Mayor ORDINANCE NO. -7 -7 ,%„ - $'7 AN ORDINANCE APPROPRIATING $111, 948. 87 FROM THE NON-REVERTING EAST BANK TRAIL FUND TO ACCOUNT 399. 0 CONTRACTUAL SERVICES, SAID ACCOUNT BEING WITHIN THE EAST BANK TRAIL FUND STATEMENT OF PURPOSE AND INTENT: WHEREAS, funds were received from the Stanley & Flora Clark Community Trust Fund to help acquire land and develop the East Bank Trail (abandoned Con-Rail Railroad) and funds are now needed to start the project. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: SECTION I . The sum of $111,948 .87 is hereby appropriated from the Non-Reverting East Bank Trail Fund and will be administered by the Department of Public Parks and will be distributed as set forth below: 402. 399. 0. 24. 04399. 00 Contractual Services $111,948. 87 SECTION II . That this Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. 40r 1 40fIemb'r of th Common 1.uncil OF PUat,c, w l A 9 a� ° Department of Public Parks ,1 0 Administration Building i, St. Louis Boulevard at Wayne Street South Bend, Indiana 46617 PHONE: (219) 284-9401 January 5, 1987 Members of the Common Council County-City Building South Bend, Indiana 46601 Dear Members: The South Bend Department of Public Parks is requesting the Common Council to approve an ordinance appropriating $111,948.87 to the Non-Reverting East Bank Trail Fund. Through the efforts of the Michiana Watershed and other private citizens, the Trustees of the Stanley and Flora Clark Community Trust Fund awarded a donation to the Department of Public Parks in the amount of $100,000.00. The $11, 948.87 difference is interest earned on the $100,000.00. The gift was conditioned on the Park Department applying for and receiving a Land and Water Conservation Grant in the amount of $100,000.00. The $100,000.00 grant was received by the Park Department March 15, 1985. For some time, the Park and Economic Development Departments have been meeting and working with the property owners along the abandoned rail- road property to resolve property rights for the proposed project. Surveys have been completed of the property needed for the trail and notices have been sent to the affected property owners that an appraisal will be made of the property needed for the trail. The Land and Water Conservation Grant is a 50% reimbursable grant thus the city must spend the gift money first then be reimbursed 50%. The first phase of the project is estimated to cost $200,000.00 which would include land acquisition, barricades, lights, seating areas, and some repair of the viaducts at Michigan and Leeper Avenue.
