GAMMON Approved and signed by me e 1 \ C7 19—,Z___7 -a/ O*,,i Mayor SUBSTITUTE BILL NO. 8-87 ORDINANCE NO. 7 7 q _g'7 AN ORDINANCE AMENDING CHAPTER 4 ENTITLED LICENSES AND CHAPTER 5 ENTITLED ANIMALS AND FOWL OF THE SOUTH BEND MUNICIPAL CODE STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend, Indiana, believes it is in the best interests of public safety and welfare to amend certain licensing provisions of the South Bend Municipal Code in order to allow the City Controller to delegate certain licensing respsonsibilities. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. Chapter 4, Article 1, Sec. 4-14(a) of the Municipal Code of the City of South Bend shall be amended to read as follows: Section 4-14. Licensing powers and duties of the Office of the City Controller. (a) The City Controller shall issue all licenses in the name of the City, except as otherwise provided herein. The City Controller shall have the authority to designate a third party to issue pet licenses. Said designation must be made by the Controller no later than the first Wednesday of each year by the filing of an appropriate Resolution with the Common Council for their consideration and approval unless said resolution designates a period of time which is consistent with the term of said contract with the third party. Any monies remaining with the third party designee from the collection of such pet licenses at the end of the calendar year shall be processed pursuant to the applicable terms of the contract then in effect between the City and the third party. SECTION II . Chapter 5, Article 5, Sec. 5-32 of the Municipal Code of the City of South Bend shall be amended to read as follows: Section 5-32. Notice of pet .registration-license required. (a) Any resident of the City who adopts a dog from the humane society, animal care facility, or any not-for-profit agency, or who purchases a dog from a for-profit business or organization must be given a copy of the "Pet Registrot4erz-f wircd"-farm-by-t-he-facili y form entitled "Pet License Required". (b) The City -Ceetr-o1le-' --Off-ee Controller or his designee shall provide "Pet Registration- License Required' forms to all such facilities on an annual basis. Chapter 5 , Article 8 , Sec . 5-45 of the Municipal Code of the City of South Bend shall be amended to read as follows : Section 5-45. Application ; term. ( a) Application for regfstrat48as licenses or permits may be made with at the City Cea tra23er's-Office-or-des4gaated-#ac44 ty Controller or his designee , or by mail , and shall include name , address of applicant , type of permit applied for , number and description of animal ( s ) , proof of rabies vaccination , information regarding sterilization , and appropriate fee . ( 1 ) All applicants must be in compliance with zoning and all other applicable state or local laws , and shall not have been convicted of any of the cruelty to animal offenses set forth in I . C . Section 35. 46-3-2 , within the past twelve ( 12 ) months . ( 2 ) Those permits that require prior inspection will not be issued until proof of such inspection is made available to -C-041tr-04ae-r2-s- -0-f-fuce City Controller or his designee by the inspecting agency . ( b ) ii-eg1-s-t-r-a-t-i.o-n Licenses and permits are to be issued for a term of one ( 1 ) year , commencing with the first day of February and expiring at midnight on the last day of the licensing period . After February 1st all applicants will be required to pay an additional five dollars ( $5. 00) for each fe.9.43tfat-4641- license or permit required ; provided , however , circuses , carnivals , performing animal acts , or exhibitions shall be exempt from the penalty . South Bend, IN 46601 Dear President Serge: The enclosed ordinance is being filed for first reading of the February 9, 1987 South Bend Common Council meeting. The ordinance amends Chapter 4 - Licenses and Chapter 5 - entitled Animals and Fowl of the South Bend Municipal Code. Passage of this ordinance will allow the City Controller to designate other agencies, in this particular case, the St. Joseph County Humane Society to issue licenses on their premises in the City' s name. As you are aware, the City of South Bend has worked diligently with the St. Joseph County Humane Society to work out a contractual agreement for animal control in the City boundaries. By the passage of the enclosed ordinance, the Controller would also be able to designate the St. Joseph County Humane Society as its agent for the issuance of dog licenses. The City of South Bend has issued dog licenses for many years, but feels the Humane Society is in a better position to issue the licenses because of their contact with the animal owners. Where the City historically has issued about 500 dog licenses annually, it has felt that the potential licensing could be many times that amount. This upgraded level of licensing would insure greater compliance with the ordinance and with health and safety requirements concerning dog vaccinations, etc. Hon.
