AN ORDINANCE AMENDING CHAPTER 21 OF THE
SOUTH BEND MUNICIPAL CODE ENTITLED ZONING
STATEMENT OF PURPOSE AND INTENT:
Due to the expansion of redevelopment efforts in the
Central City and the need to coordinate planning for that area,
the Council finds it is necessary to extend the legal boundaries
of the controlled use exempt area to permit growth of certain
entertainment and restaurant activities therein.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS :
SECTION I . Section 21-18(c) shall be amended to read
as follows :
(c) In order to promote the use of the downtown and
eastbank area as a regional retail business and convention
center, any Class A cabaret or restaurant which sells beer or
intoxicating liquor for consumption on the premises is exempt,
for the purpose of this chapter, from the locational restrictions
in section 21-18(b) herein, in the area bounded by a line drawn
as follows :

Beginning at a point formed by the intersection of the north
right-of-way line of Madison Avenue and the west right-of-way
line of William Street thence south along the west ri.ht-of-way
line of William Street to the north ri:ht-of-wa line of Western
Lincolnway East ; thence southeasterly along said right-of-way to
the southeast right-of-wa line of the portion of Monroe Street
between Lincolnway East and the St. Joseph River; thence north-
easterly along said right-of-way to its intersection with the
centerline of the St. Joseph River; thence northwesterly along
said centerline to the north right-of-way line of Jefferson
Boulevard • thence east alonl said right-of-wa to the first
alle east of Niles Avenue • thence north along said alley,
extended, to the north right-of-way line, extended, of Sorin
Street; thence west along said right-of-way to the east right-
of-way line of Niles Avenue; thence north along said right-of-
Hay to the second alley north of Sorin Street; thence west along
said alle extended to the centerline of the St. Jose.h River•
thence southwesterly along said centerline to the north right-
of-way line, extended, of Madison Avenue; thence west along said

SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council ,

Dear Council Members::
The Departments of ,Redevelopment and Code Enforcement have
determined that in order to encourage growth and development
in the downtown area, it is necessary to expand the downtown
exempted area and amend Section 21-19 (c) of the South Bend
Municipal Code.
The attached ordinance extends the legal boundaries of the
exempt downtown area to include the.proposed baseball park
site and more of the East Bank area.
These proposed changes would allow for growth of certain
entertainment and restaurant establishments in the expanded
area to aid in the revitalization and economic development
of the area.
If you have any questions concerning this amendment to
Chapter 21 , the zoning chapter, of the South Bend Municipal

Controlled Use - Exempt Area
City of South Bend
REQUESTED ACTION: This proposed ordinance would extend the
boundaries of the controlled use exempt area to
permit the growth of certain entertainment and
restaurant activities therein. Any Class A
cabaret or restaurant, which sells beer or
intoxicating liquor for consumption on the
premises, and is located within the exempt area,
would be exempt from the 1 ,000 foot locational
requirements from any other two controlled uses.
The intent of the exempted area is to promote
the use of the downtown area as a regional
retail business and convention center.

RE: A proposed ordinance initiated by Councilman Beverlie Beck amending
Chapter 21 of the South Bend Municipal Code, entitled Zoning, extending
the legal boundaries of the controlled use exempt area, City of South Bend
Gentlemen:
The above referenced ordinance initiated by Councilman Beverlie Beck was
legally advertised May 9 and May 10, 1986. The Area Plan Commission gave it a
public hearing on May 20, 1986, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by Willie
Morgan, and unanimously carried, the proposed ordinance
initiated by Councilman Beverlie Beck amending Chapter
21 of the South Bend Municipal Code, entitled Zoning,
extending the legal boundaries of the controlled use
exempt area, City of South Bend is sent to the Common
Council with a favorable recommendation
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.
