AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY The first North-South alley East of Eddy St. running North from St. Vincent St. to the intersecting East-West alley for a distance of 360 feet ± all being in Hartman & Miller Ad- dition to the City of South Bend, St. Joseph County, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: The first North-South alley East of Eddy St. running North from St. Vincent St. to the intersecting East-West alley for a distance of 360 feet ± all being in Hartman & Miller Ad- dition to the City of South Bend, St. Joseph County, Indiana. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or bene- ficially affected by such vacating: Lots 17 thru 34 inclusive in Hartman and Miller Addition to the City of South Bend. SECTION IV. The purpose of the vacation of the real property is to: Provide protection for private properties and ensure public safety. SECTION V. VINCENT Dear Members of the Council: In accordance with Municipal Code Section 18-53 .8 , a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition filed by the following individuals to vacate the first north/south alley east of Eddy Street running north from St. Vincent Street to the intersecting east/west alley for a distance of 360 feet ± all being in Hartman & Miller Addition to the City of South Bend, St . Joseph County, Indiana: J. Findley May, Jr. 1105 Georgiana Street Gene DeFauw 1107 Georgiana Street Housing Authority of So. Bend 1104 N. Eddy Street Myron J. & Pauline F. Busby 1112 N. Eddy Street Wayne R. & Shirley J. McMahon 1114 N. Eddy Street Kingdom Hall of Jehovah' s Witness 1118 N. Eddy Street Johnnie R. Johnson 1124 N. Eddy Street For your information, a Public Hearing concerning this proposed vacation was held by the Board of Public Works on May 6 , 1986 . i Mr. Johnnie Johnson, 1124 North Eddy Street, was present and spoke in favor of the vacation. There was no one else present wishing to speak either for or against the Petition and no written objections were filed with the Board. In order to give Board members an opportunity to visit the site of the proposed alley to be vacated, the decision on the matter was tabled until May 13 , 1986 . Based on a site inspection having been conducted by the Board and favorable recommendations received from the Engineering Department , Area Plan Commission and Department of Economic Development concerning this vacation, the Board of Public Works favorably recommends vacation of the above referred to alley subject to any and all utility easements .
