AN ORDINANCE AMENDING SECTION 20-18 OF THE
SOUTH BEND MUNICIPAL CODE ESTABLISHING
FINES FOR OVERTIME PARKING
STATEMENT OF PURPOSE AND INTENT:
The fine assessed by the City of South Bend for overtime
parking was established in 1972 and has not been increased since that
time. The Common Council believes it is in the best interest of the
City to increase that fine in order to offset the ever increasing
cost of providing traffic safety services.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
SECTION I . Section 20-18 of the Municipal Code of the
City of South Bend shall be amended as follows:
Sec. 20-18. Answering notice on
overtime parking; payment of fine.
The owner or operator who has been
notified of a violation of the parking
regulations, as herein provided, may,
within five ( 5) days after being
notified, answer at the office of the
Traffic Violations Bureau, to the
charge of such violation as set forth
in such notice, and pay a prescribed
fee of Twe-Beiiars-+$2788+ Three Dollars
( $3 . 00) in settlement of the offense or
charge, or Five-Beliars-+$509+ Ten
Dollars ( $10. 00) after the expiration
of five ( 5) days. An acceptance of the
payment of the fee and the authority by
the Clerk shall be deemed complete
satisfaction for the violation and the
violator shall be given a receipt which
so states.
SECTION II . This Ordinance shall be in full force and
effect from and after its passage by the Common Counci, approval
by the Mayor and legal publication, August 1, 1986.

Dear President Beck:
The enclosed ordinances are being filed for first reading of the May
27, 1986 Council Meeting. The first ordinance amends the rates and
charges currently established for the Parking Garages and flat lots
the City of South Bend operates. Specifically, that ordinance
increases the monthly parking fees by $3 . 00 per month per vehicle,
raises the garage hourly rates by $ . 10 per hour in each category,
and establishes a new parking rate category known as a special event
rate of $1 . 00 per event per vehicle.
The second ordinance amends Section 20-18 of the South Bend
Municipal Code establishing fines for overtime and illegal parking.
Currently the parking ticket fine is $2 . 00 per violation if paid
within a five day period and $5. 00 per violation if settlement of
the offense occurs after the five days has expired. The amendment
would raise the fee to $5. 00 per violation if paid within a five day
period and $10. 00 after expiration of the five day period.
These changes are necessary to enhance the financial operation of
the parking garages and secure our ability to meet lease payments
and other operating expenses on the garages. The most recent audit
report prepared by Crowe Chizek &Company for the year 1985 showed
an operating deficit of $98,102.00. The adjustments being proposed
to the rates and parking fines are estimated to generate an
additional $130, 000.00 annually. This is a conservative estimate
and therefore should last for several years.

The establishment of a special event fee should allow the garages to
address parking overflow problems at Century Center, Morris Civic
Theatre and other special events that may happen downtown. The :-
intent of the fee is for use on weekends and after 6:00 p.m. when
the garages are doing very little business.
In reviewing the ordinances, it appears that the last general rate
increase on the parking fees was put in effect during February 23 ,
1981. The parking violation fines have not been updated since 1972.
Tuesday, May 27, 1986 , the Board of Public Works will take action in
this matter. Hopefully your ratification of their decision will
then be forthcoming.
