HomeMy WebLinkAbout01/16/13 Board of Public Safety MinutesPUBLIC AGENDA SESSION JANUARY 16, 2013 1 The Board of Public Safety met in the Public Agenda Session at 8:04 a.m. on Wednesday, January 16, 2013 in the 13`h Floor Board Conference Room, County -City- Building, 227 West Jefferson Blvd., South Bend, Indiana, with Board President Patrick D. Cottrell and Board Members Laura Vasquez, Eddie Miller, John Collins, and Luther Taylor present. Also present was Fire Chief Stephen Cox, Police Chief Charles Hurley, and Attorney Andrea Beachkofsky. The meeting was held in the Board of Public Works Meeting Room, 13`h Floor County City Building, South Bend, Indiana. Board members discussed the following agenda items: - Promotion to Assistant Chief and Commendation Ms. Beachkofsky informed the Board that Mayor Buttigieg would be present for both the promotion of Assistant Chief John Corthier and the commendation for Firefighter Ben Noell. She added if Sergeant Bryan Miller, Police Department, was present, she would like to move up his promotion on the agenda so the Mayor could acknowledge that also. - Monthly Statistical Analysis —Fire Department Chief Steve Cox stated the most important thing to note was in the year of 2012 there were no fire fatalities. He stated he researched records and could not find any previous year with no fatalities in the history of the Fire Department. Mr. Luther Taylor stated he could not recall a year in his twenty (20) years of serving as Chief of the Fire Department that there were no fatalities, and the Fire Department is to be commended for their work. - Monthly Statistical Analysis -- Police Department Police Chief Charles Hurley stated the Police Department continues to see a 20% decline in crime overall, He noted he cannot recall any previous year when there was a 20% decline in all Part 1 crimes, so this is commendable for the Police Department in the same way the Fire Department is to be commended for no fatalities. Board President Patrick Cottrell, and Board Members Laura Vasquez, Eddie Miller, John Collins, and Luther Taylor were present. Cottrell, Member S�� Laura Vasquez, Member Me m b e id i,�M i ller, er 1— ollins, Member REGULAR MEETING JANUARY 16 2013 The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, January 16, 2013, with Board President Patrick Cottrell, and Board Members Laura Vasquez, Eddie Miller, John Collins, and Luther Taylor present. Also present were Police Chief Charles Hurley, Fire Chief Stephen Cox, and Attorney Andrea Beachkofsky. The meeting was held in the Board Conference Room, 13`h Floor, County City Building, South Bend, Indiana. FIRE DEPARTMENT ACCEPT AND APPROVE RECOMMENDATION FOR PROMOTION – JOHN CORTHIER In a letter to the Board, Fire Chief Stephen Cox recommended that Battalion Chief John Corthier be promoted from Battalion Chief to the rank of Assistant Chief of Training effective January 1, 2013. Mayor Pete Buttigieg addressed those present. He stated this is the best part of his job, not only is it a chance for him to recognize an individual who is being promoted but a chance to recognize the whole department and the work that happens day in and day out. Mayor Buttigieg stated that one of the central priorities of this administration is making sure the basics of getting through life for a citizen or a business in our community are so easy they don't have to think about it. He noted that is one of the things the Fire Department does. It's the men and women of the Fire Department that quietly do their work on a daily basis that secures normal life for the people that live in the community. He stated that in the middle of an emergency when somebody is undertaking a life and death situation it is true that good training done right saves lives. He noted one of the reasons the City has had an excellent record in safety (not only for the Firefighters, but also the City has been able to mark a year gone by with zero fire fatalities in 2012) is the result of training done right. Mayor Buttigieg noted that we usually only see the very end result when a job is done right, we don't see the hours and hours of work that go into it. When our firefighters do their j ob well you don't see the hours and hours of training that went into that end result, but it's largely about the training that saves lives and is responsible for a good job done. Mayor Buttigieg noted that it was for this reason REGULAR MEETING JANUARY 16, 2013 that the Fire Department made the recommendation that the Mayor's administration concurred with, that Battalion Chief Corthier belonged in the position of Assistant Chief of Training. Fire Chief Steve Cox stated the Fire Department wants to put an emphasis on training, making it their number one (1) priority. He noted that no matter the emergency, when 911 calls, the Fire Department almost always responds. He noted that they must always be prepared for any emergency, now more than ever, and as a result they are moving forward with building a new training facility that will be under Assistant Chief Corthier's control. Upon a motion made by Ms. Vasquez, seconded by Mr. Taylor and carried, the Chief's recommended permanent promotion was accepted and approved effective January 1, 2013. Mayor Buttigieg pinned Chief Corthier's badge on him and joined the Board of Safety in congratulating him. ADOPT RESOLUTION NO. 03-2013 - A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND INDIANA - COMMENDATION FOR FIREFIGHTER BEN NOELL President Cottrell read a letter from the San Carlos Park Fire Protection and Rescue Service District, Fort Myers, Florida, commending Firefighter Ben Noell's lifesaving actions on December 28, 2012, that resulted in saving the life of a cardiac arrest patient. Mayor Pete Buttigieg read the following resolution: RESOLUTION NO. 03 -2013 COMMENDATION FOR FIREFIGHTER BEN NOELL WHEREAS, the Board of Public Safety wishes to issue commendations to individuals that perform meritorious service on behalf of the citizens of this community, and; WHEREAS, such service shall be recognized by the Board of Public Safety and appropriate commendation shall be presented to the individuals performing said meritorious service; NOW, THEREFORE, BE IT RESOLVED, that commendation be given to: Firefighter First Class Ben Noell On December 28, 2012, Firefighter Noell was vacationing in the area of Fort Myers, Florida. While F/F Noel was performing work on a house, an elderly neighbor came outside and shouted for help. F/F Noell responded and inquired as to the nature of the emergency and was told that the woman's daughter had collapsed. F/F Noell then entered the patient's home and found her pulseless and not breathing. After 911 was called, F/F Noell began to perform CPR with mouth to mouth ventilations until the paramedic ambulance arrived on scene. F/F Noell continued to assist the ambulance crew and local fire department first responders throughout the event until the patient was found to have spontaneous pulses. He assisted with packaging the patient for transport to the hospital where she was further treated and admitted to the Intensive Care Unit. The American Heart Association has identified bystander CPR and notification of EMS as critical links in the chain of survival for victims of cardiac arrest. Without bystander CPR, this woman's chances for survival would have been near 0 percent. F/F Noell responded to this emergency without hesitation and without regard to his own personal safety in order to assist a fellow citizen to whom he had no legal obligation. Be it further resolved that Ben Noell be commended and recognized for his quick actions, dedication, and professionalism. His actions reflect highly upon him, the South Bend Fire Department, and the City of South Bend. He noted we are constantly trying to remind ourselves that South Bend is not an island; every time someone does something that reflects well on them, it reflects well on the City of South Bend and their reputation. Secondly, he noted, the work that Firefighter's do isn't just a job, it's something that's in you. He stated he is proud, but not surprised at Firefighter Noell's actions, and his actions are a great credit that reflects well on the whole City. Upon a motion by Ms. Vasquez, seconded by Mr. Taylor and carried, the resolution was adopted by the Board of Safety. ACCEPT MINUTES OF PREVIOUS MEETINGS Mr. Cottrell stated unless there were any corrections, the Board would accept the Minutes of the Public Agenda Session, Executive Session, and Regular Meetings of December 19, 2012, and the Special Meeting of December 27, 2012. FIRE DEPARTMENT FILING OF QUARTERLY TRAVEL AND TRAINING EXPENDITURES REPORT — OCTOBER, NOVEMBER, AND DECEMBER 2012 Fire Chief Stephen Cox submitted to the Board a written Quarterly Travel and Training Expenditure Report for the period of October, November and December 2012. The report summarizes travel and training expenditures for the South Bend Fire Department personnel during this quarterly period. In his letter, Chief Cox stated that training is essential to all aspects of fire service and it is necessary to remain abreast of the most current firefighting technologies and emergency medical services. There being no questions concerning this report, the Quarterly Report for Travel and Training Expenditures was accepted and filed. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — DECEMBER 2012 Fire Chief Stephen Cox submitted to the Board the monthly report for December 2012 compiled by the Prevention/Inspection Bureau of the Fire Department. Chief Cox stated that the key performance indicators the Fire Department typically looks at is how much damage is done from fires. This year, Chief Cox noted, they will continue to look at property damage, but also how much property is saved. He stated if they go back and look at how much was saved in previous years he would expect there would be significant numbers. Chief Cox noted also that typically inspections are down in December and the inspectors will use that month to catch up on previous months, affecting the number of inspections showing in December. Mr. Cottrell stated if there were no objections, the Board would accept the report for filing as presented. A summary is as follows: December December 2011 2012 STRUCTURE FIRES Property Damage -- Buildings & Contents (Estimates) $276,000.00 $33,506.00 INSPECTIONS (Fire Prevention/Inspection Bureau) 149 Inspections 199 Total Inspections (60 Re-Inspections) (53 Re-Inspections) INVESTIGATIONS (Police/Fire Arson Bureau) 23 16 Investigations Investigations 2 1 Arson Arson REGULAR MEETING JANUARY 16, 2013 POLICE DEPARTMENT APPROVE PERMANENT PROMOTION — BRYAN MILLER In a letter to the Board, Police Chief Charles Hurley recommended that PFC Bryan Miller be promoted permanently to the rank of Sergeant in the K9 Unit, effective February I5, 2011 Chief Hurley stated in his letter that Sergeant Miller was placed in a Special Assignment as a Sergeant in the K9 Unit on February 15, 2012. Upon a motion made by Mr. Miller, seconded by Mr, Collins and carried, the Chief's recommended permanent promotion was accepted and approved effective February 15, 2013, contingent on nothing happening before that date to change his status. PILING OF CHARGES NO. 2013 -01 — THEODORE ROBERT In a letter to the Board, Police Chief Charles Hurley recommended that the following Charges be filed against Patrolman Theodore Robert and he be terminated from the South Bend Police Department. Upon a motion by Mr. Miller, seconded by Mr. Collins and carried, the Chief's recommendation to file and serve Charges No. 2013 -01 on Mr. Robert was approved. Upon a motion by Mr. Miller, seconded by Mr. Collins and carried, the Chief's recommended discipline was accepted. President Cottrell read the following Charges No, 2013 -01: FACTUAL ALLEGATIONS On or about, October 8, 2012, at approximately 11:00 p.m. Patrolman Theodore Robert arrived at the 7 -11 Store located at 1827 S. Miami Street in South Bend, Indiana dressed in his official South Bend Police Department uniform and driving a marked South Bend Police Department squad car. Upon entering the store, Patrolman Robert informed the employees that he was conducting an investigation and attempted to gain information from the employees regarding two cases that were being actively investigated by the South Bend Police Department involving incidents at that store. Patrolman Robert was never assigned to work either of these cases in any capacity by the South Bend Police Department, nor did Patrolman Robert have any involvement in these cases as civilian, witness or otherwise. (South Bend Police Case# 12 -14486 and Internal Affairs Case # AI -12- 0017). While attempting to gain information about the incidents at the store, Patrolman Robert was informed by employees that a Lieutenant from the South Bend Police Department Internal Affairs Unit was already investigating the cases he was inquiring about. In response to this information, Patrolman Robert stated that he was conducting his own investigation and began making derogatory comments about the Lieutenant and the South Bend Police Department. These derogatory remarks involved accusations of racism and allegations of a cover -up. At some point during the incident Patrolman Robert informed the employees that he planned to disclose information regarding these cases to a local news outlet. On or about, October 11, 2012 at approximately 8:30 a.m., Patrolman Theodore Robert called the 7- 11 Store located at 1827 S. Miami Street in South Bend and spoke to the store manager. Patrolman Robert identified himself as a South Bend Police Officer and asked to meet with the store manager to discuss a case. At approximately 9:10 a.m. Patrolman Robert arrived at the 7 -11, in a marked South Bend Police Department squad car, dressed in plain clothes. Upon entering the store, Patrolman Robert identified himself as Officer Robert and informed the manager that he was doing some follow up regarding some incidents that had occurred at the store. Patrolman Robert then attempted gain information from the store manager regarding the same cases that he had previously attempted to gain information about on the night of October 8, 2012. (South Bend Police Case# 12 -14486 and Internal Affairs Case # AI -12 -0017) During the course of the conversation, Patrolman Robert again made derogatory comments about the South Bend Police Department alleging a cover up. In addition, Patrolman Robert requested a copy of the store's video tape of one of the alleged incidents. Patrolman Robert informed the store manager he planned to disclose the tape to a local news outlet. The store manager advised Patrolman Robert that she could not provide him with any information or the requested video and that he would have to speak with the store's business consultant regarding his requests. In response, Patrolman Robert stated he wanted to get the information and provided his contact information to the store manager requesting that the business consultant contact him regarding the matter. On October 17, 2012, at approximately 9:53 a.m., Lt. Lee Ross conducted an Internal Affairs interview with Patrolman Theodore Robert regarding his interactions with the employees at the 7 -11 on October 8, 2012 and October 11, 2012. Patrolman Robert was given all of the proper notifications that he was under investigation by the Office of Professional Standards including his "Garrity Notice." During the course of the interview Patrolman Robert denied: 1) using his official position as a South Bend Police Officer (including identification thereof) to obtain information, REGULAR MEETING JANUARY 16 2013 6 evidence and /or conduct an unauthorized investigation; 2) knowledge of ongoing South Bend Police Department investigations into the incidents he was attempting to investigate; 3) attempting to obtain information and /or investigate the facts relating to South Bend Police Case# 12- 14486; 4) informing the employees of the 7 -11 that he intended to release information regarding the incidents he was investigating to a local news outlet on October 8, 2012; 5) making derogatory remarks on October 11, 2012, about the South Bend Police Department alleging a cover up to the 7 -11 store manager; 6) informing the store manager on October 11, 2012, that he wanted to obtain a copy of the store's video tape of one of the incidents so he could release it to a local media outlet. CHARGES COUNTI- For his actions, on or about October 8, 2012, of using his official position as a South Bend Police Officer (including identification thereof) to obtain information, evidence and /or conduct an unauthorized investigation, Patrolman Robert acted in a manner which reflects unfavorably upon him and upon the South Bend Police Department. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in violation of I.C. 36- 8- 3- 4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (18) entitled, which state: A. Officers Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself /herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 18. Shall not use their official position or official identification or badge for personal or financial gain, for obtaining privileges not otherwise available to them except in the performance of their duties, or for avoiding consequences of illegal acts. Officers shall not lend another person their identification or badge or permit them to be photographed in conjunction with their official title in connection with testimonials, advertisements or any commodity or commercial enterprise without the approval of the Chief of Police. COUNT II For his actions, on or about October 8, 2012, of using his official position as a South Bend Police Officer (including identification thereof) to obtain information, evidence and/or conduct an unauthorized investigation into multiple incidents that Patrolman Robert knew and /or was on notice of were being investigated by another South Bend Police Department Officer, Patrolman Robert acted in a manner which reflects unfavorably upon him and upon the South Bend Police Department. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in violation of I.C. 36- 8- 3- 4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (28) entitled, which state: A. Officers 2. Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself /herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 28. Shall not knowingly interfere with the investigation, assigned task or duty assignment of another. They shall not interfere with cases assigned to other officers for investigation without consent, except REGULAR MEETING JANUARY 16, 2013 by order of a superior officer, nor shall they interfere with the operation of any division, bureau or unit. COUNT III For his actions, on or about October 8, 2012, of making derogatory remarks against a Lieutenant of the South Bend Police Department and the South Bend Police Department in general that involved accusations of racism and allegations of a cover -up to the employees of the 7 -11 Patrolman Robert acted in a manner which reflects unfavorably upon him and upon the South Bend Police Department. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in violation of I.C. 36- 8- 3- 4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (4 1) entitled, which state: A. Officers 2. Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself/herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 41. Shall not publicly criticize or ridicule the Department, its policies, or officers by speech, writing or expression in any other manner when such speech, writing, or other expression is defamatory, obscene, unlawful, or made with reckless disregard for its truth or falsity. COUNT IV For his actions, on or about, October 11, 2012, of using his official position as a South Bend Police Officer (including identification thereof) to obtain information, evidence and /or conduct an unauthorized investigation, Patrolman Robert acted in a manner which reflects unfavorably upon him and upon the South Bend Police Department. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in violation of I.C. 36- 8- 3- 4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (18) entitled, which state: A. Officers Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself/herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 18. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in REGULAR MEETING JANUARY 16. 2013 8 violation of I.C. 36- 8- 3- 4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (28) entitled, which state: A. Officers 2. Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself/herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 28. Shall not knowingly interfere with the investigation, assigned task or duty assignment of another. COUNT VI For his actions, on or about October 11, 2012, of making derogatory remarks against a the South Bend Police Department and the South Bend Police Department that involved accusations of racism and allegations of a cover -up to the manager of the 7 -11 Patrolman Robert acted in a manner which reflects unfavorably upon him and upon the South Bend Police Department. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in violation of I.C. 36- 8-3-4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (41) entitled, which state: A. Officers 2. Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself /herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 41. Shall not publicly criticize or ridicule the Department, its policies, or officers by speech, writing or expression in any other manner when such speech, writing, or other expression is defamatory, obscene, unlawful, or made with reckless disregard for its truth or falsity. COUNT VII For his actions, on or about October 17, 2012, of failing to truthfully answer all questions during the course of an Internal Affairs interview Patrolman Robert acted in a manner which reflects unfavorably upon him and upon the South Bend Police Department. As such, Patrolman Robert's actions are a violation of rules and conduct unbecoming of an officer in violation of I.C. 36-8-3 - 4(b)(2)(B) and (H) and the South Bend Police Department Duty Manual, Section 302.00 Rules of Conduct (A) subsections (2) and (34) entitled, which state: A. Officers Shall conduct themselves on and off duty in such a manner as to reflect most favorably on the Department. A member is further charged with the duty to conduct himself/herself at all times in keeping with the Law Enforcement Code of Ethics and the policy statements of the Police Department. Any activity contrary to this concept, may subject an officer to disciplinary action. 34. Shall truthfully answer all questions relating to the scope of their REGULAR MEETING JANUARY 16, 2013 employment and operations ofthe Department which may be asked of them. Miller, Member s /John Collins, Member s/Luther Taylor, Member Attest: s /Linda Martin, Clerk ACCEPT RECOMMENDATIONS FOR EMPLOYEES OF THE MONTH—NOVEMBER, 2012— DANIEL DEMLER AND SARAH JANIS In a letter to the Board, Chief Charles Hurley stated that Sergeant Daniel Demler and Patrolman Sarah Janis were selected as Employees of the Month for November, 2012. The award is to recognize officers, civilian employees, on the South Bend Police Department who have demonstrated actions noted by supervisors or citizens from both a professional law enforcement position and in support of the community policing efforts with citizens of South Bend. Chief Hurley stated that Sergeant Demler was responsible for the apprehension of two (2) suspects one (1) hour after the crime occurred. The Chief explained that Sergeant Demler, along with a canine unit, traced the suspects to a home where they were sitting on a porch. He was able to identify them by witness descriptions, and took them into custody, solving a horrendous crime within one (1) hour of its occurrence. Chief Hurley stated that Patrolman Janis was traveling on Portage Avenue when she came upon an accident at a roundabout. She crawled into the car and applied emergency medical assistance on the victim and kept her calm so she wouldn't go into shock. Chief Hurley stated Patrolman Janis was covered from head to toe in blood. There being no further discussion, Mr. Cottrell stated the Board would accept the recommendations of Chief Hurley for filing. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — DECEMBER 2012 Police Chief Charles Hurley stated that the good news is that Part 1 crimes are down 20% for the year 2012. He noted he is not aware of any previous year with a 20% reduction. Chief Hurley commended the community citizens for their help and the Police Department for a job well done. Mr. Cottrell indicated that unless there were questions or objections by members of the Board, the statistical analysis report for the month of December, 2012, as submitted by the Police Department, would be accepted for filing.
