with other truck routes or boundary lines of the City with appropriate signs displaying in letters not less than four ( 4) inches in height the words "TRUCK ROUTE. " Section 20-109. 7. Penalties. (a) Any person found in violation of any provision of this article shall be fined not less than fifty dollars ( $50. 00) for the first offense , no less than one hundred dollars ( $100. 00) for the second offense , and not less than two hundred fifty dollars ( $250. 00) for the third or subsequent offense , with a citation being issued for each violation. ( b) In addition to the citation procedure, a fine up to two thousand five hundred dollars ( $2, 500. 00) may be imposed upon conviction. SECTION II. This ordinance shall be in full force and effect from and after its adoption by the Common Coucil , approval by the Mayor and legal publication. Fifth District THOMASZAKRZEWSKI Complaints of noise and fumes during all hours are just Sixth District some of the many concerns brought to the Council' s JAMES V.BARCOME attention. At Large AL B.PASZEK At Large This ordinance updates the Truck Route Regulations, JOHN VOORDE which have not been updated since 1968. At Large KATHLEEN CEKANSKI•FARRAND Council Attorney Simply, what this ordinance does is to keep commercial vehicles off of residential streets, the ordinance basically states that trucks 20 feet in length or over one ton can not park on a City street, unless otherwise posted. Trucks entering, leaving, or staying within the City Limits must stay on truck routes as designated in this ordinance. The only exception is if they are making a delivery on a street which is not a truck route. Then, after the delivery, they must proceed the shortest and most direct way to the nearest truck route. When a commercial vehicle is sighted in violation of these regulations the vehicle shall be fined not less than $50. 00 for the first offense; not less than $100. 00 for the second offense; and not less than $250. 00 for the third or subsequent offense, with a citation being issued for each violation.
