GAMMON Approved and signed by me 19 C C't zA I Mayor ORDINANCE NO. 7-731-17 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH-SOUTH ALLEY RUNNING SOUTH FROM WOODSIDE FOR A DISTANCE OF 134 FEET ALL BEING IN KROU & WHITEMORE ADDITION TO THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend, having held a public hearing on the petition to vacate the following property: THE FIRST NORTH-SOUTH ALLEY RUNNING SOUTH FROM WOODSIDE FOR A DISTANCE OF 134 FEET ALL BEING IN KROU & WHITEMORE ADDITION TO THE CITY OF SOUTH BEND, INDIANA. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lot numbered 43-44-45-46 and 47 all in Krou & Whitemore Addition to the City of South Bend, St. Joseph County, Indiana. SECTION IV. The purpose of the vacation of the real property is to: Allow the construction of a parking lot in conjunction with New Super Market. SECTION V. This vacation is subject to the dedication of public right-of-way to accommodate a twenty ( 20) foot turning radius from a southerly and easterly direction. SECTION V. FROM WOODSIDE FOR A DISTANCE OF 134 FEET Dear Members of the Council: In accordance with Municipal Code Section 18-53 . 8 , a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition filed by Mr. Robert Cira, 2904 South Michigan Street, South Bend, Indiana, to vacate the following property: The 1st north/south alley east of Michigan Street running South from Woodside for a distance of 134 feet all being in Krou & Whitmore Add to the City of South Bend. For your information, a Public Hearing concerning the Vacation Petition as filed was held by the Board of Public Works on March 17 , 1987 . Mr. Joseph Cira, 2904 Michigan Street, South Bend, Indiana, was present but made no comments regarding this vacation. A copy of the excerpts of the minutes of the Public Hearing is attached for your information. Based on favorable comments received from the Area Plan Commission, the Engineering Department and the Department of Economic Development, the Board favorably recommends the vacation of the above referred to alley subject to the following: MEMBERS OF THE COMMON COUNCIL March 18 , 1987 Page -2- - Dedication of public right-of-way to accommodate twenty ( 20 ) feet of turning radii in both directions - Any and all utility easements. Mr. Joseph Cira advised the Board that he had no problem with the requirement that additional property be dedicated for sufficient turning movements from the remainder of the north/south alley to the intersecting east/west alley.
