AN ORDINANCE FIXING THE ANNUAL PAY AND MONETARY
FRINGE BENEFITS OF MEMBERS OF THE SOUTH BEND
POLICE DEPARTMENT FOR THE CALENDAR YEARS 1987,
1988 AND 1989
STATEMENT OF PURPOSE AND INTENT
The South Bend Common Council has responsibility for fixing by
ordinance the annual compensation of all members of the Police Department,
pursuant to Indiana Code 36-8-3-3(d).
A four-person City Negotiating Team was authorized by the South Bend
Common Council, Board of Public Safety, and the City Administration to
negotiate on behalf of the City all pay and monetary fringe benefits.
The City Negotiating Team and the F.O.P. Bargaining Committee of the
Fraternal Order of Police, Lodge No. 36, held several negotiating sessions
concerning annual pay and monetary fringe benefits for sworn members of the
South Bend Police Department for calendar years 1987, 1988 and 1989.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, as follows:
SECTION I. (a) The South Bend Common Council recognizes the F.O.P.
Bargaining Committee of the Fraternal Order of Police, Lodge No. 36, as the
sole bargaining unit for the annual pay and monetary fringe benefits for
sworn members of the South Bend Police Department excluding the Police
Chief, Division Chiefs, and Captains.
(b) The Police Chief, Division Chiefs and Captains of the South Bend
Police Department are designated in this ordinance as "Officers".
SECTION II. (a) Annual pay for the Officers and other sworn members
of the South Bend Police Department, by rank, for calendar years 1987, 1988
and 1989 shall be as follows:

While recruits are not sworn members, the Common Council establishes
the following annual pay.

(b) In the event that a Local Option Income Tax becomes effective and
tax income from the Local Option Income Tax is received by the City of South

Bend in its' General Fund in 1988 or 1989, the annual maximum salaries for
1989 for the ranks listed in Subsection (a) herein shall be increased by two
percent (2%) over the amounts listed for 1989.
(c) In addition to the above, salaries shall be further adjusted in
accordances with paragraphs (1) or (2) below, whichever is applicable.
(1) In the event that the offer made by the City Negotiating
Team is accepted by the Fraternal Order of Police; Lodge No.
36, such acceptances being by written notification signed by
the officers of the Fraternal Order of Police, Lodge No. 36,
delivered to the office of the City Clerk on or before
August 7, 1986, an acceptance bonus shall be as follows:
I. $700.00 acceptance bonus shall be paid to all
officers and sworn members of the South Bend
Police Department as identified in III below,
with $450.00 to be paid to entitled
members after the first full pay period
after January 1, 1987, representing the first
payment of said acceptance bonus; and $250.00
to be paid entitled members after the first
full pay period after January 1, 1988,
representing the final payment of said acceptance
bonus. None of the amounts of the acceptance
bonus shall be attributed to the annual salary
base for pension purposes.
II. An additional $200.00 one time payment shall be
paid to all ranks listed in Sub-section (a) on
the first full pay period after January 1, 1988
which shall be attributed to the annual salary
base for pension purposes.
III. The acceptance bonus and one time payment
would be paid only to all officers
and sworn members of the South Bend Police Dept.
who are employed by the Department at the time of
the effective date of this ordinance.
(2) In the event that the offer made by the City Negotiating Team
is not accepted by the Fraternal Order of Police, Lodge No. 36,
there shall be no acceptance bonus for either 1987 or 1988;
however additional compensation shall be paid to all ranks
listed in Sub-section (a) which shall be attributed to the
annual salary base for pension purposes and shall be as follows:
I. $300.00 in 1987
II. $300.00 in 1988
SECTION III. ADDITIONAL PAY
(a) If a sworn member is subpoenaed to court or has to go to court or
is required to appear at any given location to validate a complaint, warrant
or recall, and if that sworn member is off-duty, the sworn member shall be
paid at the rate of time and one-half (1/2) their regularly scheduled pay
during a work day, in an amount not less than four (4) hours if they are on
their regularly scheduled day off at the time of the required appearance.
(b) Any sworn member required to work overtime shall be paid at the
rate of one and one-half (1-1/2) time their normal rate of pay in an amount
not less than one (1) hour for any overtime beyond their normal work day

schedule.
(c) Officers and sworn members shall be entitled to receive Sixty-Two
Dollars ($62.00) for the nine and one-half (9-1/2) holidays established by
the Board of Public Safety; whether such holiday is worked or not. Pay for
such holidays shall be received during the pay period in which the holiday
occurs; however, no holiday shall be paid in advance of its occurrence.
(d) Night incentive and hazard pay shall be paid at the rate of Three
Hundred Dollars ($300.00) each per year.
(e) Each officer and sworn member shall be entitled to the following
annual allowances:

SECTION IV. VACATIONS
(a) Current officers and sworn officers shall be entitled to vacations
pursuant to the following schedule for 1987, 1988 and 1989:
0 - 1 year of service - 1 day per month
1 - 5 years of service - 13 days annually
6 - 10 years of service - 16 days annually
11 - 15 years of service - 21 days annually
16 - 20 years of service - 23 days annually
21 years of service and over - 28 days annually
(b) New sworn members hired and sworn after December 31, 1986, shall be
entitled to vacations pursuant to the following schedule for 1987, 1988 and
1989:
0 - 1 year of service - 1 day per month after six (6) months
1 - 3 years of service - 8 days annually
4 - 5 years of service - 10 days annually
6 - 10 years of service - 12 days annually
11 - 15 years of service - 15 days annually
16 - 19 years of service - 18 days annually
20 years of service and over - 21 days annually
(c) The above terms shall be subject to approval by the Board of Public
Safety through the Board's adoption of a proper resolution.
SECTION V. OTHER MONETARY FRINGE BENEFITS
(a) Clothing Allowance: Officers and other sworn members shall
receive an annual clothing allowance of Seven Hundred and fifty-four
($754.00) Dollars, one-half (1/2) of which shall be paid on or before June
15th one-half (1/2) of which shall be paid on or before December 15th.
(b) Dependent Health Insurance: The annual contribution by the each
officer and other sworn members for dependent health insurance costs related
to the City of South Bend's self funded health insurance program shall
remain at the 1986 level during the period covered by this Ordinance.
(c) Overtime Foot Patrol: Each sworn member working under the
Overtime Foot Patrol Program shall be paid at the rate of Seven Dollars and
Fifty Cents ($7.50) per hour.

SECTION VI. SERVICE YEAR FOR PAY AND BENEFITS ADDRESSED IN
ORDINANCE
(a) The first service year for a member of the Police Department
commences upon the individual being sworn in before the Board of Safety as a
member of the department. The second service year shall begin on the next
succeeding first day of January and service years shall continue to increase
until the member attains the maximum salary for the particular rank they may
hold.
(b) Advancement from the rank of Patrolman First Class to Corporal is
dependent upon three (3) complete calendar years of service plus a
determination of satisfactory performance of duty and promotion by the Board
of Public Safety.
SECTION VII. HEALTH CARE INSURANCE COST REDUCTION PROGRAM
The Board of Health Care Insurance Oversight, shall continue to
operate in an advisory capacity to and under the direction of the City
Controller. This Board shall be composed of representatives of the
Fraternal Order of Police, Lodge No. 36, and employees of the Department of
Administration and Finance of the City of South Bend, together with other
employees of the City of South Bend. It shall be the responsibility of the
Board to review, under the direction of the City Controller, on a regular
basis the activities of the City's Health Care Insurance Program.
In addition, in an effort to control health care costs, the City's
current health insurance package shall be modified to provide a program
containing comprehensive major medical health insurance which would provide
for first dollar after a one hundred dollar ($100.00) deductible per year is
met by the sworn member or officer, deductibles of ten percent (10%) of the
cost of such major medical expenses, with maximun claims annual cost to the
sworn member or officer for such coverage being five hundred dollars
($500.00)
SECTION VIII. PAID SICK LEAVE
(a) Sick Leave Cost Reduction Program.
(1) The following Sick Leave Cost Reduction Program shall continue on
an experimental basis for calendar years 1987 and 1988 and shall apply to
all officers and sworn members of the department. This program shall be
considered an experiment in encouraging the conservation of sick time and
the costs thereof.
(2) Through and including December 1, 1989, officers and sworn members
shall be compensated for the relinquishment of earned sick time as follows:
One (1) days pay for each earned sick
day relinquished, with a maximun of
eight (8) days per year.
(3) The rate of pay for compensation for conservation of sick time in
the schedule listed above shall be the then-current rate of pay for the rank
of Corporal. Payment shall be made to officers and sworn members for sick
time conservation on or before December 15th of each year.
(4) The Sick Leave Cost Reduction Program shall not affect the current
sick leave policy authorized by the Board of Public Safety.
(b) Paid Sick Leave Accrual

(1) Current officers and sworn members shall be entitled to accrue a
maximum of eight (8) paid sick days per calendar year.
(2) Current officers and sworn members shall be entitled to accrue a
maximum of ninety (90) sick days in a sick leave bank.
(3) New officers and sworn members hired after December 31, 1986, shall
be entitled to eight (8) paid sick days per calendar year.
(4) New officers and sworn members hired after December 31, 1986, shall
be entitled to accrue a maximum of ninety (90) sick days in a sick leave
bank.
(c) The above terms shall be subject to approval by the Board of Public
Safety through the Board's adoption of a proper Resolution.
SECTION IX. GREEN ALERT/FLSA ISSUES
If the Fraternal Order of Police, Lodge No. 36, accepts the City
Negotiating Team's offer it shall file a letter with the Office of.the City
Clerk on or before December 31, 1986, which is signed by its' officers
verifying that the F.O.P will not originate or support any F.L.S.A. action
relating to Green Alert for the duration of this ordinance.
SECTION X. VOLUNTARY RECALL
If the Fraternal Order of Police, Lodge No. 36, accepts the City
Negotiating Team's offer it shall file a letter with the Office of the City
Clerk on or before December 31, 1986, which is signed by its officers
verifying that the F.O.P. will not originate or support any concerted
refusal to accept voluntary recall for the duration of this ordinance on or
before December 31, 1988 whichever is sooner.
SECTION XI. This ordinance shall be in full force and effect from
and after its passage by the Council and approval by the Mayor.

RE: Police Salary Ordinance
Dear Councilmembers:
The City Negotiating Team recommends the attached ordinance for
your review and consideration.
You will recall that the City Negotiating Team was authorized to
represent the Common Council, the Board of Public Safety, and the City
Administration in all wage negotiations for the City.
Our first meeting with the F.O.P. Bargaining Committee for the
Fraternal Order of Police, Lodge No. 36, was held on May 1, 1986.
Numerous negotiating sessions since that time have taken place.
Negotiations between the respective bargaining teams culminated in
a tentative agreement being reached between the bargaining committees.
Unfortunately, the tentative agreement was subsequently turned down by
the rank and file of the Police Department.
The City Negotiating Team has been clear in its objectives and has
had the unanimous and continuing support of the South Bend Common
Council and the City Administration.
The overall goals which the City Negotiating Team have attempted
to achieve include increased productivity of City personnel resulting
in better service to the public and decreasing paid time off, as well
as negotiating a fair wage and benefit package which can be afforded by
the City.
In accordance with the directives received by your negotiating
team, the City Negotiating Team has stated on numerous occasions that
the best possible wage and benefit package would be the one negotiated
across the table.
The City Negotiating Team recommends the attached ordinance to the
Common Council. It would freeze wages at 1986 levels for 1987 and 1988
and would alter current vacation, holiday, and sick leave policies. It
should be noted however, that your team is ready and willing to
continue to meet with the F.O.P. Bargaining Committee and that it will
supplement its present recommendation in writing to the Common Council
prior to the time that the ordinance is scheduled for public hearing.
Although the City Negotiating Team is ready, willing, and able to
sit down and continue to meet in negotiation sessions with the F.O.P.
Bargaining Committee, it has informed the F.O.P. Bargaining Committee
that it will not do so, if any type of illegal job action is then
underway.
