The June 25, 2001 meeting of the Zoning and Annexation Committee was called to order by its
Chairperson, Council Member Karen L. White at 4:02 p.m. in the Council Informal Meeting
Room.
Persons in attendance included Council Members: Aranowski, King,White,Kelly,Varner,Kirsits,
Pfeifer and Coleman; Carl Littrell, Gary Gilot, Isabele Gonzalez, Khadijah Muhammad, Michael
Dansch, Nancy Sulok of the 'OtttUJ ub tribune, and Kathleen Cekanski-Farrand, Council
Attorney.
Council Member White noted that the first item on the agenda was to review Bill No. 45-01 which
is a proposed historic landmark designation for the property located at 2716 Vine Street, the site of
the"Old Nuner School".
Council Member White noted that the Council had received a letter dated June 21, 2001 from John
Oxian President of the Historic Preservation Commission (copy attached) requesting that the
public hearing be postponed until July 9, 2001 "to allow the Neighborhood Association and the
Commission to obtain all proposals form interested developers".
Council Member White noted that she, Dr. Varner and the Council Attorney met informally with
representatives of the South Bend Community School Corporation. That in light of that discussion
and the request from Mr. Oxian, that she would entertain a motion to continue Bill No. 45-01 on
the condition that certain information be filed with the Office of the City Clerk by HPC and SBCC
by the filing deadline and that the Council take formal action to pass or defeat Bill No. 45-01 on
July 9th.
The Council Attorney noted that some of the requested information would include a time-line from
the SBCC with regard to all action on Nuner School, a cost-benefit analysis, physical structure
long-term plan and that all documents with regard to notice and hearing from HPC would be
requested so that the Council may make an informed decision on the requested historic landmark
proposal. She added that the overall process with regard to timeliness and equal protection
concerns were also discussed.
Council Member King noted that such information would be helpful adding that proposed
development and interim protection status need to be carefully considered.
Council Member Coleman agreed that additional details are necessary and voiced support for the
action proposed by Council Member White.
Council Member Kelly noted that he had toured Nuner and the benefit would have to be
astronomical to save the facility.
Council President Pfeifer inquired into what notice is given to surrounding neighborhood groups
or businesses when a use stops on such buildings. She stressed the need for neighborhood input
and hoped that that would be a consideration in any additional legislation in this area. She added
that a mechanism should be in place so that such proposed designations are fairly and timely
addressed.

Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that at

the request of the Petitioner, the Historic Preservation Commission, that Bill No. 45-01 be
continued to July 9, 2001, on the condition that Council Member White send a letter to HPC and
SBCC requested various documents to be filed by each with the City Clerk by the filing deadline
for the next Council meeting.
The motion passed.
There being no further business to come before the Committee, Council Member White adjourned
at 4:17 p.m.
