Attach information regarding projects your organization has completed for the period of one (1) year prior to the date of the current bid. 2. Attach a listing of public works projects currently in process of construction by your organization. 3. Attach information regarding any failure to complete any work awarded to you and the location thereof. 4. Attach references from private firms for which you have performed work. SECTION II PLAN AND EQUIPMENT QUESTIONNAIRE Attach an explanation of your plan or layout for performing proposed work. (Examples could include a narrative of when you could begin work, complete the project, number of workers, etc. and any other information which you believe would enable the City of South Bend to consider your bid.) 2. Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms outside your own firm who have performed part of the work) that you have used on public works projects during the past five (5) years along with a brief description of the work done by each subcontractor. 3. If you intend to sublet any portion of the work, attach the name and address of each subcontractor, equipment to be used by the subcontractor, and whether you will require a bond. However, if you are unable to currently provide a listing, please understand a listing must be provided prior to contract approval. Until the completion of the proposed project, you are under a continuing obligation to immediately notify the City of South Bend in the event that you subsequently determine that you will use a subcontractor on the proposed project. 4. Attach a listing of equipment you have available to use for the proposed project. 5. Have you entered into contracts or received offers for all materials which substantiate the prices used in preparing your proposal? If not, attach an explanation for the rationale used which would corroborate the prices listed. SECTION III CONTRACTOR'S FINANCIAL STATEMENT Attachment of bidder's financial statement is mandatory. Any bid submitted without said financial statement as required by statute shall thereby be rendered invalid. The financial statement provided hereunder to the City of South Bend awarding the contract must be specific enough in detail so that said City of South Bend can make a proper determination of the bidder's capability for completing the project if awarded. Persons, firms, partnerships, corporations, associations, orjoint venturers awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of contract or employment, or any matter directly or indirectly related to contracting or employment because of race, sex, religion, color, national origin, ancestry, gender expression, gender identity, sexual orientation, or due to age or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions will consider the Contractor's good faith efforts to obtain participation by those subcontractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder. Contractors seeking the award of a City contract cannot be required to award a subcontract to an MWBE; however, they may not unlawfully discriminate against said MBE/WBE. On goal -eligible contracts, Contractors are required to either meet both MBE and WBE utilization goals or demonstrate that the Contractor has made good faith efforts to obtain participation from MBE and WBE subcontractors. A finding of noncompliance or a discriminatory practice shall prohibit that Contractor from being awarded a City contract for a period of one (1) year from the date of such determination, and such determination may also be grounds for terminating the contact to which the discriminatory practice or noncompliance pertains. 7. Yoder Construction, Inc. The City seeks to enhance its ability to identify responsive and responsible bidders on all City public works projects by institution of comprehensive submission requirements in compliance with State law. Quality workmanship, efficient operation, safety, and timely completion of projects requires that all bidders meet certain minimum requirements to be responsive and responsible bidders. THIS FORM MUST BE SUBMITTED WITH YOUR BID. INSTRUCTIONS: If you are a pre -qualified bidder, complete Section I only. If you are not a pre -qualified bidder, complete Section 11 only. Section II acts as an application for pre -qualification. Submission of Section II will allow the bidder to be considered for pre -qualification for bids with the City of South Bend Department of Public Works. Pre - qualified bidders will then be exempt from a portion of the submission requirements outlined in Section 6- 63 of The Responsible Bidding Ordinance No. 10594=18 (hereinafter, "Responsible Bidding Ordinance") for a period of twelve (12) months. Thereafter, contractors who are pre -qualified must submit a complete application for continuation of "pre - qualified" standing, on a form provided by the City ("Responsible Bidder Checklist (1) Pre -Qualified Bidders") by December 31s' for the upcoming calendar year, or within twelve (12) months of obtaining pre - qualified standing. If the status of any item changes within the twelve (12) months, it is the responsibility of the contractor to notify the City. It is the sole responsibility of the potential bidder to comply with all submission requirements applicable to the bidder in Section 6-63 of the Responsible Bidding Ordinance no later than the date of the public bid opening. Version 02/23/2022 General Conditions - 10 POST BID SUBMISSIONS: Post -bid submissions must be submitted in accordance with Section 6-64 of the Responsible Bidding Ordinance. The post -bid submission requirements are as follows: 1. All bidders shall collect, maintain, and provide upon request, a current written list that discloses the name, address, licensing status, and type of work for any subcontractor from whom the bidder has accepted a bid and/or intends to hire on any part of the public work project, including individuals performing work as independent contractors. 2. Each subcontractor, whose portion of the project is estimated to be at least one -hundred fifty thousand dollars ($150,000.00), shall be required to adhere to the requirements of Section I of the Responsible Bidder Ordinance as though it were bidding directly to the City, except that the subcontractor shall submit the required information (including the name, address, and type of work) to the successful bidder prior to the commencement of work. 3. Failure of a subcontractor to submit the required information shall not disqualify the successful bidder from performing work on the project and shall not constitute a contractual default and/or breach by the successful bidder. However, the City may withhold all payment otherwise due for work performed by a subcontractor, until the subcontractor submits the required information and the City approves such information. 4. The disclosure of a subcontractor list ("Disclosed Subcontractor(s)") to the City by a bidder shall not create any rights in the Disclosed Subcontractor(s). Thus, a bidder may substitute another subcontractor for a Disclosed Subcontractor by giving the City, upon request, written notice of the name, address, licensing status, and type of work of the substitute subcontractor. 5. The successful bidder and all subcontractors on a public works project are required to submit certified payroll utilizing the federal form known as WH-347 or a similar form on a bi-weekly basis, submitted within 10 days after the end of each bi-weekly payroll period. Certified payrolls shall identify the job title and craft for each employee. Certified payrolls shall be submitted electronically. Please Note: Submissions deemed inadequate, incomplete, or untimely by the City may result in the automatic disqualification of the bid. The City, after review of complete and timely submissions, shall, in its sole discretion, after taking into account all information in the submission requirements, determine whether a bidder is responsive and responsible, and provide a Pre -Qualification Verification Letter, The City specifically reserves the right to utilize all information provided in the contractor's submission and any information obtained by the City through its own independent verification of the information provided by the contractor. Answer As noted on the landscape plan L1-100, groundcover is called out as Lirio e s icata. Question 2 Is a standard joint pattern expected for the skate pathway? Answer Will be provided during construction. Question 3 Is the intent to barricade the whole site off during Construction or just the areas we are working? Is Caution tape acceptable when the paths are being built in the park? Answer The intent is to barricade off only the more significant excavations, such as the restroom building and pavilion, Question 4 Per the XXII Municipal operations in the specifications, material from ALL open excavations must be covered at night at the Park fenced -in area. Is Rick Brown ok with the areas open during the night when the concrete areas are being prepped, or do they need to be covered with geotextile? Does all the material need to be moved to the fenced -in area or just material from the EPA Zones? The fenced -in area is 70ft x 35 feet. If all the material if usable for backfill is going to be stored in the fenced -in area. Can the contractor set up a separate fenced -in area closer to work? Answer Only areas with significant excavations need to be covered. Yes, separate area fenced -in closer to work is acceptable, Question 5 Is all excess material expected to be hauled to the Prairie View Facility as stated in the WSP specifications? Answer Yes. Question 6 The lead time for the ICON Shelter is roughly 20 weeks from notice to proceed. I reached out to Romtec and am still waiting to hear back about their lead time, but I contacted a pre -built shelter supplier in the area, and they said they are roughly a year out on prefabricated buildings. The contract is 90 days. Can an extension be made for this project? Answer Project extensions will be made as noted above for the scope related to these two items. Question 7 The plans call for the water main to be 3-inch ductile iron. Can this be upsized by the contractor? Answer 4-inch ductile is acceptable. Question 8 What size is the water main we are connecting to at the Charles Black Center? Answer Water service is called out as 4" DI on "As -Built Plans" Question 9 What aggregate is the sub base for the sidewalk and park improvements? Can recycled concrete be used? Answer There is no aggregate base for sidewalks that are not expected to have heavy traffic. Where applicable, recycled aggregate is acceptable. Question 10 The scale baron pages C1-100, C1-200, and C1-400 do not match with the scale stated in the informational box. Answer Scales are updated. Question 11 Can you supply a layout for the Romtec building? Answer Romtec updates will be included in a future addendum. Question 12 On pages 21 through 23 of the specifications the building installer and building supplier supply different scopes of work for the building. Can you Clarify the following scope questions? (specs are in bold. The question is after spec reference.) 1. Rebar in wall shall be supplied by building installer. Specs state see plans for spacing. Plans do not show spacing. Can you supply a layout for the concrete contractor to follow? 2. Interior wall finish shall be latex epoxy paint supplied by Building Installer. Can you supply a plan showing what paint and how each wall is coated? 3. Doors and Frames are primed to be painted onsite by building Installer. Question 13 What goes underneath the park pavilion? Is the area under the pavilion sidewalk? Answer This area is concrete sidewalk. Question 14 Is there any paint that goes on the basketball court after milling and resurfacing? Where is this going to be paid under the existing pay items? Answer Yes, an updated section and paint requirement are included. Question 15 Are the Park Benches, seating, and tables models from Vector Seating Systems? Answer Forms + Surfaces is the manufacturer for all benches, seating, and tables as noted on the plans. Product lines are Vector, Cordia, and Tangent. Refer to model numbers as noted. Question 16 Please identify where the asphalt and concrete paths are separated in alternate A and the base bid. What hard surface is around the Romtec Restroom? Answer Plans are updated. Hard surface around restroom is concrete. Question 17 In Alternate A, there are no proposed grades. Do you know if the contractor is to match existing grades? If the path has more than a 2% slope, is the contractor expected to correct the path for ADA compliance? If the path is raised or lowered for ADA compliance, is the contractor expected to grade/add soil to the park to correct any changes from the existing grade to the proposed sidewalk grade? Answer Match existing grades and provide less than a 2% cross slope. Path is not expected to exceed 5% in any areas based on existing grades. Question 18 On sheet CO-100, there is a callout 91 with no legend note. What is Callout 91 representing? Answer Updated on the plans. Note 91 is removed. Question 19 Is a geotextile (weed Barrier) going underneath any of the landscape or ground cover areas? Answer No. Question 20 Is Groundcover's pay item supposed to be an SF instead of an EA? There is roughly 7500 SF inside the mulched area around the playground. Answer Groundcover is planted spaced 12" on center, making it the same as SF. Question 21 Will the City deliver the mulch to the project, or must the Contractor pick it up? Answer City delivered. Question 22 Is the seeding pay item only for the area specified inside the roller rink? Is all other disturbed ground that needs seeded expected to be covered as incidental to the project? Answer Yes, seeding is intended to be within circular sidewalk area. All other disturbed area is incidental. Question 23 Will there be a pay item for the Lily Turf and Daffodil Bulb mix area, or is this a ground cover? If the lily turf and daffodil bulb mix is groundcover, then is the mulch not groundcover and incidental to the project? Answer Mulch is not groundcover, Lily Turn and Daffodil Bulbs are. Does the Pavilion have lighting inside that an electrician has to wire? I attached the preliminary construction plans ICON supplied me with, and I do not see what needs to be done electrically. Answer Pavilion should include outlets at each post, No lighting is included. Question 26 The sanitary sewer has roughly 2 feet of cover at the southwest corner of the skating ring. Is there any worry about the minimum cover of the sanitary sewer? Do the cleanouts require cleanout castings? There is 266 LF as a pay item and 319 LF on the plans. Can you change the pay item to reflect the amount shown on the prints? Answer Cover is not a concern. Pay item amounts are updated. Question 27 The demolition plan shows no concrete being removed for the water service connection. Is this incidental to the water meter pit? Where is the water meter pit supposed to go, next to the Charles Black Center or the restroom? Answer Water Meter pit is supposed to go next to the Restroom Building. Concrete demo for connection is incidental to water meter pit. Question 28 Is South Bend Supplier the Flow meter? Sheet C1-300 Callout A references a plumbing plan: is there a plumbing plan? Answer To be included with the Romtec Plans. Question 29 The 53 Aggregate appears to be understated. Based on the pay items, there is 1872 SYS of Concrete sidewalk and 921 SY of asphalt pavement. Based on the prints, all hard surface receives 4 inches of aggregate. 2793 SY of aggregate x 4 inches / 36 inches = 310 CY x 2 Tons per cubic yard = 620 Tons of stone. This does not include the stone under the concrete stake islands and stairs. Will this pay item be revised, or is stone incidental to an item?
