GAMMON Approved and signed by me - /6, .9 ,f6 / / -vt.-}mayor • SUBSTITUTE BILL ORDINANCE NO. `--] (o(o Q_ g() AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE PARKING RATES FOR ALL CITY-OPERATED FLAT LOTS, THE COLFAX STREET PARKING GARAGE, AND THE JEFFERSON STREET PARKING GARAGE. STATEMENT OF PURPOSE AND INTENT: I.C. 36-9-11-7 authorizes the Board of Public Works to fix rates for municipal off-street parking facilities, subject to approval of the Common Council. The Council has received Resolution No. 12-1986 of the Board of Public Works, a copy of which is attached hereto and made a part hereof, which revises existing rates for municipal off-street parking facilities and establishes a new special event rate for the Colfax and Jefferson Street Parking Garages to be used when the garages are authorized by the Board of Public Works to provide parking for special events. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND THAT THE FOLLOWING PARKING RATES, AS RECOMMENDED BY THE BOARD OF PUBLIC WORKS, BE APPROVED: SECTION I. Rates for City-operated flat lots for individual vehicles shall be set as follows : (a) Lot at Western and St. Joseph: $19. 00 per month. (b) Lot at the Municipal Services Facility, 700 block West Sample: $16. 00 per month. SECTION II. Rates at the Colfax Street Parking Garage for individual vehicles shall be set as follows : (a) Per month: $33. 00 (b) Per hour . 75 Two hours 1.20 Three hours 1.35 Four hours 1. 60 Five-eight hours 2. 10 Nine-twelve hours 2.35 After twelve and up to twenty- four hours 2.85 (c) Special event rate 1. 00 SECTION III. Rates at the Jefferson Street Parking Garage for individual vehicles shall be set as follows : (a) Per month: $35. 00 (b) Per hour .85 Two hours 1.35 Three hours 1.60 Four hours 1.85 Five-eight hours 2. 10 Nine-twelve hours 2. 60 After twelve and up to twenty- four hours 3.35 (c) Special event rate 1. 00 (a) Number of Vehicles Monthly Rate Per Vehicle 5-19 $30.00 20-49 27. 00 50-99 23.00 100-over 19.00 (b) Group rates are contingent upon payment in advance by one check for the entire group each month. (c) Group rates addressed in this section shall become effective November 1, 1986. SECTION V. This ordinance recinds and supercedes all prior ordinances and resolutions setting rates for municipal off-street parking facilities. SECTION VI . South Bend, Indiana 46601 Dear President Beck: The enclosed ordinances are being filed for first reading of the May 27, 1986 Council Meeting. The first ordinance amends the rates and charges currently established for the Parking Garages and flat lots the City of South Bend operates. Specifically, that ordinance increases the monthly parking fees by $3 . 00 per month per vehicle, raises the garage hourly rates by $ . 10 per hour in each category, and establishes a new parking rate category known as a special event rate of $1. 00 per event per vehicle. The second ordinance amends Section 20-18 of the South Bend Municipal Code establishing fines for overtime and illegal parking. Currently the parking ticket fine is $2 . 00 per violation if paid within a five day period and $5. 00 per violation if settlement of the offense occurs after the five days has expired. The amendment would raise the fee to $5 . 00 per violation if paid within a five day period and $10. 00 after expiration of the five day period. These changes are necessary to enhance the financial operation of the parking garages and secure our ability to meet lease payments and other operating expenses on the garages. The most recent audit report prepared by Crowe Chizek & Company for the year 1985 showed an operating aeficit of $98 ,102 . 00 . The adjustments being proposed to the rates and parking fines are estimated to generate an additional $130, 000.00 annually. This is a conservative estimate and therefore should last for several years. M22 Council President Beverlie Beck May 22, 1986 Page -2- The establishment of a special event fee should allow the garages to address parking overflow problems at Century Center, Morris Civic Theatre and other special events that may happen downtown. The intent of the fee is for use on weekends and after 6 : 00 p.m. when the garages are doing very little business. In reviewing the ordinances, it appears that the last general rate increase on the parking fees was put in effect during February 23 , 1981. The parking violation fines have not been updated since 1972 . Tuesday, May 27, 1986, the Board of Public Works will take action in this matter.
