Case of City of South Bend vs Bernard Scott, Habitual Offender Status
Animal Welfare Commission Members Present: Dr. Mariah Covey, Christina Gerken, Becky
Kaiser.
City Staff present: Lindsay Cueller, SBARC Shelter Manager, Tom Panowicz – Attorney for
SBARC, Kylie Connell - Attorney for AWC , Liz Maradek – Director of Code Enforcement.
1. Meeting called to order at 18:03
2. Respondents Michelle Scott and Bernard Scott are in attendance.
3. Time given for Scotts to read complaint while City of South Bend presents their case for Habitual
Offender Status requesting relinquishment of dogs Covid and GG.
4. Scotts presented case that the bites have been on their property and the dogs were never at large,
SBARC representative agrees dogs were never at large. Respondents have installed a privacy
fence in the rear of yard to insure if guests are coming dogs are not in front of house to bite.
5. After discussion Scotts were assigned Habitual Offenders with both dogs for multiple dog bites,
Commission requires both dogs spay/neutered, Microchipped and brought up to date on shots
require that dogs have one more change if another bite occurs they will relinquish their dogs
without incident or another hearing.
