'''j 2 g ( AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3606 EAST JEFFERSON BOULEVARD IN THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Part of the Southeast Quarter (1/4) of Section Eight (8) Township Thirty-seven (37) North, Range Three (3) East, described as beginning on the North line of said Quarter (1/4) Section, at a point One Hundred Sixty-nine (169) feet West of the Northeast corner thereof, running thence west along the North line of said Quarter (1/4) Section, Sixty-seven (67) feet; thence South Five Hundred Eighteen (518) feet, more or less, to the North line of the right-of-way of the Grand Trunk Western Railway Company, at a point Two Hundred (200) feet West of the. West line of Logan Street in the City of South Bend (formerly known as 19th Street) ; thence East along the said North line of the right-of- way of the Grand Trunk Western Railway Company, Sixty-seven (67) feet; thence North Five Hundred Eighteen (518) feet to the place of beginning in St. Joseph County, Indiana. part of the Northeast Quarter (1/4) of the South- east Quarter (1/4) of Section Eight (8) , Township Thirty-seven (37) North, Range Three (3) East, described as beginning at a point on the North line of said Northeast Quarter (1/4) of the South- east Quarter (1/4) Two Hundred Thirty-six (236) feet West of the Northeast corner thereof, running thence West on the North line of said Northeast Quarter (1/4) of the Southeast Quarter (1/4) , One Hundred. The north-south right-of-way bounded by Jefferson Boulevard on the North and the right-of-way of the Grand Trunk Western Railroad Company on the South, being the same Thirty-three (33) foot right-of-way running along the entire Eastern boundary of Fernwood Addition to the City of South Bend, as shown on the Plat thereof, recorded July 12 , 1945 , in Plat Book 15, Page F, in the office of the recorder of St. Joseph County, Indiana. The east-west street known as Sunnymede Avenue boun- ded on the West by the West line extended of Lots Eight (8) and Thirteen (13) of said Fernwood Addi- tion and on the East by the East line extended of Lots Ten (10) and Fifteen (15) of said Fernwood Addition be and the same is hereby established as "C-1" Commercial , "A' Height and Area. Date Filed Application Number Date Area Plan Commission Received The undersigned hereby makes application and petitions the Common Council of the City of South Bend, Indiana, to amend the Zoning Ordinance as herein requested. (1) The property sought to be rezoned is located at 3606 East Jefferson Boulevard, South Bend, Indiana 46615 . (2) The name and address of all property owners is Holy Cross Health System Corporation, 3606 East Jefferson Boulevard, South Bend, Indiana 46615; telephone : 233-8558 . (3) It is desired and requested that this property be rezoned from "C-1" Commercial and "A" Residential , "A" Height and Area to "C-1" Commercial, "A" Height and Area. (4) This rezoning is requested so as to allow the following uses : Expansion of existing office building and parking lot. (5) Attached is a copy of (a) legal description of the property; (b) a list of names and addresses of all property owners within 300 feet of the petition property; (c) 5 site plan drawings; and (d) addressed, stamped envelopes for all property owners within 300 feet of the petition property. (6) By signing this Petition, the undersigned understands that if the Council approves this Petition to rezone, it may be r - • approved subject to the submittal of a final site plan. A final site plan must be submitted to the Area Plan Commission within one (1) year of the Council ' s action. The Area Plan Commission gave it a public hearing on May 20, 1986, at which time the following action was taken: Upon a motion by John DeLee, being seconded by Dean Speicher, and unanimously carried, the proposed ordinance and site development plan of the Holy Cross Health System Corporation to zone from "C-1" Commercial and "A" Residential, "A" Height and Area to "C-1" Commercial, "A" Height and Area, property located at 3606 East Jefferson Boulevard, City of South Bend is sent to the Common Council with a favorable recommendation, subject to a final site development plan showing screening along all property lines adjacent to residential uses. PLEASE NOTE that the Ordinance has been amended by the petitioner to include a legal description different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. Ford • • STAFF REPORT HOLY CROSS HEALTH SYSTEM CORPORATION #1024-86 May 8, 1986 3606 East Jefferson Boulevard City of South Bend REQUESTED ACTION: The petitioners are requesting a zone change from "C-1" Commercial and "A" Residential, "A" Height and Area, to "C-1" Commercial , "A" Height and Area to permit the expansion of their building. EXISTING LAND USE: The property contains the Holy Cross Health System Corporation offices. SURROUNDING LAND USE AND ZONING: Located to the north across Jefferson Boulevard is an office building zoned "C Commercial; to the east is an abandoned gas station zoned "C" Commercial and a number of single-family homes zoned "A" Residential; to the south are the Grand Trunk railroad tracks, and to the west are three single-family homes zoned "A" Residential . ACCESS: Access to the site will continue to be from Jefferson Boulevard. DRAINAGE: The drainage has not been addressed by the petitioners. DATA: The total site to be rezoned is 3.35 acres. Of that, the building will occupy 27,682 square feet, or 197. of the site; the parking and drives will occupy 68,286 square feet, or 47% of the site, and 50,151 square feet or 34% of the site will remain as open space. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: The City Engineer noted that sanitary and storm sewers are available to the site. The City Building Commissioner noted that the parking area will require the proper screening as defined by the zoning ordinance, and that the vacated rights- of-way must be approved prior to any work on the site.
