This did not allow the contractor time to clear the trees on the project prior to April 1, 2021in order to comply with the bat nesting requirements. The work began on May 11, 2011 and the trees were realized in early June. At that time the mitigation process was deemed to be impractical as there well over 10 trees larger than 4 inches in diameter and there was a good change the process would run past October 1, 2021. The contractor determined that there was enough work that could be done prior the trees needing to be cleared if they started on August 7, 2021. This would allow them to work up to October 1,2021 and then clear tress and proceed with the project. It was also determined that with a Rule 5 Permit in place that project should be extended until May 1, 2022 to have time to establish trees and vegetation for the Notice of Termination. This change order is to extend the contract completion date to September 29, 2022. No extra costs are added to this change order.
