AN ORDINANCE AMENDING CHAPTER 21 OF THE
SOUTH BEND MUNICIPAL CODE ENTITLED ZONING
STATEMENT OF PURPOSE AND INTENT:
In response to concerns expressed by the South Bend Housing
Authority, the Council finds it is necessary to reduce slightly the
legal boundaries of the controlled use exempt area.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS :
SECTION I. Section 21-18(c) shall be amended to read
as follows :
(c) In order to promote the use of the downtown and
eastbank area as a regional retail business and convention
center, any Class A cabaret or restaurant which sells beer or
intoxicating liquor for consumption on the premises is exempt,
for the purpose of this chapter, from the locational restrictions
in section 21-18(b) herein, in the area bounded by a line drawn
as follows :
Beginning at a point formed by the intersection of the north right-
of-way line of Madison Avenue and the west right-of-way line of
William Street; thence south along the west right-of-way line of
William Street to the - o-n-t n- t—o-f a-y 1 first alley south of
Western Avenue ; thence west along said 421-04--o-f--wa-y- alley to the
west right-of-way line of Taylor Street; thence south along said
right-of-way/ ex-t�-J to the north right-of-way line of South
Street; thence east along said right-of-way to the west right-of-way
line of William Street; thence south along said right-of-way,
extended , to the south right-of-way of the Conrail property ; thence
southeasterly along said right-of-way to the west right-of-way of
Lafayette Boulevard; thence north along said right-of-way to the
south right-of-way line of Monroe Street; thence east along said
right-of-way to the southwest right-of-way line of Lincolnway East;
thence southeasterly along said right-of-way to the southeast
right-of-way line of the portion of Monroe Street between Lincolnway
East and the St. Joseph River; thence northeasterly along said
right-of-way to its intersection with the centerline of the St.
Joseph River; thence northwesterly along said centerline to the
north right-of-way line of Jefferson Boulevard; thence east along
said right-of-way to the first alley east of Niles Avenue ; thence
north along said alley, extended, to the north right-of-way line,
extended, of Sorin Street; thence west along said right-of-way to
the east right-of-way line of Niles Avenue; thence north along said
right-of-way to the second alley north of Sorin Street; thence west
along said alley, extended, to the centerline of the St . Joseph
River; thence southwesterly along said centerline to the north
right-of-way line, extended, of Madison Avenue ; thence west along
said right-of-way to the west right-of-way line of William Street,
which is the point of beginning , all in the City of South Bend, St.
Joseph County, State of Indiana.
SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council ,

Dear Council Members:
Attached is an ordinance amending Chapter 21 of the South Bend
Municipal Code. The ordinance slightly reduces the boundaries of
the controlled use exemption area in the downtown.
This ordinance reduces the boundaries slightly from those
recently passed by the Council . This modification is in response to
concerns from the South Bend Housing Authority that we not include
an area along Western Avenue and at South Street. We agreed that
these were valid concerns and have revised the boundaries
accordingly.
I ask for your support of the ordinance and will be glad to
answer any questions you might have.

Re: A proposed ordinance initiated by Councilman Beverlie Beck amending
Chapter 21 of the South Bend Municipal code, entitled Zoning, reducing the
legal boundaries of the controlled use exempt area
Gentlemen:
The above referenced ordinance initiated by Councilman Beverlie Beck was
legally advertised August 8 and August 9, 1986. The Area Plan Commission gave
it a public hearing on August 19, 1986, at which time the following action was
taken:
Upon a motion by Joseph Serge, being seconded by Joseph
Zappia, and unanimously carried, the proposed ordinance
initiated by Councilman Beverlie Beck amending Chapter
21 of the South Bend Municipal Code, entitled Zoning,
reducing the legal boundaries of the controlled use
exempt area, is sent to the Common Council with a
favorable recommendation
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.
