ORDINANCE NO 1G 60 .((
AN ORDINANCE TO VACATE THE FOLLOWING
DESCRIBED PROPERTY
The 1st East-West•.alley North of Lincoln Way West
running West from Sheridari'to Knoblock for a distance, of
299 feet+ all being in Post Place Addition to the
City of-South Bend St. Joseph County Indiana.

STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common Council is
charged with the authority to hear all petitions to vacate public ways or public
places within the City.
The following Ordinance vacates the above described public property.
NOW, TI HERR O ; ':BE IT ORDAINED BY THE COMMON':COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I.' The Common`Council of the City of South' Bend having
held a publid hearing on `the petition t'o'vacate the following property:
The 1st.--East-West alley:.North of Lincoln Way-Way= West
running West``;from Sheridan to 'Knoblock, for a distance of
299=-feet+`all being.-in Post Place Addition to the
City of South Bend St. Joseph County Indiana.
hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the rights and
easements of all utilities and the Municipal City of South Bend,
Indiana to construct and maintain any facilities, including, but not
limited to, the following: electric, telephone, gas, water, sewer;
surface water control structures and ditches,' within the vacated
right-of-way, unless such rights, are released by the individual utilities.
SECTION III. The following propertessmay be beneficially affected
by such vacating:
Lot 8 and Lot 9 bound by Sheridan and Knoblock N&ith of. Lincoln Way West,
being in Post Place Addition to the City of South. Bend
St. Joseph County,
SECTION IV. The purpose of the vacation of the real property
is to
a) Remove traffic flow on said alley by persons using said alley
as a throughway from Maplewood to. Sheridan.
b) Remove eyesore that said alley has developed into.
c) Remove danger to children of property owners on said alley.
d) Decrease'the amount of debris and trash being deposited on
bordering properties, in particular Lot 9, by persons using said alley
as a throughway.
SECTION V. This ordinance shall be in full force and effect from
and after, its passage,by the Common Council and approval' by the Mayor.

Dear Mr. and Mrs. Osborn:
I am sorry to be somewhat tardy inresponse to your letter
of May 1 concerning the east-west alley located to the
south of our property, Lot 9-Post Place.
It is too bad that this alley has become the nuisance
you describe and I have no reason to doubt the accuracy
of your opinion. Neither my wiferor I wish to promote
in any way the use of this alley for those wishing to
use the lots for dumping purposes. It is important of
course that there be sufficient ingress and egress to
allow for removal of debris or weeds when that becomes
necessary for the good appearance of the property.
You may inform the Becsies , and be informed yourselves
that my wife Barbara and I are fully in accordance with your
petition to vacate the alley and wi§-i you success in
the endeavor:-.
We would appreciate hearing of the Council ' s final action
in this regard, as it is our wish to be good neighbors,even
at some distance.
