AN ORDINANCE AMENDING SECTIONS OF CHAPTER
21 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED
"ZONING," CONCERNING PARKING SPACE AREA REQUIREMENTS.
STATEMENT OF PURPOSE AND INTENT:
The Common Council finds it in the best interest of the
safety and welfare of the citizens of the City of South Bend ,
Indiana, to amend Chapter 21 of the South Bend Municipal Code,
Section 21-1(a) (45) and Section 21-99(a) to clarify requirements
for parking spaces .
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS :
SECTION I. Chapter 21, Article 1, Section 21-1(a) (45)
of the South Bend Municipal Code shall be amended to read as
follows :
SECTION 21-1 . Definitions .
(a) As used in this chapter, unless otherwise
provided :
( 45) Off-street parking space means a suitably
surfaced area provided for the off-street parking of vehicles.
Such spaces shall be a useable area containing a minimum of two

at least dimensions of approximately nine (9) by twenty (20)
feet, and shall be adequately surfaced , drained , screened and
landscaped . Aisle, access or maneuvering space shall not be
included in the minimum useable area.
SECTION II. Chapter 21, Article 5, Section 21-99(a) of
the South Bend Municipal Code shall be amended to read as
follows :
Section 21-99. Design standards ; off-street parking
facilities.
(a) Minimum area. Each off-street parking space shall
contain an area of not less than two-hundred-428E4 one hundred
and eighty (180) square feet as defined in Section 21-1 .
SECTION III. This Ordinance shall be in full force and
effect from and after its passage by the Common Council,
approval by the Mayor and legal publication.

Dear Council Members :
The attached Ordinance proposes amendments to two (2) sections
of the Zoning Ordinance, Chapter 21, of the South Bend Municipal
Code . These amendments are being introduced to correct an in-
consistency in the Code and to make the dimensions of required
off-street parking spaces more realistic with current parking
needs . .
The inconsistency in the Code occurs in Section 21-1(a) ( 45) ,
which defines off-street parking spaces . The Code states that
spaces will have a useable area containing a minimum of two
hundred (200) square feet, having at least dimensions of appro-
ximately nine (9) by twenty (20) feet. If a parking space had
dimensions of nine (9) by twenty (20) feet, the space would have
one hundred eighty (180) square feet, not two hundred (200)
square feet, as currently stated in the Ordinance. Therefore,
the amendment to Section 21-1(a) (45) proposes changing the use-
able area for a parking space to one hundred eighty (180) square
feet.
The second proposed amendment changes Section 21-99(a) to also
reflect the minimum area needed for a parking space to be one
hundred eighty (180) square feet. The decrease in size for
required off-street parking spaces will provide an adequate size
parking space to accomodate the standard size vehicle.

RE: A proposed ordinance initiated by Councilman Beverlie Beck amending
sections of Chapter 21 of the South Bend Municipal Code, entitled Zoning,
concerning parking space area requirements
Gentlemen:
The above referenced ordinance initiated Councilman Beverlie Beck was legally
advertised July 4, and July 5, 1986. The Area Plan Commission gave it a public
hearing on July 15, 1986, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by C. J.
Witz, and unanimously carried, the proposed ordinance
initiated by Councilman Beverlie Beck amending sections
of Chapter 21 of the South Bend Municipal Code,
entitled Zoning, concerning parking space area
requirements is sent to the Common Council with a
favorable recommendation
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

REQUESTED ACTION: This Ordinance clarifies both the square footage
and dimensions of a parking space, addressing an
inconsistency in the Code. A parking space is
presently defined as having minimum dimensions of
9 feet by 20 feet, and a minimum area of 200
square feet. A 9 by 20 foot area has 180 square
feet , and not 200 square feet. This Ordinance
would require a minimum parking space dimension of
9 feet by 20 feet containing a minimum area of 180
square feet.
