III. PUBLIC HEARING
a. CERTIFICATE OF APPROPRIATENESS
i. 2023-0601 B-3 715 Riverside Drive River Bend LHD,
Ordinance #8308-92 (Audio Position: 00:38)

The staff report was presented by: Adam Toering
Staff Recommendation: Staff recommended dividing the project into multiple
components at the June 20, 2023 meeting. Only B-3 remains unresolved:
COA 2023-0601 B-3 — Window Replacement (General). Staff makes no
recommendation.
The applicant was represented by: Timothy and Donna Barkley, 715
Riverside Dr, South Bend, IN, appeared in person and served as the
applicant.
The public was represented by: there was no one from the public to speak.
After due consideration the following action was taken:
Upon a motion by Elizabeth Hertel, seconded by Don Dietz, and
UNANIMOUSLY carried by vote, the Historic Preservation Commission
AMENDS the application to include the removal of the chimney and the
use of aluminum siding to cover the porch exterior and then APPROVES
the amended Certificate of Appropriateness Application #2023-0601 B-3
Vote: 6-0. Six in favor, none opposed.
COA#2023-0601 B-3 is APPROVED.

The staff report was presented by: Adam Toering
Staff Recommendation: The Standards and Guidelines state that "rear and
side yard fences should start no further forward on the site than the front
wall of the house, no taller than six feet, and may be solid in
construction," as well as "new rear and side yard fences should be
constructed of wood" (page 11). The Standards and Guidelines also stat
that "The following is not recommended and generally not approved by
the Commission: [ .. ] chain link, barbed wire, or vinyl fencing; horizontal
board fencing" [emphasis added]. Staff makes an unfavorable
recommendation.
The applicant was represented by: William Howell -Bey, 1346 Lincoln Way
East, South Bend, IN, appeared virtually and served as the applicant.
The public was represented by: there was no one from the public to speak.
After due consideration the following action was taken:
Upon a motion by David Wyncott, seconded by Elizabeth Hertel, and
carried by vote, the Historic Preservation Commission APPROVES
Certificate of Appropriateness Application #2023-0622.
Vote: 6-1. Six in favor, one opposed
COA#2023-0622 is APPROVED.
iii, 2023-0703 108 North Main St South Bend Local Landmark,
Ordinance #8915-1998 (Audio Position: 28:24)
The staff report was presented by: Adam Toering
Staff Recommendation: Staff recommends approval.
The applicant was represented by: John Brown, with Cressy Commercial
Real Estate, 4100 Edison Lakes Parkway, Ste 350, Mishawaka, IN
appeared in person and served as the applicant.
The public was represented by: there was no one from the public to speak.
After due consideration the following action was taken:
Upon a motion by Elizabeth Hertel, seconded by David Wyncott, and
UNANIMOUSLY carried by vote, the Historic Preservation Commission
AMENDS the application to include blackout glass in the upper sections
of the three sets of windows and APPROVES the amended Certificate of
Appropriateness Application #2023-0703.
Vote: 7-0. Seven in favor, none opposed.
COA#2023-0703 is APPROVED.
b. LOCAL LANDMARK NOMINATION

Upon a motion by Andrew Jones, seconded by Elizabeth Hertel, and
UNANIMOUSLY carried by vote, the minutes from the May 1, 2023 Historic
Preservation Commission Special meeting are approved.
ii. June 20, 2023 — Regular Meeting Minutes (Audio Position: 42:29)
Upon a motion by David Wyncott, seconded by Elizabeth Hertel, with Andrew
Jones abstaining, and carried by vote, the minutes from the June 20, 2023
Historic Preservation Commission meeting are approved.
b. STAFF REPORTS
i. Administrative Approvals
After due consideration, no action was taken.

No committees met since the previous meeting.
