The November 12, 2001 meeting of the Public Works and Property Vacation Committee was
called to order by its Chairperson, Council Member David Varner at 4:03 p.m. in the Council
Informal Meeting Room.
Persons in attendance included Council Members Coleman, Varner, White, Aranowski, Kirsits,
Pfeifer, Ujdak, King, and Kelly; Attorney Charles R. Shedlak, Mahmoud A. Hussein, Elizabeth
Leonard, City Controller Frederick 011ett, Public Works Director Gary Gilot, Terry Bland of the
'otttj Igt110 rttltUtt and Kathy Cekanski Farrand, Council Attorney.
Dr. Varner noted that the first item on the agenda was to review Substitute Bill No. 94-01 which is
a request to vacate a portion of the first east/west alley south of South Bend Avenue. Dr. Varner
noted that the Board of Public Works sent a favorable recommendation. Dr. Varner further noted
that this Bill was continued from the October 22nd Committee meeting.
Mr. Charles R. Shedlak, the attorney for Club 23 made the presentation. Mr Shedlak stated that
the vacation is being requested in order to better protect the safety of the patrons of the abutting
commercial establishment known as Club 23. The alley currently separates the business from the
parking lot used by its patrons and is causing safety concerns. He noted that the substitute Bill
addresses all of the concerns raised at the previous meeting. He further noted that he spoke
directly with Tony Molnar and Carl Littrell who recommended the changes incorporated into the
substitute Bill. Mr. Shedlak further noted that the business owns the property above the alley and
Mr. Hussein personally owns the property below the alley.
Mr. Gilot stated that he would have preferred a cut on the opposite side however the jug handle
being proposed would be acceptable.
Council Member King inquired about how the vacated alley would be shut off. Mr. Hussein stated
that he would fence off the area immediately after they receive permission to vacate the alley.
Council Member Ujdak inquired about access to a new home built east of the area in question.
Council Member King noted that the Neighborhood Housing Services has protected parking.
Mr. Gilot recommended that a reflectorized fence be used. Mr Hussein noted that he would put
reflectorized tape on the fence.
Following discussion, Council Member King made a motion, seconded by Council Member
Aranowski that Bill No. 94-01 be recommended favorably. The motion passed.
Under unfinished business, Dr. Varner inquired about the overall vacation process. The Council
Attorney recommended that another meeting be held with Mr. Gilot to address continuing issues.
There being no further business to come before the Committee, Council Member Varner adjourned
the meeting at 4:14 p.m.
