AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA,AMENDING THE ZONING ORDINANCE AND SEEKING A SPECIAL
EXCEPTION USE FOR PROPERTY LOCATED 1319, 1323,AND 1333 LINCOLN WAY
WEST AND , COUNCILMANIC DISTRICT NO. 2 IN THE CITY OF SOUTH BEND,
INDIANA
STATEMENT OF PURPOSE AND INTENT
Petitioners desire to rezone the property from U3 Urban Neighborhood 3 to NC
Neighborhood Center District and seeking a Special Exception Use for Major Vehicle Repair.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. Ordinance No. 10689-19, which ordinance is commonly known as the
Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby amended in order
that the zoning classification of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
LOT 31 AND 32, EXCLUDING THE 33' OF THE NORTH END OF SAID LOTS, OF
CUSHING'S ADDITION TO THE CITY OF SOUTH BEND, INDIANA
COMMONLY KNOWN AS 1333 LINOLN WAY WEST, SOUTH BEND, INDIANA
be and the same is herby established as NC Neighborhood Center District
SECTION II. That a Special Exception Use for Major Vehicle Repair is herby granted
subject to a site development plan hereby attached and made a part of this Ordinance and which
site plan contains and lists all conditions, if any,by the Advisory Plan Commission.
SECTION III. The Common Council of the City of South Bend, Indiana, hereby finds
that:
1. The proposed use will not be injurious to the public health,safety, comfort, community
moral standards, convenience or general welfare;
2. The proposed use will not injure or adversely affect the use of adjacent area of property
values therein;
3. The proposed use will be consistent with the character of the district in which it is
located and the land uses authorized therein;
4. The proposed use is compatible with the recommendations of the City of South Bend
Comprehensive Plan;
SECTION IV. This ordinance is and shall be subject to commitments as provided by
Chapter 21-12.07(0(7) Commitments, if applicable.
SECTION V. This Ordinance shall be in full force and effect from and after its passage
by the Common Council and approval by the Mayor, and legal publication, and full execution of
any conditions or Commitments placed upon the approval.
