AN ORDINANCE TO VACATE THE FOLLOWING
DESCRIBED PROPERTY:
The first East-West alley South of Monroe
Street, running East from Main Street, for
a distance of approximately 330 feet to
Michigan Street, excepting the right-of-way
of the intersecting North-South alley.
STATEMENT AND PURPOSE OF INTENT
Pursuant to Indiana Code Section 36-7-3-12 , the Common
Council is charged with the authority to hear all petitions to
vacate public ways or public places within the City.
The following ordinance vacates the above described
public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I . The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the following
property:
The first East-West alley South of Monroe Street,
running East from Main Street, for a distance of
approximately 330 feet to Michigan Street,
excepting the right-of-way of the intersecting
North-South alley, all being in Martin' s Addition
to the City of South Bend,
hereby determines that it is desirable to vaC.ate _Salid :property.
SECTION II . The City of South Bend hereby reserves the
rights and easements of all utilities and the Municipal City of South
Bend, Indiana to construct and maintain any facilities, including, but
not limited to the following: electric; telephone; gas; water; sewer;
surface water control structures and ditches, within the vacated
right-of-way, unless such rights are released by the individual utilities.
SECTION III . The property owned by the Salvation Army.
and known as 510 S. Main Street, South Bend, Indiana will be beneficially
affected. These, are Lots 33 and 34 of Martin' s Addition to the City
of South Bend. Lots 21 and 22 in Martin' s Addition which are East of
the North/South alley will also be beneficially affected. No property
will be injuriously affected.
SECTION IV. The purpose of the vacation of the real
property is to:
Provide that the existing parking lot directly South of
said alley be contiguous with the existing building structure which is
directly North of said alley.
SECTION V. This ordinance shall be in full force and
effect from and after its passage by the Common Council and approval
by the Mayor.

South Bend Common Council :
The first East-West alley South of Monroe Street ,
running East from Main Street , for a distance of
approximately 330 feet to Michigan Street , except-
ing the right-of-way of the intersecting North-
South alley.

referred to this office for review and recommendation. Prior to
submitting a recommendation to the Council , the Board of Public
Works notifies all abutting property owners that a public
hearing will be held for the purpose of hearing all interested
persons concerning the vacation. The Council also will conduct
a public hearing at a subsequent date , and you will be so
notified.
This is to advise you that the Board of Public Works will hold a
public hearing at 9 : 30 a.m. on Tuesday, February 17 , 1987 , in
the Board of Public Works Hearing Room, 1308 County-City
Building , South Bend, Indiana, concerning the vacation of the
above alleys . If you wish to address the Board concerning this
matter, but are unable to attend the hearing, please send your
written comments prior to the above hearing date .

Board concerning this matter.

Dear Members of the Council:
In accordance with Municipal Code Section 18-53 .8 , a favorable
recommendation is being submitted to the Common Council concerning the
Vacation Petition filed by Mr. James V. Davis, Secretary, The
Salvation Army, 510 South Main Street, to vacate the following alley:
The first east/west alley south of Monroe Street,
running East from Main Street, for a distance of
approximately 330 feet to Michigan Street, excepting
the rights-of-way of the intersecting north/south alley.
For your information, a Public Hearing concerning the Vacation
Petition as filed was held by the Board of Public Works on February
17, 1987 .
Captain George Smelser, was present on behalf of The Salvation Army
and spoke in favor of the proposed vacation. A copy of the excerpts
of the minutes of the Public Hearing is attached for your
information.
Therefore, based on favorable comments received from the Area Plan
Commission, the Engineering Department and the Department of Economic
Development, the Board favorably recommends the vacation of the above
referred to alley subject to any and all utility easements.
