GAMMON Approved and signed by me ' 3 d Ig(f" G� Mayor • • • SUBSTITUTE BILL NO. 73-86 ORDINANCE NO. 7 (C,_s-- - AN ORDINANCE FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS FOR THE CALENDAR YEARS OF 1987 AND 1988 STATEMENT OF PURPOSE AND INTENT The South Bend Common Council has responsibility for fixing by ordinance the annual compensation of all members of the Fire Department, pursuant to Indiana Code 36-8-3-3(d). The four-member City Negotiating Team representing the Common Council, Board of Public Safety and the City Administration, met on numerous occasions with the Wage Committee of the South Bend Fire Fighters Association, Local No. 362. As a result of those negotiations, a tenative agreement was reached by the negotiating teams, and that agreement was subsequently ratified by the membership of the South Bend Fire Fighters Association, Local W . 362. Therefore, the Common Council, wishes to formally adopt the terms of the tentative agreement and believes that they represent the best possible wage and benefit package for the Firefighters which the City can afford for calendar years 1987 and 1988. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. (a) The South Bend Common Council recognizes the Wage Committee of the South Bend Firefighters Association, Local No. 362, as the sole bargaining unit for the annual pay and monetary fringe benefits for sworn members of the South Bend Fire Department excluding the Fire Chief, Assistant Chiefs, and Battalion Chiefs. (b) The Fire Chief, Assistant Chiefs and Battalion Chiefs of the South Bend Fire Department are designated in this ordinance as "Officers." SECTION II. (a) Annual pay for the Officers and other sworn members of the South Bend Fire Department, by rank, for calendar years 1987 and 1988 shall be as follows: RANK 1987 1988 Fire Chief $36,500 $36,800 Assistant Chiefs $33,000 $33,300 Battalion Chiefs $29,000 $29,300 Captains $21,919 $22,219 Specialists $22,269 $22,569 Engineers 10 + years of service $21,219 $21,519 Engineers 9-10 years of service $20,969 $21,269 Engineers 8-9 years of service $20,719 $21,019 Engineers 7-8 years of service $20,469 $20,769 1 Engineers 6-7 years of service $20,219 $20,519 Engineers 5-6 years of service $19,469 $19,769 Engineers 3-5 years of service $19,719 $20,019 Firefighter 1st Class $18,169 $18,469 Firefighters $16,169 $16,469 The following sets forth the service requirements of the following ranks: 0 to 1 year In training 1 to 2 years Firefighter 2 to 3 years Firefighter 1st Class (b) A signing bonus of one thousand and five hundred and fifty dollars ($1,550.00) shall be paid to all officers and sworn members of the South Bend Fire Department who are employed by the Department at the time of the effective date of this ordinance and in accordance with the following provisions: (1) that all officers and sworn members who were officers and sworn members employed by the Fire Department at the time of the effective date of this ordinance shall be entitled to receive said bonus; (2) that One Thousand Dollars ($1,000.00) in bonus shall be paid to such entitled members after the first full pay period after January 1, 1987, representing the first payment of said signing bonus; (3) that Five Hundred and Fifty Dollars ($550.00) in bonus shall be paid to such entitled members after the first full pay period after January 1, 1988, representing the final payment of said signing bonus; (4) that none of the amounts of the signing bonus shall be attributed to the annual salary base for pension purposes. SECTION III. Additional pay for Extra Duty and Special Performance. (a) For recall or overtime pay, time and one-half regularly scheduled pay for a work day. (b) For regularly assigned drivers of fire trucks and other heavy equipment, and the tillerman, the personnel assigned to drive ambulances on regular or rotation basis, the following annual amounts: 1987 1988 $275.00 $300.00 (c) For persons certified by the State of Indiana as a certified Emergency Medical Technician, the following annual amounts: 1987 1988 $300.00 $350.00 (d) For regularly assigned scuba divers, the following annual amounts: 1987 1988 $350.00 $450.00 (e) Sworn members performing paramedic duties will be paid the 2 following annual amounts over the base salary for their rank: 1987 1988 $925.00 $1,050.00 (f) Regularly assigned members of the Hazardous Materials Handling • Team, the following annual amounts: 1987 1988 $400.00 $600.00 (g) All officers and sworn members shall receive Five Hundred and Forty-Four Dollars ($544.00) holiday pay, gross for the year. Such holiday pay shall be paid in two (2) equal installments of Two Hundred Seventy-Two Dollars ($272.00) gross each, payable by the 15th day of June and the 15th day of December. The holiday pay shall be paid to each officer or sworn member regardless of whether the holiday is worked. SECTION V. OTHER MONETARY FRINGE BENEFITS (a) Clothin& allowance: Officers and other sworn members shall receive an annual clothing allowance of Seven Hundred Ninety-Nine Dollars ($799.00), one-half (1/2) of which shall be paid on or before June 15th and one-half (1/2) of which shall be paid on or before December 15th. (b) Dependent Health Insurance: The annual contribution by the officers or sworn members for dependent health insurance costs related to the City of South Bend's self-funded health insurance program shall remain at the 1986 level during the period covered by this Ordinance. SECTION VI. HEALTH CARE INSURANCE COST REDUCTION PROGRAM The Board of Health Care Insurance Oversight, shall continue to operate in an advisory capacity to and under the direction of the City Controller. This Board shall be composed of representatives of the South Bend Fire Fighters Association, Local No. 362 and employees of the Department of Administration and Finance of the City of South Bend, together with other employees of the City of South Bend. It shall be the responsibility of the Board to review, under the direction of the City Controller, on a regular basis the activities of the City's Health Care Insurance program. . In addition, in an effort to control health care costs, the City's current health insurance package shall be modified to provide a program containing comprehensive major medical health insurance which would provide for first dollar after a one hundred dollar ($100.00) deductible per year is met by the officers or sworn members deductibles of ten percent (10%) of the cost of such major medical expenses, with maximum claims annual cost to the employee for such coverage being Five Hundred Dollars ($500.00). SECTION VII. VACATION: (a) The present officers or sworn members who work a 24-hour shift shall remain on the present vacation schedule which is as follows: Years of Service Days of Vacation 6 months through 1 year 3 working days 1 year through 7 years 6 working days 8 years through 15 years 8 working days 3 16 years through 19 years 10 working days 20 years and over 11 working days (b) New sworn members hired after December 31, 1986, and working 24-hour shifts shall have the following vacation schedule: Years of Service Days of Vacation 0 - 1 year 1 working day 1 - 7 years 4 working days 8 - 15 years 6 working days 16 - 19 years 8 working days 20 years + 10 working days (c) The present officers or sworn members working non-24-hour shifts shall remain on the present vacation schedule which is as follows: Years of Service Days of Vacation 6 months through 1 year 5 working days 2 years through 7 years 10 working days 8 years through 15 years 15 working days 16 years through 19 years 20 working days 20 years and over 25 working days (d) New sworn members hired after December 31, 1986 and working non-24-hour shifts shall have the following vacation schedule: Years of Service Days of Vacation 0 - 1 year 1 working day per month after 8 months 1 - 3 years 6 working days 4 - 5 years 10 working days 6 - 10 years 12 working days 11 - 15 years 15 working days 16 - 19 days 18 working days 20 years + 21 working days (e) Sworn members hired between the effective date of this ordinance up to and including December 31, 1986, shall be entitled to the schedule of present sworn members for their respective 24-hour or non-24-hour shifts. (f) The above terms shall be subject to approval by the Board of Public Safety through the Board's approval of a proper Resolution. SECTION VIII. PAID SICK LEAVE (a) Present officers or sworn members working non-24 hour shifts shall have eight (8) sick days per calendar year with a maximum accrual of one hundred (100) sick days in a sick leave bank. (b) New sworn members hired after December 31, 1986, and working non-24 hour shifts shall have eight (8) paid sick days each calendar year with a maximum accrual of forty-five (45) paid sick days in a sick leave bank. (c) Present officers or sworn members working 24-hour shifts shall be entitled to Five (5) paid sick days per calendar year with a maximum allowable accrual of thirty-eight (38) paid sick days. 4 (d) New sworn members hired after December 31, 1986, and working 24-hour shifts shall have three (3) sick days each calendar year and shall be able to accumulate a maximum of twenty-one (21) paid sick days in a sick leave bank. (e) If a sick leave buy-back program is appproved by the F.O.P. , the program shall be made available to the sworn members of the Fire Department with the specifics as to 24-hour personnel being mutually worked out between the parties. (f) The above terms shall be subject to approval by the Board of Public Safety through the Board's adoption of a proper Resolution. SECTION IX. FLSA MATTERS AND FITNESS AND WELLNESS PROGRAM An understanding has been reached between the City and the South Bend Fire Fighters Association Local No. 362 regarding FLSA Matters and a Fitness and Wellness Program, specific details of which shall be set forth in a separate agreement which will remain in effect until at least December 31, 1988. SECTION X. SERVICE YEAR FOR PAY AND BENEFITS ADDRESSED IN ORDINANCE The first service year for a member of the Fire Department commences upon upon his being sworn in before the Board of Safety as a member of that department. His second service year shall begin on the next succeeding first day of January and service years shall continue to increase until the member attains the maximum salary for the particular rank he may hold. SECTION XI. This ordinance shall be in full force and effect from and after its passage by the Council and approval by the Mayor. S. Over the past several weeks the respective negotiating teams for the City of South Bend and the South Bend Fire Fighters Association, Local No. 362, have been meeting to negotiate benefits and wages. The negotiating teams reached a tentative agreement which was ratified by the membership of the South Bend Fire Fighters Association, Local No. 362, on July 10th and 11th. The City Negotiating Team believes that the attached ordinance incorporates a fair wage and benefit package for the Fire Department for the calendar years 1987 and 1988, that said costs are appropriate in view of the overall requirements and that the City can afford said package. The City Negotiating Team further believes that the overall goals of achieving increased productivity resulting in better service to the public and decreasing paid time off will also be achieved through the terms of this agreement. We believe that the negotiating process has worked and that the negotiations with the Wage Committee of the South Bend Fire Fighters Association, Local No. 362 were conducted in a professional and positive atmosphere.
