Dear Ms. Walsh:
At its September 26, 2023 meeting, the Board of Public Works approved your request
for the installation of the Vinyl Wrapping of Five (5) Signal Boxes at various locations along
Mishawaka Ave. and Pleasant Ave. This encroachment was approved subject to the
improvements not becoming a safety hazard and subject to verbiage being oriented away
from the street. Enclosed please find copies of the permit and application.
The encroachment will be permitted to remain and continue until such time as the
Board of Public Works of the City of South Bend shall determine that such encroachment is in
any way impairing or interfering with the highway or with the free and safe flow of traffic
thereon. Said encroachment shall not in any way prejudice or preclude the City's rights with
respect to the future use of that portion of the right-of-way.

RECOGNITION OF ENCROACHMENT UPON CITY OF SOUTH BEND -CONTROLLED PROPERTY
AND PROVISIONS ALLOWING TEMPORARY CONTINUANCE OF SAME

The encroachment will be permitted to remain and continue under the following terms and conditions:
1) Until such time as the BOARD OF PUBLIC WORKS ("BOARD") of the CITY OF SOUTH BEND ("CITY") shall
determine that such encroachment is in any way impairing or interfering with the highway or with the free and
safe flow of traffic thereon;
2) Said encroachment shall not in anyway prejudice or preclude the CITY'S rights with respect to the future use of
the portion of the right-of-way;
3) The encroachment as it now exists shall in no manner be added to or enlarged in its present scope or dimensions;
4) In the event of change of ownership of the fixture or any other item of personal property which constitutes the
aforesaid encroachment, this permit shall become null and void;
5) The CITY shall not be liable to APPLICANTfor any damages caused to APPLICANT that arise out of or is incidental
to any activity and/or incidences authorized by this permit;
6) In consideration of the granting of this Permit by the BOARD, APPLICANT shall indemnify, hold harmless and
defend the CITY from and against any and all actions or causes of action which the CITY may suffer or incur by
reason of bodily injury, including death, to any person or persons, or by reason of damage to or destruction of any
property, including the loss thereof, arising out of or in any manner connected with any activity and/or incidences
authorized by this permit and/or any activities and/or incidences incidental thereto, or which the CITY may
sustain or incur in connection with any litigation, investigation, or other expenditures incidental thereto, including
any suit instituted by the CITY to enforce the obligation of this agreement of indemnity.
It is the intent of the parties hereto that the APPLICANT shall indemnify the CITY under this indemnification
clause to the fullest extent permitted by law.
This approval shall be binding upon everyone past or present, claiming any interest in and to the aforementioned
encroachment.

Agreement for Installation of the Vinyl Wrapping for 5 Signal Boxes
in River Park, South Bend Indiana
This Agreement, entered into this 09 / 26 /2023 by the River Park Neighborhood Association
(hereinafter called the Contractor) and the City of South Bend Public Works (hereinafter called the
Owner).
Witnesseth that the Contractor and the Owner, in consideration of the premises and of the mutual
covenants, considerations and agreements herein contained, agree as follows:
Statement of Work: The Contractor, has a signed agreement with US Signcrafters to purchase and
install 5 digitally printed graphic wraps for 5 electrical boxes to be installed onsite at each box. US
Signcrafters will clean and prepare the signal boxes properly before applying the vinyl wrap. Each box
should take 1-2 days to complete the application. The street and sidewalk do not need to be closed.
Maintenance: The vinyl US Signcrafters will use, can hold up appropriately for the application. Life of
a sign is defined as 5 to 7 years. Every sign is a `durable' product that will deteriorate over
time. Therefore, US Signcrafters offers the following warranty. US Signcrafters warrants the following
to the Contractor- All workmanship and materials are guaranteed for 1 year.
The wrap can be cleaned by the contractor with soap & water. Avoid ammonia -based cleaners.
If a wrap has to get removed due to damage, graffiti, etc - The wrap would need to be removed and
the cost to repair depends on the amount of the wrap that is damaged and the section of graphic that
needs to be reprinted. The Contractor will pay US Signcrafters to reprint and reinstall a damaged
wrap.
Once the wrap is removed for good, the wrap will not leave any damage to the paint. The
contractor will keep funds set aside if the box needs to be repainted.
*Funds are limited for replacing damaged wraps and if needed the damaged wraps will be
permanently removed by the Contractor.
Breach of Contract: If at any point in time the Owner feels the Contractor is not properly
maintaining the vinyl wrapped signal boxes, the Owner holds the right to notify the Contractor with
a Warning, The Warning will give the Contractor two weeks to correct the issues. If the
Contractor does not follow through with the request or come to a mutual agreement with the
Owner, the Owner reserves the right to remove the vinyl wrap in question and return the signal
box to its original status.
In witness whereof, the undersigned competent representatives do hereby enter into this
agreement for the vinyl wrapping of five signal boxes and maintenance of the said boxes, in River
Park, South Bend Indiana, as of the date listed above.

The Tepe delivery truck is from 1933. As of 2023, you can still find Tepe Furniture on Mishawaka Avenue.
The River Park Theater at Mishawaka Avenue and 30th.
opened on February 12, 1927 with Coleen Moore in
“Ella Cinders”. It was equipped with a Reproduco pipe
organ which was opened by organist Proff. Chas
Mathis. It closed in 1986.
(River Park Theater in South Bend, IN - Cinema Treasures
River Park Hardware was founded in 1927. It was purchased by Carl A Fisher Sr in 1945 and renamed Fisher Hardware, then renamed
again as Fisher Ace Hardware in 1968. The store was operated by Carl A Fisher Jr until it closed December 27, 2011 . The store was
originally located at 2220 Mishawaka Ave. Carl Sr.'s brother-in-law, Bill Foster, operated a 5 and Dime next door. In 1955, Carl briefly
partnered with Orville Davis and moved to a larger storefront at 2314 Mishawaka Ave. For a few years, the store operated as
Fisher-Davis Hardware at this location until Carl Sr. bought out his partner. At the same time, Bill Foster relocated two doors to the
west of the hardware store.

Company, Clement Studebaker, officially
press the button on March 28, 1903 to
start manufacturing of their watches.
On Thanksgiving Eve, Wednesday,
November 27, 1929, the nearly 300
employees of the company were notified
the plant would be closed until January 1,
1930. The company never reopened.
Rebuilt in 1965, it is now the Administra-
tion Building for the campus and home to
the IUSB Leighton School of Business and
Economics.

A Brief History of IU South Bend
As the oldest and largest regional campus of Indiana University, IU South Bend’s mission is fo-
cused on regional impact, partnership, and transformation. IU South Bend acknowledges and
honors the Indigenous communities native to this region, and recognizes that the campus was
built on the homelands and resources of the Potawatomi, Peoria, Myaamia, Kickapoo,
Kaskaskia, Mascouten and Meskwaki people: the past, present, and future caretakers of this
land.
IU South Bend’s history is a mix of tradition and innovation.

Indiana University offered its first extension class in South Bend during the spring semester of
1916. There were occasional classes from 1922 onward, but an organized extension program
began in 1933. Before World War II, most young men from South Bend and Mishawaka went
into factory jobs even before graduating from high school, while young women worked in offic-
es or retail stores, or settled early into raising a family. Higher education was largely for children
of families which could afford the cost of tuition, room and board at a residential college far
from home. The two well-known Catholic colleges located just outside the city limits enrolled
few students from the local community.
The IU extension program consisted almost entirely of evening courses at Central High School
in downtown South Bend, taught chiefly by local high school teachers who held advanced de-
grees. Enrollment reached about 500 before the outbreak of World War II, and all courses were
at the freshman and sophomore level, because it was assumed that students would somehow
find the time and money to complete their degrees at the home campus in Bloomington. Re-
turning veterans taking advantage of the G.I. Bill boosted credit enrollment to 1100 by 1950,
and there was also a popular program of non-credit classes and lectures.
By the mid-1950s, IU President Herman B Wells developed a new system of "regional campus-
es" for South Bend, Gary and Fort Wayne, all with new buildings to replaced crowded borrowed
and rented facilities. The South Bend-Mishawaka Center opened on its riverside site in 1961,
with some 1500 students and a small full-time faculty as well as a much larger number of ad-
junct lecturers, but still limited to a two-year transfer program. Not until 1965 did the Indiana
General Assembly authorize IU to offer degree programs at its regional campuses. The first de-
grees were awarded locally in 1967. Rapid growth in degree programs, faculty and facilities
quickly followed, and Indiana University at South Bend (renamed in 1968 and generally called
IUSB thereafter) enrolled more than 5,000 students by the early 1970s, when its expansion
slowed.
Lester M. Wolfson led the campus from 1964 until 1987, emphasizing programs in the liberal
arts, although there was a substantial enrollment in Business and Education, which offered
masters as well as undergraduate degrees. By purchase and new construction, as well as the
closure of several city streets, by the early 1990s IUSB achieved the image of a traditional
campus, with a central landscaped mall. Not until 2008 did the campus open its first long-
desired student housing, located across the St. Joseph River and reached by an elegant pe-
destrian bridge which became its most distinctive visual symbol. In 2016 Indiana University
South Bend has an enrollment exceeding 7,500 and awards nearly a thousand 'bachelors' and
'masters' degrees each year.

Many school children from the South Bend community in
the 1940s and 1950s remember visiting the Coca-Cola
bottling, warehouse, and distribution plant on
Mishawaka Avenue. It was replaced in 1996 by Wiekamp
Hall, home to the various departments of humanities and
social sciences and the School of Social Work.

The original conservatory, the Potawatomi Greenhouse, was built by Lord & Burnham in the 1920s and was originally built as
eight growing houses to raise plants for South Bend city parks and conservatories and floral shows in the region. The Ella
Morris Conservatory and Muessel -Ellison Botanical Conservatory were built in the 1960s. The Desert Dome was built in 1973 .
By 1910, the population of River Park had climbed to 1,560
people, with 436 enrolled in the River Park School. Because
of funding problems for the school, which also functioned
as a community center, and an inadequate water system,
the residents began to seek annexation. At first the South
Bend Common Council showed no interest. The River Park
town board then set up an election for September 10,
1910, on the question of whether to annex to South Bend
or Mishawaka. But, on August 22nd, the Mishawaka City
Council voted in favor to annex River Park. The Mishawaka
Council’s action taken before the River Park citizens vote
angered the town and the residents filed for a remon-
strance. The Mishawaka City Council withdrew their annex-
ation plan. In the November 1910 elections South Bend
and River Park voted to merge. In March 1911 the town
government of River Park stopped operating and it ceased
being a independent town. The gas lights and River Park
School were still being used until 1923. The school building
remained standing into the 1940s.

The River Park Neighborhood Association proposed beautifying the area and the neighbors
gave us positive feedback and offered to help with painting the Signal Electrical Boxes starting
with those on Mishawaka Avenue.
Due to requirements and recommendations from the City of South Bend and Public Works, the
project changed from hand painted boxes to vinyl wrapped signal boxes with historical photos of
River Park.
The RPNA has entered into a contract with US Signcrafters to produce and install the vinyl
wrappings. The RPNA will work on any touch ups that may be needed and we will keep a small
amount of the grant money for fixing the boxes or repainting them back to their original color if
needed.
Once the wrappings are installed or possibly during the process, the RPNA is also planning on
having a special - Community Fest - with food trucks, music, arts/craft show and activities for
the kids. The RPNA will also be asking the local businesses and churches to participate along
with the business association.

t'CE TANCE PROPOSAL
This protect will go to production once the contract is accepted and signed, a down payme received,
and the permit is acquired. To secure a permit we may require a provided site plan. Ensure I artork
colors are correct before signing proposal. Changes of any kind will require new proposal, a ork and
signature. Once deposit and proposal is secured by US Sincrafters any changes made are su. ect to
additional cost. progress billings shall be submitted based on completion of work. Each billing s all be
certified by US Signcraftens to be true and accurate, shall be based on the percentage of project
completion as of the date of billing, and shall include all project related expenses. Payments shall be
due upon receipt.
Private utilities on your property will NOT be marked by Indiana 811, MISS DIG 811 or other 811
DIG services because they are not owned by 811 members. These can include underground lines
like an electric line or water line, lines to septic tares, electric lines to out buildings or landscape
lighting, lawn sprinkler systems and more. If you think you might have a private utility on your
property, you should contact a private utility locator company to locate any additional privately -
owned utilities.

Any sign(s) that are illuminated and require new primary electric to be nun and or connected rest be
done by a qualified electrician. This Is not included in our proposal. We can provide hookup If electric i
within ten feet.
Any alteration or deviation from the above specifications involving extra costs, will be executed only
upon written orders, and will become an extra charge over and above the agreement. All agreements
are contingent upon strikes, accidents, or delays beyond our control. It is agreed that this contract shall
be construed according to the Mate of Indiana. The sign contractor will not be responsible for errors in
laps, designs, s cations, or drawings furnished by the customer.
When a duly authorized person of each park suns this contract, all provisions contained herein
become binding part of this contract, and there is no other agreement or understanding of any nature
unless specifically incorporated within the contract. The above prices, specifications, and conditions are
satisfactory and hereby accepted. The sign contractor is authorized and responsible to execute the
work as specified and shall retain title of the goods until payment of the full purchase price, subject to
allocation of payments and release security interest as rewired by law. Customer agrees to make the
payments as outlined above and agrees to safely keep the goods free other liens and encumbrances.
The full balance shall become due upon default, with customer paying all reasonable attorney fees and
cost of collection. Upon default, the sign contractor is entitled to retain all payments by the customer
together with any deficiency due from the customer and sign contractor shall have the right to retake
ossession of the odds contracted in this agreement.
Artwork developed for this proposal is a courtesy included at no charge. However, should this design be
requested for other outside uses other than the sign contractor, it would be available at an additional
cost of $125.00 which includes converting the artwork to other usable files.

The balance is due Net 30 days upon receipt of the final invoice. All late payments are subject to an
additional 0% charge and passible filing of a Herr. Should litigation be necessary for collection
customer agrees to pay legal fees. This document constitutes the full agreement. Any additional
