City of South Bend Legal Memorandum To: Board of Public Works, Theresa Heffner, Michael Schmidt From: Jenna Throw, City Attorney Subject: Memoranda of Understanding with Teamsters Local 364 Date: September 29, 2023 The Memoranda of Understanding ("MOU") before you at the October 10, 2023 Board of Public Works meeting set forth agreements between the City and the Teamsters Local 364, as described below. The first Memorandum sets forth revisions to the Supplement for the Venues Parks & Arts Work Group pertaining to employer -provided training and associated longevity provisions associated with the receipt of training. The second Memorandum sets forth revisions to the 2023 Teamsters Salary Ordinance. The Memorandum represents the City's agreement to file an amended salary ordinance reflecting these revisions. These revisions pertain to 1) correcting a scrivener's error in the Equipment Services Work Group, 2) adding position titles at existing rates in the Venues Parks & Arts Work Group, and 3) adding new positions within the Water Works Work Group. RECITALS WHEREAS, the Parties entered into a Master Agreement ("Agreement") to provide for equitable and peaceful adjustment of differences which may arise, further a mutual and voluntary effort to promote and maintain sound labor relations, and to establish other conditions of employment for the calendar years 2022-2024; and WHEREAS, the Common Council of the City of South Bend, Indiana ("Common Council") passed Ordinance Number 7997-89 on July 24, 1989, fixing the maximum wages and monetary fringe benefits for Teamsters Union employees of the City for the calendar years 1990 through 1992. Further, each subsequent contract cycle, the Common Council has passed an ordinance fixing the maximum wages for Union employees, most recently on October 10, 2022 in Ordinance Number 10893-22 for calendar year 2023 (the "Salary Ordinance"). WHEREAS, the Parties mutually desire to amend the Salary Ordinance to correct a scrivener's error in the hourly rates for the Machinist IV and V positions in the Equipment Services Work Group, to separately list certain Group Leader positions within the Venues Parks & Arts Work Group at the same rate of pay as existing Group Leaders, and to add two new positions within the Water Works Division as part of restructuring within the Customer Service Work Group. NOW, THEREFORE, the Parties agree as follows: 1. The City will file an amended Salary Ordinance requesting that the Common Council amend the Salary Ordinance as follows: a. This Memorandum of Understanding shall be effective beginning with the first full pay period following the date of Common Council approval through December 31, 2024. Every other provision of the original Master Agreement and all Supplemental Agreements are hereby ratified, approved, and reaffirmed by the Parties and all other matters previously agreed to and set forth in the original Master Agreement and Supplementals not affected by this Memorandum of Understanding shall remain in full force and effect.
