QL4ittinitt part:
uWt 1Workz anD jropertt Vacation Committu
The October 8, 2001 meeting of the Public Works and Property Vacation Committee was called to
order by its Chairperson, Council Member David Varner at 3:30 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Coleman, Varner, White, Kirsits, Aranowski,
King, and Kelly; Building Commissioner Don Fozo, Melvin Reed, John Oxian, Assistant City
Attorney Ann-Carol Nash and Kathy Cekanski Farrand, Council Attorney.
Council Member Varner noted that the only first item on the agenda was to review Bill No. 93-01
which would amend.Chapter 6, Article 8, § 6-37 of the South Bend Municipal Code addressing
various provisions of the Property Maintenance Code.
Assistant City Attorney Ann-Carol Nash made the presentation. She noted that the ordinance
would specify certain privacy requirements within the existing property maintenance codes with
respect to areas used for sleeping purposes. The ordinance would also authorize the Board of
Public Works to establish expenses and performance bond amounts pursuant to the Unsafe
Building Act.
Dr. Varner inquired whether the Board of Public Works is aware of their new responsibilities.
Ms. Nash stated that she had not contacted the Board, adding that all bond and expense provisions
would be submitted to the Board in a form of a proposed resolution.
Council Member King inquired whether the proposed ordinance was basically housekeeping in
nature. Ms. Nash stated that it was and would bring local provisions consistent with state law.
Council Member White voiced concern that the Board of Public Works was unaware of the
proposed legislation.
Dr. Varner suggested that Bill No. 93-01 be continued until the October 22nd Council meeting to
permit Ms. Nash to consult with the Board of Public Works.
Council Member Aranowski agreed that a continuance was in order.
Ms. Nash agreed to continue the proposed ordinance and discuss it with the Board of Public
Works and report back to the Council on October 22nd.
There being no further business to come before the Committee, Council Member Varner adjourned
the meeting at 3:40 p.m.
Respectfully submitted,
Council Member David Varner, Chairperson
Public Works and Property Vacation Committee
KCF:kmf
Attachment
•
