ORDINANCE NO. 1C731- K7 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTIONS OUTLINING CHAPTER 2, ARTICLE 8 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, ENTITLED CITY OFFICERS AND EMPLOYEES STATEMENT OF PURPOSE AND INTENT In 1986, the City's Wage Negotiating Team was appointed by the city Administration and Common Council to negotiate salary and fringe benefits on behalf of the City. Following a series of negotiating sessions, agreements were reached with regard to specify pay policies and procedures. As a result of these agreements, Ordinance Nos. 7667-86 and 7675-86 were passed by the Common Council and a subsequent written agreement was approved by the City and Teamster local No. 364. The following ordinance amends the relevant sections of the City Code addressing: sick leave for all officers and employees; annual vacations for officers and employees; and holidays. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 2, Article 8, Sections 2-119, 2-120, and 2-121, are hereby deleted in their entirety and amended to read as follows: Section 2-119 SICK LEAVE FOR ALL OFFICERS AND EMPLOYEES. (a) Employees hired prior to January 1, 1987, shall retain their sick leave previously accrued until January 1, 1987. Employees hired prior to January 1, 1987, with less than forty-five (45) days shall be entitled to continue to accrue said sick leave as provided for in Sub-section (c) herein. Employees as of December 31, 1987, who have between forty-five (45) and ninety (90) sick days shall have said sick leave frozen at the amount they then have. Said employees may utilize said sick leave thereafter, but once used, said sick leave may only be replenished up to forty-five (45) days as provided for in Sub-section (c) herein. (b) All employees listed above, except as hereinafter provided, shall be entitled to an extended Sick and Accident Program, which program shall have a duration of seventeen (17) weeks and said employees shall thereafter be entitled to participate in the City Long Term Disability Program. Notwithstanding the above, employees who had, as of December 31, 1986, more than sixty-five (65) days as of said date shall have the right to continue to accrue up to ninety (90) days, but in the event that said employees elect to continue under the ninety (90) day program, such employees shall not be entitled to participate in the City's Long Term Disability Program. (c) All employees employed as of January 1, 1987, or thereafter, will accrue sick leave at the rate of eight (8) days per year or 2/3 days per mnnth with a maximim allnwahla annriial of fnrty-f-h (L151 einlr nave (d) This Section shall not apply to sworn police officers or firefighters. Section 2-120 ANNUAL VACATIONS FOR OFFICERS AND EMPLOYEES (a) All officers and employees of the City whose anniversary date falls on or before December 31, 1986, shall be subject to the following vacation schedule for 1987: Years of Service Working Days of Paid Vacations 1 but less than 5 10 5 but less than 8 12 8 but less than 16 15 16 but less than 20 20 20 but less than 25 26 25 or more 28 Said officers and employees are entitled to the same total number of working days of paid vacation entitled to in 1987 for 1988 and 1989. (b) All new officers and employees hired as of January 1, 1987, or thereafter, shall be governed by the following vacation schedule: Years of Service Working Days of Paid Vacations 0 - 1 year 0 working days 1 - 2 years 5 working days 3 - 4 years 10 working days 5 -10 years 12 working days 11 -15 years 15 working days 16 -19 years 17 working days 20 -24 years 20 working days 25+ years 22 working days (c) "Working days" mean all days during which the officer or employee would normally be at work if not on vacation or sick leave, but shall not include legal holidays (except for officers or employees who would otherwise work on legal holidays) or regular days off. (d) "Paid vacation" means the officer or employee shall continue to receive his regular rate of pay during the time he or she is on vacation. (e) "Years of service" means uninterrupted employment with the City. All references to years indicate a complete year of employment upon the employee's anniversary date rather than fiscal years. (f) Vacation time is not cumulative, and any days of vacation not actually used during the calendar year in which they accrue shall be lost with no additional compensation paid to employees not using those lost vacation days. (g) This section shall not apply to sworn police officers and firefighters. Section 2-121. HOLIDAYS (a) Officers and employees shall receive seven and one-half (7 1/2) designated holidays as approved by the Board of Public Works and two (2) additional non-designated holidays. An officer or employee may choose to substitute these additional holidays for one (1) of the following non-designated holidays: Washington's Birthday T.inrnln'c Rirthrlav (b) This section does not apply to sworn police officers or firefighters. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
