GAMMON Approved and signed by me t fibRl)/ V ID 19 V7 G Mayor SUBSTITUTE BILL NO. 5-87 ORDINANCE NO. 72,4T-87 AN ORDINANCE AMENDING CHAPTER 17 OF THE SOUTH BEND MUNICIPAL CODE AND ESTABLISHING A SCHEDULE OF RATES , CHARGES AND SURCHARGES FOR SERVICES RENDERED BY THE SOUTH BEND WASTEWATER TREATMENT PLANT STATEMENT OF PURPOSE AND INTENT: The Common Council of the City of South Bend last established a schedule of rates and charges for services rendered by the Wastewater Treatment Plant of the City of South Bend and for the water service fund to repair water service line leaks , by Ordinance No . 7379-84 , which was adopted on August 27 , 1984 . Rates and charges were not increased at that time . Prior to August 27 , 1984 , the Common Council of the City of South Bend last established a schedule of rates and charges for services rendered by the Wastewater Treatment Plant of the City of South Bend by Ordinance No . 6828-80 , adopted on September 15 , 1980. The Council now finds that in order to meet the financial requirements of the Wastewater Treatment Plant , it is necessary that the rates and charges for the services be raised for the first time in six ( 6) years and be established as set forth below. The discharge of sewage containing high concentrations of phosphorus or in which the biochemical oxygen demand (BOD) or the suspended solids ( SS) are high , places an undue demand upon the facilities and personnel at the sewage treatment plant . The policy of the City of South Bend is that the cost of operating the sewage treatment plant should be borne in an equitable manner by the users of that plant , taking into account the amount and intensity of their demands upon the facilities and its personnel . The Council now finds that in order to meet the financial requirements of the sewage treatment plant , it is necessary that a heavy demand discharge rate be established as set forth below. NOW , THEREFORE , BE IT ORDAINED by the Common Council of the City of South Bend , Indiana , as follows : SECTION I . Chapter 17 , Article 2 , Section 17-5 of the Municipal Code of th'e City of South Bend , shall be amended by adding the following : ( 10. 1 ) Heavy Demand Substances are concentrations of phosphorus , suspended solids or biochemical oxygen demand in sewage which exceed the levels established in Section 17 -47.3(a ) of this chapter . SECTION II . Chapter 17 , Article 5 , Section 17-47. 1 of the Municipal Code of the City of South Bend , shall be amended in its entirety to read as follows : Rate per 100 Cubic Feet Quantity of Water Used per Month per Month First 500 cubic feet 1. 16 From 501 to 2 ,000 cubic feet 8:88 _R9 From 2 ,001 to 4 ,500 cubic feet 8768 .75 From 4, 501 to 12 ,000 cubic feet 6.-54 .60 From 12,001 to 30,000 cubic feet 8.-51 . 57 From 30,001 to 50,000 cubic feet 6:44 .49 From 50,001 to 100,000 cubic feet 0736 .40 From 100,001 to 500,000 cubic feet 0:32 .36 From 500,001 to 1 ,000 ,000 cubic feet 0726 .29 Over 1 ,000 ,000 cubic feet 0:19 ,2 L ( b ) The above rates and charges are in addition to water rates and charges and the minimum charge per month for each bill from October 1 , 1980 , and thereafter shall be five dollars and eighty cents ( $5. 80) . (c ) The Common Council shall review on a regular basis all rates and charges established pursuant to this Article . Said review shall be conducted at least every four ( 4) years , beginning with four ( 4) years from the effective date of this subsection ordinance. The Director of tittl-i-tres. Public Works shall file all pertinent data needed by the Council , on or before June 1st of the year in which the rates and charges shall be reviewed . (d ) There shall be, and is hereby established for the use of and the services rendered by the wastewater treatment plant of the City of South Bend for a family dwelling unit located in an apartment complex , hotel or motel , or mobile home park the following method of computation: ( 1 ) Divide the usage shown on the meter by the number of dwelling units served by the meter to produce the average dwelling unit usage ; and ( 2) Apply the average dwelling unit usage to the rate table set forth above to produce the average dwelling charge ; and ( 3 ) Multiply the average dwelling unit charge by the total number of dwelling units served by the meter to produce the customer charge . SECTION III . Chapter 17 , Article 5 of the Municipal Code of the City of South Bend shall be amended by the addition of a new section , Section 17-47. 3 , which will read as follows : ( a) Commencing February 1 , 1987 , whenever a user' s sewage contains more milligrams per liter per day of phosphorus ( P ) , suspended solids ( SS) or biochemical oxygen demand (BOD) than the following levels : 1987 1988 1989 BOD 1 ,000 mg/1 750 mg/1 500 mg/1 SS 1 ,000 mg/1 750 mg/1 500 mg/1 P 12 mg/1 11 mg/1 10 mg/1 1987 1988 1989 BOD $0 .02/lb . $0. 03/lb . $0 . 04/lb . ( b) The amount of pounds of the heavy demand substance shall be computed according to the following formula : Gallons of sewage Milligrams divided by 1 ,000,000 x per liter x 8. 34 ( c ) Charges shall be rendered only for such heavy demand substances which have exceeded the minimum . The surcharge shall be computed on the amount of the heavy demand substance which exceeds the minimum . (d ) The surcharges are in addition to all other charges for water and wastewater and for all penalties imposed by the ordinances of the City of South Bend . ( e) Surcharges shall be based on actual quantities discharged for treatment as determined from measured concentration and flow. SECTION IV . This Ordinance shall be in full force and effect from and after its passage , approval by the Mayor , and legal publication . The rates were designed to meet the financial needs of the utility for about four years . We are before you today asking for the first rate increase in seven years . Operating with no increase in revenue for the past seven years has not been easy. During these years we have continued to improve the wastewater treatment plant operations . We have kept costs down in various ways , some of which are listed below. 1 . Systematic automation of various operations allowing a decrease in personnel . 2 . Stepped up preventive maintenance. 3 . Alternative sources for parts , many times having them manufactured locally. 4 . Process changes to handle differing loads . 5 . Ability to accept new customers or handle local business expansions allowing us the advantage of economies of scale. The bill which is filed increases the cost for two user groups . One, it proposes that the rate for heavy demand substance be established and be phased in over a period of three years as follows : 1987 1988 1989 BOD $0 . 02/lb. $0 . 03/lb. $0 . 04/lb. Page Two South Bend Common Council January 7 , 1987 Heavy demand substance generators create additional cost to the utility, and the increase in the rate merely reflects those increased costs . This heavy demand substance charge is directed to those dischargers of large quantities of BOD, SS or Phosphorus . Businesses and industry can control their costs through strict monitoring of discharge quality and quantity. The revenues we expect to realize from the Heavy Demand Substance Charge for the first three years are as follows : Industry Surcharge 1987 1988 1989 BOD 69 , 200 135 , 000 219 , 000 SS -0- -0- 11 , 900 P -0- -0- -0- Secondly, the bill proposes to keep the minimum charge for residential customers at $5 . 80 . In addition, an 11% increase is recommended for the basic rate. This revised bill represents the results of extensive discussions with the Common Council and incorporates your recommendations .
