THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS
PER ACCEPTANCE RESOLUTION
Whereas, the City of South Bend, Indiana, through its Board of Public Works, has caused a Preliminary
Engineering Report (“PER”), dated April, 2023, to be prepared by the consulting firm of American
Structurepoint, Inc., and
Whereas, said PER has been presented to the public at a public hearing held on May 23, 2023 with the
Board of Public Works, located at 1308 County-City Building, South Bend, Indiana, for public comment;
and
Whereas, the South Bend, Indiana Board of Public Works, finds that there was not sufficient evidence
presented in objection to the recommended projects in the PER.
Now, therefore be it resolved that:
1.The WWTP/CSO 045 EQ Basin and WWTP Hydraulic Improvements Preliminary
Engineering Report, prepared by American Structurepoint, Inc., dated April, 2023 be approved
and adopted by the City of South Bend, Indiana Board of Public Works; and
2.Said PER be submitted to the State Revolving Fund Loan Program for review and approval.
Adopted and Passed by the City of South Bend, Indiana Board of Public Works this 13th. day of June, of
2023.

SIGNATORY AUTHORIZATION RESOLUTION
Whereas, the South Bend, Indiana, through its Board of Public Works (Participant), has plans for a
wastewater infrastructure improvement project to meet State and Federal regulations and the Participant
intends to proceed with the construction of such project:
Whereas, the Participant has adopted this Resolution dated May 13, 2023,
Now, therefore, be it resolved by the Participant, the governing body for the City of South Bend, that:
1.Mr. Eric C. Horvath, Public Works Director at City of South Bend, Indiana, be authorized to
make application for a State Revolving Fund Loan (“SRF Loan”) and provide the SRF Loan
Program such information, data and documents pertaining to the loan process as may be required,
and otherwise act as the authorized representative of the Participant; and
2.The Participant agrees to comply with the Indiana Finance Authority, State of Indiana, and
Federal requirements as they pertain to the SRF Loan Program; and
3.Two certified copies of this Resolution be prepared and submitted as part of the Participant’s
Preliminary Engineering Report.
Adopted and Passed by the Board of Public Works of the City of South Bend, Indiana, this 13th day of
of May, 2023 at their regularly scheduled meeting.
