NOTICE is hereby given that the Board of Commissioner s of St. Joseph County, Indiana will publicly open and read
aloud bids on February 7, 2023, at the hour of ten o’clock [10:00] a.m. [EDT] in the County Council Chambers,
Fourth Floor, County-City Building, South Bend, Indiana, as per Specifications now on file in the office of the
County Auditor, Second Floor, County-City Building for the following Project:
211 ANGELA BOULEVARD BRIDGE REHABILITATION OVER ST. JOSEPH RIVER
This project entails a bridge rehabilitation that includes a rigid deck overlay, expansion joint replacement, reinforced
concrete bridge approach replacement, sidewalk with curbs and bike ramp, bituminous paving, bridge railing and
sidewalk surface seal, tree clearing, and concrete bridge railing repair. The estimated project length is 339 feet.
SAID bids must be accompanied with a Certified Check made payable to St. Joseph County, Indiana or Bid Bond
executed by the bidder and surety company in a sum of not less than ten percent [10%] of the total amount of the
bid, together with a non-collusive affidavit as prescribed in Form 96, Revised 2013. Bids must be filed in the office
of the County Commissioners no later than 10:00 a.m. [EDT] on February 7, 2023, Room 722, County/City
Building, South Bend, Indiana. The bidder awarded the contract will be required to furnish a separate Payment,
Performance and Maintenance Bonds before commencing work. The Payment and Performance Bonds shall remain
in effect throughout the entire construction period in an amount equal to the awarded Contract Amount. The
required Maintenance Bond shall remain in effect for a period of three years from the date of final acceptance in an
amount of 10 percent [10%] of the awarded Contract Amount.
The bidder’s attention is directed to the Affirmative Action Requirements, and the Insurance Provisions of the
Project.
RESPONSIBLE Bidders may obtain a set of and/or sets of the Contract Documents, Special Provisions, and/or
Plans, if applicable, for this Project at http://www.sjcindiana.com/Bids.aspx. Bidders must mail in a check for the
nonrefundable fee of $35.00 to the St. Joseph County Auditor’s Office, Second Floor, County-City Building, 227
West Jefferson Boulevard, South Bend, Indiana, to be considered as a Responsible Bidder. Make any and all checks
payable to the St. Joseph County Auditor’s Office.
SPECIFICATIONS and/or Plans, if applicable, are on file and available for examination in the County Engineer’s
Office, Room 732, County-City Building, South Bend, Indiana, and may be reviewed between the hours of eight
[8:00] a.m. and four-thirty [4:30] p.m. [EDT] Monday through Friday.
THE Board of Commissioners reserves the right to reject a ny and all bids or to accept the one which, in its
judgement will be to the best interest of St. Joseph County, Indiana. The Board of Commissioners also reserves the

PREVENTIVE MAINTENANCE OF ANGELA BOULEVARD BRIDGE
OVER ST. JOSEPH RIVER
I. PROJECT DESCRIPTION
This project entails a bridge rehabilitation that includes a rigid deck overlay, expansion joint
replacement, reinforced concrete bridge approach replacement, sidewalk with curbs and bike
ramp, bituminous paving, bridge railing and sidewalk surface seal, tree clearing, and concrete
bridge railing repair. The estimated project length is 339 feet.
II. COUNTY SPECIFICATION
The County Specifications of St. Joseph County, Indiana adopted March 29, 1977, as
amended, and revised on August 17, 1989, are to be used on this Project. The County
Specifications incorporate the latest edition of the Standard Specifi cations of the Indiana
Department of Transportation and all Supplemental Specifications to the date of
advertisement, and the current list of approved or prequalified materials.
III. PLANS
The Contract Plans consisting of Sheets 1 through 7 and applicable Standards are to be used
in conjunction with the County Specifications, the Standard Specifications of the Indiana
Department of Transportation (INDOT) and the Special Provisions. Special Provisions shall
cover only modifications or additions to the Standard Specifications.
IV. SCOPE OF WORK
A. 2022 INDOT Standard Specification: 104
B. Additions:
1. The Contractor shall verify existing site conditions to preclude a stoppage of
work due to "Differing Site Conditions".
V. LEGAL RELATIONS
A. 2022 INDOT Standard Specification: 107
B. Additions:
1. The Owner, where mentioned in these documents, is St. Joseph County,
Indiana. The Engineer, where mentioned in these documents, is the St. Joseph
County Engineer or designated representative.
2. The Contractor shall apply for and obtain any and all required permits for the
work from local, state, and federal agencies and shall comply with any and
all permit requirements.

3. Materials and properties purchased under contract with the Owner that
become a permanent part of the structure or facilities constructed are not
subject to the Indiana Gross Retail Tax (Sales Tax). The exemption number
will be furnished to the Contractor upon award.
VI. BIDDING REQUIREMENTS AND CONDITIONS
A. 2022 INDOT Standard Specification: 102
B. Additions:
1. The Contractor shall submit the following fully executed documents:
a. Proposal Bid Form
b. Form 96
c. Bid Bond or Certified Check in the amount of 10% of the bid.
d. Bidder’s Checklist.
e. Bids are due at the office of the County Commissioners, Room 72 2
County-City Building, South Bend, Indiana not later than 10:00 a.m.
[EDT] on February 7, 2023.
2. Bidder is required to be a prequalified contractor with INDOT.
VII. PROSECUTION AND PROGRESS
A. 2022 INDOT Standard Specification: 108
B. Additions:
1. Completion time for this Project shall be forty-five (45) calendar days.
Notice to Proceed will be issued for the 2023 construction season.
Construction shall not begin before June 15, 2023, and shall be complete no
later than August 9, 2023. Bridge shall not be closed to traffic for more than
3 days prior to start of construction and shall be opened to traffic within 3
days upon construction completion.
2. In the event excessive inclement weather causes a delay in work, the
Contractor may apply in writing for an extension of the work schedule. The
Owner through his/her authorized representative review and establish any
and all time extensions.
VIII. MONUMENTS AND SECTION CORNERS
A. 2022 INDOT Standard Specification: 615

B. Additions:
1. Before the beginning of any work that might disturb or destroy any
monumented Section Quarter Corners as shown on the Plans, the Contractor
shall notify the St. Joseph County Surveyor at (574) 235-9631. The
Contractor shall identify and mark existing property irons and exercise
caution to leave them undisturbed through construction. There shall be no
payment for this work.
IX. UTILITY COORDINATION
A. 2022 INDOT Standard Specification: 105 and 107
B. Additions:
1. Coordination with various utilities regarding their facilities may be necessary
and it will be the Contractor’s responsibility to initiate and maintain this
coordination. The Contractor will not be granted a time extension due to
utility conflicts if the Contractor fails to properly coordinate with Utilities.
2. The facilities of AT&T Distribution exist adjacent to the project limits.
AT&T has a buried 600 pair copper cable crossing Angela Boulevard east of
the bridge on the westside of North Shore Boulevard and are not expected to
be affected by the proposed construction. If questions arise, Matt Smith of
the utility may be contacted by phone at (219) 662-4418, by cell at (219)
775-1781 or at ms2827@att.com.
3. The facilities of NIPSCO Gas Distribution exist within the project limits.
NIPSCO has a 6’’ steel main attached to the northside of the bridge and three
inactive mains and are not expected to be affected by the proposed
construction. NIPSCO has a gas valve and box located in the northwest
sidewalk approach that the contractor can adjust to final grade. See
NIPSCO’s work plan for additional details. If questions arise, Dean Garrett
of the utility may be contacted at utilitycoordination@nisource.com, or by
cell at (219) 713-6929.
4. The facilities of South Bend Water exist within the project limits; South
Bend Water has a 12’’ water main attached to the southside of the bridge;
and are not expected be in conflict of the proposed construction. If questions
arise, Leslie Biek of the utility may be contacted at lbiek@southbendin.gov,
or by phone at (574) 235-9323.
X. WAGE RATES
A. Prevailing Specification: None
B. Additions:
1. Awarding agencies require that all Contractors and Sub-Contractors awarded
Public Works Contracts file a schedule of wages to be paid on the Project
before any work is performed. This usually takes the form of a Contractor or
Sub-Contractor submitting a list of labor classifications and rates of pay to
the awarding agency.

2. Successful bidder is required to submit Form 347, Weekly Payroll, to the
Engineer within 10 days of the applicable payroll date throughout the
duration of the Contract.
XI. PAYMENT
A. The quantities shown in the bid documents are believed to be sufficient to complete
the specified work, however, they are approximate and are shown for the purpose of
comparing bids. Payment to the Contractor will be made only for those quantities of
work actually completed and accepted in accordance with specifications. Major work
changes made in the field must be submitted for approval prior to the commencement
of work, or the Engineer must sign the Contractor’s daily work report on the day the
work is performed. Minor changes in existing items must be reviewed by the
Engineer in the field and documented on the Engineer’s daily report.
B. Payment for the various items of the contract shall be complete and final according to
the Field Engineer. Payment for all materials, tools, equipment, overhead and profit
for the item shall be completed on a progress pay estimate processed at a two (2)
week minimum basis. Payment shall be determined from weight tickets or shipping
bill furnished by the Contractor for each material delivered to the project, and upon
field measurements as agreed upon by the Contractor and the Engineer. Payment will
only be made once all paperwork including daily certifications, weight tickets,
change orders, payrolls, and work schedules are received for that pay period.
XII. AWARD AND EXECUTION
A. 2022 INDOT Standard Specification: 103
B. Additions:
1. The submission of the lowest total of all unit price extensions does not
guarantee award of contract to the Bidder submitting such low total of
extensions.
2. If a Contract is awarded, the award shall be to the qualified bidder submitting
the most advantageous proposal to the Owner. The Owner shall consider in
its evaluations of proposals:
a. the total estimated amount of the contract work indicated by the total
of unit price extensions; and
b. the individual unit prices bid, with particular attention and
consideration of unit prices for major work items that are subject to
overrun; and
c. the probable final, as-constructed cost of the project work; and
d. the overall qualifications, experience, and history of satisfactorily
completed projects of each bidder.

3. The award of the contract will be made within a maximum time of sixty (60)
calendar days from the submittal date. The County reserves the right to hold
the bids until the award of the contract.
4. The Engineer shall approve all sub-contractors submitted by the Contractor.
5. Upon award, the Engineer shall submit Contract Documents to the
Contractor. Contract Documents include the Contract, Payment and
Performance Bonds, and a 3-year Maintenance Bond.
XIII. LIQUIDATED DAMAGES
A. 2022 INDOT Standard Specification: 108
B. Additions:
1. The time of beginning and the time of completing the work are essential
conditions of the Contract. Should the Contractor fail to complete the work
within the time stipulated, or within any extensions thereof granted by the
Owner, there shall be a deduction in the amount otherwise due the
Contractor, not as penalty, but as ascertained and liquidated damages, for
each and every day that the Contractor shall be in default after the time
stipulated, or as extended, in the amount of $500.00 per day.
2. Any liquidated damages due the Owner shall be deducted from the final
payment due the Contractor. Should the amount otherwise due the
Contractor be less than the amount of such liquidated damages, the
Contractor and his surety shall be liable to the Owner for such deficiency.
3. Lost time shall not be included in the computation of Contract time, and
liquidated damages shall not be assessed against the Contractor for that day’s
delay when the loss of the day's work is due to an unforeseeable cause
beyond the control and without the fault or negligence of the Contractor.
Such unforeseeable causes shall include but not necessarily be restricted to
the following:
a. Acts of God, acts of the public enemy, acts of the Owner except as
provided in the Contract Documents, acts of another contractor in the
performance of a Contract with the Owner, riots, strikes, epidemics,
quarantine restrictions, freight embargoes, fires, floods, and
unusually severe weather that precludes efficient work progress.
b. Delays to subcontractors or suppliers for any of the causes listed in
subparagraph 3. (a) above when such delays have consequential
effect upon the completion of the work.
4. The Inspector or other authorized representative of the Owner shall keep a
written record of each day sufficient for his determination as to the inclusion
of that day in the computation of Contract time. Where no provision for full
time inspection is made, local weather records will be used to determine lost
days. This record shall be available for examination by the Contractor during
normal hours of work. In case of disagreement between the representative of

the Owner and the Contractor as to the classification of any day, the matter
shall be referred to the Engineer, whose decision shall be final. Where no
written record of lost time and job progress is submitted to the Engineer for
weekly review and Contract schedule maintenance, each day will be included
in computation of Contract time.
5. For the purposes of this Contract, New Year’s Day, Memorial Day,
Independence Day, Labor Day, Thanksgiving, Christmas, Saturdays, and
Sundays will be considered legal holidays; no other days will be so
considered. No engineering observation will be furnished on legal holidays
except in an emergency.
6. Legal holidays will not be included in the count of lapsed days chargeable to
Contract time, regardless of the fact that the work may have been done
thereon.
XIV. INSURANCE
A. Prevailing Specification: Attached County Insurance Requirements.
B. Additions:
1. Bidder's attention is drawn to the Insurance Provisions as set out in 103.04.
The named insured shall include St. Joseph County, Indiana and its agents.
2. Final Contract Documents will not be processed for the successful bidder
until all insurance policies or binders are received by the County.
a. The awarded bidder will be required to furnish separate Performance
and Payment Bonds, each in the amount of one hundred percent
(100%) of the contract price before commencing work.
b. The Performance Bond and Payment Bond shall remain in effect
throughout the entire construction period and in addition a
Maintenance Bond in an amount of 10% for a period of three years
from the date of final acceptance of work will be required.
3. All insurance premiums shall not be paid for separately. The cost thereof shall
be included in the cost of the pay items.
4. No work shall commence until the Contractor submits all necessary
paperwork.
XV. MAINTENANCE OF TRAFFIC
A. 2022 INDOT Standard Specification: 104 and 801
B. Additions:
1. The Contractor shall provide the Owner and the Engineer with the name and
phone number of his responsible employee during non-working hours for any
signage and barricade maintenance.

2. All necessary traffic control signs and barricades used during construction
shall conform to Section 801 and the Indiana Manual on Uniform Traffic
Control Devices for Streets and Highways. Traffic control devices shall be
erected and maintained in accordance with the INDOT Standard Drawings,
and current revisions thereto.
3. The Contractor shall be required to furnish all advance construction signs and
barricades as maybe required or otherwise shown on the plans. These shall
remain the Contractor's property. Only those signs and barricades listed as
pay items in the proposal will be paid for separately. All other signs and
barricades not specifically provided as pay items are to be included in the
lump sum price for Maintaining Traffic.
4. Unless prior written approval is received, no work shall be permitted on
Federal or State recognized holiday weekends from noon Friday until sunrise
Monday.
5. Open excavations and trenches shall have temporary safety fencing enclosing
the area to prevent access by unauthorized people. The safety fence shall be
bright orange made of high-density polyethylene grid or approved equal a
minimum of 42-inches high supported and tightly secured to steel posts on
10-foot centers. Fencing shall be removed upon completion of work in the
area. Do not stockpile material or spoil outside fenced areas in preparation
for the next day's work.
6. All closures and/or road restrictions shall be coordinated with public safety
and local school officials.
7. Access to all businesses and residences for all postal deliveries and all
emergency traffic (police, fire, medical, etc.) within the project limits shall be
maintained at all times.
8. Notification shall be given a minimum of 48 hours prior to all road closures
and for road restrictions. Proposed deviations from the plans shall be in
writing to the Engineer for approval.
9. Pedestrian accessibility shall be provided and maintained in accordance with
107.08 during the construction of the project where sidewalks and curb
ramps exist. However, due to full bridge closure, bridge sidewalks will be
closed to pedestrians during construction.
10. The signalized intersection at Angela Boulevard and North Shore Drive shall
flash red during the bridge closure period. Contractor shall coordinate with
the City of South Bend and St. Joseph County for adjustment of the Angela
Boulevard and North Shore Drive signalized intersection during construction.
The Point of Contact for the City of South Bend is Leslie Biek, Assistant
City Engineer.

XVI. CONSTRUCTION ENGINEERING
A. 2022 INDOT Standard Specification: 105.08
B. Additions:
1. The Contractor will provide all work required under this item.
2. The Contractor will be responsible for witnessing the existing vertical grades
for bridge deck overlay requirements.
3. Construction Engineering will be paid for at the lump sum price bid for this
item and shall not exceed two (2%) percent of the total of all other bid items
of the original proposal.
4. The Contractor shall maintain at the site for the Owner, one (1) record copy
of all drawings, specifications, Addenda, Change Orders, and other
modifications in good order and marked currently to record all changes made
during construction.
5. Upon completion and Final Acceptance, As-Built drawings of all work shall
be provided to the County Engineer’s Office. These As-Built drawings shall
include specifications, addenda, Change Orders, and other modifications to
the project.
6. The Contractor shall prepare a Project Schedule to graphically show by bar
chart or using other computer software to reflect the order and
interdependence of all activities necessary to complete the Work. This
schedule shall reflect bridge rigid deck overlay, RCBA and sidewalk
replacement, surface sealing, maintenance of traffic setup, testing, surface
restoration, other miscellaneous items and final clean up and shall be made
available at the Preconstruction Meeting demonstrating how work will be
completed.
7. This project schedule shall be maintained and updated by the Contractor. An
updated project schedule highlighting changes or deviations shall be
submitted at least on a monthly basis. The schedule shall indicate actual
progress in percent complete for each activity and provide a written narrative
of revisions causing delay with an explanation of corrective actions taken or
proposed.
8. The Contractor shall not be able to make additional costs claim for
compressed schedule unless the delay is attributed to events or the work of
others beyond their control.
XVII. MATERIAL APPROVAL AND SYSTEM TESTING
A. 2022 INDOT Standard Specification: 106

1. The Contractor shall be responsible for all normal testing as specified by the
most current version of the INDOT Standard Specifications dated 2022 and
all supplements thereto.

2. The Contractor shall employ a qualified third party, professional testing
laboratory to provide all material testing, approval testing and system testing.
There will be no testing performed by the St. Joseph County Engineer’s staff.
The tests to be provided and the frequency of testing shall be as required for
the INDOT Standard Specifications for highway materials and approvals.
3. Two copies of all test reports are to be submitted to the Engineer. All reports
are to be certified by a Professional Engineer registered in the State of
Indiana.
4. If a supplier of materials has a current immediate usage approval by INDOT,
compliant material will not require further testing.
5. Material testing will not be paid for separately and shall be considered
incidental to the contract work. Cost for testing shall be included in each
respective pay item.
XVIII. SAFETY
A. 2022 INDOT Standard Specification: 107.08
B. Additions:
1. The IOSHA Regulation 29 C.F.R. 1926, Subpart P, for all construction
excavations and trench safety systems is hereby incorporated into these
Contract Documents by reference. The cost of the safety systems shall not
be paid for separately; but shall rather be included in the unit prices bid for
the work.
2. Entry into all confined facilities shall be in accordance with Local, State, and
Federal Confined Space Entry Laws and Regulations.
XIX. RETAINAGE

seventy-five (75%) percent of the lump sum price, which will be included in
the first partial payment estimate.
3. The balance of the lump sum price is considered as demobilization and will
be paid for when all work is completed on the job and final clean-up is
completed.
XXI. CLEARING RIGHT-OF-WAY
A. 2022 INDOT Standard Specification: 201 and 202
B. Additions:
1. The lump sum price bid for "Clearing Right-of-Way" shall include payment
for "Clearing and Grubbing", and "Removal of Structures and Obstructions",
which shall include removal of all brush, trees, other vegetation, and man-
made materials required to perform the scope of work, except for those items
which are specifically listed in the proposal for separate payment.
2. The removal of RCBA and integral concrete curb will be measured and paid
by the square yard price bid for "Pavement Removal".
3. The removal of concrete curb and gutter will be measured and paid by the
square yard price bid for "Curb and Gutter, Remove".
4. The removal of trees will be measured and paid per each price bid for "Tree
10-inch, Remove". This work shall also include stump removal, backfill with
suitable material, topsoil and hydromulch seed for surface restoration. These
items will not be paid separately and shall be included in the cost of this pay
item.
5. The removal of sidewalk will be measured and paid by the square yard price
bid for "Sidewalk Concrete, Remove".
6. Any fencing or man-made obstructions (i.e., guardrail, utility markers,
landscape rocks, etc.) which are in place at the start of construction shall be
carefully removed. These items shall be restored using recovered serviceable
materials. These shall include obstructions within existing right-of-way
impacted by the scope of the work. Removal and restoration of fencing and
other man-made obstacles within the right-of-way will not be paid for
separately and shall be included in the cost of the pay item. Damaged items
caused by the Contractor shall be restored or replaced at no additional cost to
the Owner.
7. The Contractor shall have all underground utilities field located prior to the
start of construction. The Contractor shall protect existing and relocated
utilities from damage. Burial of debris on site will not be allowed. Disposal
of debris shall be at an off-site location in an approved manner according to
all County and State Statutes.

XXII. COMMON EXCAVATION
A. 2022 INDOT Standard Specification: 203
B. Additions:
1. The unit price bid shall include all items required to perform the scope of
work, except for those items that are specifically listed in the proposal for
separate payment.
2. The minimum soil compaction requirements for backfill material will be as
follows:
Subgrade under any road, pavement, and drainage structure 100%
Existing ground receiving fills and any disturbed area 90%
Backfill in pipe trenches under any roads/pavement 100%
Compacted Aggregate Subbase 100%
3. Maximum density shall be determined by AASHTO T-99 as modified by
Section 203.24 of the State Specifications using Method A for soil and
Method C for granular material.
4. No open excavations without proper protection as provided or otherwise
directed shall be left overnight. Unprotected open excavations must be
backfilled or fenced.
5. The quantities of excavation shown on the proposal sheet will not be
measured separately by the Engineer. If the Contactor has acceptable data
that indicates an excavation quantity error by more than 10%, then additional
measurements will be performed by the Contractor and submitted to the
Engineer for review and determination. Measurement will not include
material excavated beyond authorized limits. If the quantity error is agreed
by the Engineer, then the unit price on the proposal form will be extended.
XXIII. EROSION CONTROL
A. 2022 INDOT Standard Specification: 205
B. Additions:
1. The Contractor shall provide temporary silt fences, temporary inlet
protection, or other necessary items to prevent sediments from being washed
off the project site. The cost for environmental protection measures shall be
included in the Stormwater Management Budget pay item.
2. The Contractor shall monitor and oversee all erosion control measures,
conduct regular weekly and post-event inspections, and perform all other
tasks related to the installation, maintenance, and removal of erosion control
measures. Sediment runoff outside the project limits shall be removed
immediately and properly disposed at no additional costs to the Owner.
Measurement will not be made separately, and all associated costs shall be
paid for under the Stormwater Management Implementation pay item Lump
Sum price.

XXIV. SITE PREPARATION AND CLEANUP

1. Contractor shall be responsible for the preparation of all work surfaces.
2. Areas of erosion that develop after completion of final grading shall have
remedial treatment.
3. Spoil, construction material, and any other project materials inadvertently
found outside of the project limits shall be immediately removed and

4. Debris, trash, and other materials discovered and not incorporated into the

6. Tack Coat shall be applied at the rate prescribed by INDOT Standard
Specification Sections 405 and 406, respectively.

cleaning and sealing of the joint shall be in accordance with 507.04(a) and as
follows. Transverse and longitudinal joints shall be sealed with hot poured
joint sealant in accordance with the sealant manufacturer’s recommendations.
Joints shall be sealed with joint sealing materials within 1/4 in. below the
surface and shall extend beyond the limits of the overlay to any existing
sealant that is to remain in place.
2. Sawing equipment shall be self-propelled single or gang-mounted units. The
saw shall be capable of maintaining the specified alignment and depth of cut
without damaging the overlay.
3. The cost of Type 1A joint in east RCBA is included in the cost of this pay
item.

OWNER AND CONTRACTOR PROTECTIVE LIABILITY INSURANCE
The Contractor shall, prior to commencing work and thereafter keep in force until terminated by
the Board of Commissioners through the execution and Board approval of the Project
Completion Affidavit, furnish the County with a policy providing Owners’ and Contractors’
Protective Liability Insurance Coverage for Operations of Contractor. The County may
accept an insurance binder, temporarily, pending receipt of the Certificate of Insurance policy.
The Insurer shall be a company holding a Certificate of Authority by the Indiana State Insurance
Commissioner to do business in the state. The named insured shall be St. Joseph County,
Indiana, its members and employees, and the limits of coverage shall be in the amounts set out
herein:
1. A limit of not less than $2,000,000.00 for all damages arising out of bodily injury or
death in any occurrence.
2. A limit of not less than $1,000,000.00 for all damages arising out of injury to or
destruction of property in any occurrence, and subject to the limit of occurrence, and
aggregate of not less than $6,000,00.00 for all damages arising out of injury to or
destruction of property during the policy period.
In addition to the limits specified herein, the policy shall also include the following
endorsements to the Owners’ and Contractors’ Protective Liability Insurance:
3. Whenever used in the policy, the term “named insured” shall include St. Joseph County
Government, its members, and employees.
4. Whenever used in this policy, the term “general supervision” shall include on-site
inspection, field engineering, field testing, and activities incidental thereto.
Proof of renewal shall be furnished fifteen (15) days prior to the expiration of the policy, and if
subject to cancellation, the policy shall provide for written notice from the insurance company to
the St. Joseph County Board of Commissioners at thirty (30) days prior to the effective date of
the cancellation. In the event of cancellation or expiration, all work on the contract shall be
suspended except that necessary for traffic maintenance and the protection of life and property.
The County shall not permit the Contractor to resume work until the above coverage
requirements are renewed and in full effect. No extension in the Contract completion time or
additional payment will be allowed on account of this requirement and contract time charges will
continue.
With respect to all operations he performs and for the duration of the Contract, the Contractor
and Subcontractor shall carry Contractors’ Comprehensive General Liability Insurance providing

COMPREHENSIVE AUTOMOBILE LIABILITY
The Contractor and Subcontractor shall carry for the duration of the Contract, Comprehensive
Business Automobile Liability Insurance providing for a limit of not less than $1,000,000.00 for
all damages arising out of bodily injury or death for each person and a limit of not less than
$1,000,000.00 for all damages arising out of bodily injury or death in any one occurrence. The
policy shall also provide for a limit of not less than $1,000,000.00 for all damages arising out of
injury to or destruction of property in any one occurrence. Such insurance shall include coverage
for all owned, non-owned, and hired vehicles.
WORKMAN’S COMPENSATION INSURANCE
The Contractor and Subcontractor shall also provide proof of a current Workman’s
Compensation Insurance policy prior to Contract awards.
HOLD HARMLESS PROVISIONS
The Contractor shall indemnify, defend, exculpate, and hold harmless St. Joseph County,
Indiana, its officials and employees for any liability due to loss, damages, injuries, or other
casualties of what so ever kind, or by whom so ever caused, to the person or property of anyone
on or off the right-of-way arising out of or resulting from the performance of the Contract or
from the installation, existence, use, maintenance, condition, repairs, alterations, or removal of
any equipment or material, whether due in whole or in part to the negligent acts or omissions of
the County, its officials, agents, or employees; on the Contractor, his agents or employees, or
other persons engaged in the performance of the Contract or rising out of this Contract; or the
joint negligence of any of them, including any claim arising out of the Workman’s
Compensation Act or any other law, ordinance, order, or decree.
The Contractor also agrees to pay all reasonable expenses and attorneys’ fees incurred by o
imposed on the County in connection herewith in the event that the Contractor shall default
under the provisions of this paragraph. As much of the money due the Contractor under and by
virtue of his Contract as the County may consider necessary for such purpose may retained for

the use of the County. In case no money is due, the Contractors’ Surety may be held until such
suit or suits, action or actions, claim or claims for injuries or damages as aforesaid shall have
been settled and suitable evidence to the effect furnished to the County. Money due will not be
withheld when the Contractor produces satisfactory evidence that he is protected adequately by
public liability and not extend to the indemnification or exculpation against claims arising out of
the preparation or approval of Plans, Specification, or Special Provisions unless furnished by the
Contractor.
It is specifically agreed between the parties executing the Contract that it is not intended by any
of the provisions of any part of the Contract to create the public or any member thereof a third
party beneficiary hereunder, or to authorize anyone not a party to the Contract to maintain a suit
for personal injuries or property damage pursuant to the terms or provisions or the Contract.

2018 RECOMMENDED GUIDE SPECIFICATION FOR ASPHALT PAVEMENTS FOR
LOCAL GOVERNMENTS AND NON-GOVERNMENTAL APPLICATIONS
This recommended specification incorporates the latest asphalt pavement technologies. It attempts to
present the best practices, procedures and processes but is not intended to replace sound engineering
knowledge, judgment and experience.
The Indiana Department of Transportation (INDOT) Standard Specifications, Section 402 – Hot Mix
Asphalt, HMA, Pavement dated 2018, shall apply with the modifications as noted herein. Section numbers
refer to INDOT Standard Specifications.
HMA.01 Description
This work shall consist of one or more courses of Hot Mix Asphalt (HMA) base, intermediate, surface
mixtures or other miscellaneous HMA application.
HMA.02 Quality Control
HMA shall be supplied from a Certified HMA Plant in accordance with Indiana Test Method (ITM) 583 –
Certified Volumetric Hot Mix Asphalt Producer Program. HMA shall be transported and placed according
to a Quality Control Plan (QCP) prepared by the Contractor in accordance with ITM 803 – Contractor
Quality Control Plan for HMA Pavement. The QCP shall be submitted to the Contracting Agency five
calendar days prior to commencing HMA paving operations.
HMA.03 Materials
PG binders for HMA shall be supplied by an INDOT approved supplier in accordance with ITM 581 – Asphalt
Supplier Certification (ASC) Program and shall meet the requirements of Section 902.01.
Aggregate materials for HMA mixtures shall be supplied by an INDOT Certified Aggregate Producer (CAPP).
The aggregates shall meet the requirements of Section 904.
The HMA fine aggregate materials shall meet the requirements of Section 904.02(b), except the fine
aggregate angularity table shall be modified as follows:

accordance with Section 401.05 and submitted to the Contracting Agency in an acceptable format one
week prior to use. The DMF shall be based on the mixture type (design ESAL) and mixture designation of

Guidelines are contained in HMA.08. The plant discharge temperature for any mixture shall not be more
than 315°F whenever PG 58-28, PG 64-22, PG 64-28, or PG 70-22 binders are used and not more than 325°
F whenever PG 70-28 or PG 76-22 binders are used. HMA mixtures may be produced by using a water
injection foaming device or additives as specified and according to the manufactures recommendations.
HMA.05 Volumetric Mix Design
Design Mix Formula (DMF) shall be determined for each mixture from a volumetric mix design by a design
laboratory selected from INDOT’s list of Approved Mix Design Laboratories. A volumetric mixture shall be
designed in accordance with Section 401.05 and AASHTO R 35 with the following tables and exceptions.
All loose mixture shall be conditioned for four hours in accordance with AASHTO R 30 prior to testing.

HMA wedge and leveling mixtures shall consist of surface or intermediate mixtures in accordance with
HMA.04. Aggregate requirements of 904.03(d) do not apply when the wedge and leveling mixture is

Temporary HMA mixtures shall be the type specified in accordance with HMA.04. A MAF in accordance
with 402.05 will not apply.
HMA curbing mixes shall be HMA surface type B in accordance with 402 except 402.05 shall not apply and
RAP shall not be used. The binder content shall be 7.0% and the gradations shall meet the following:

IMPORTANT NOTE: The above table gives the designer the option to specify a maximum binder
replacement of either 25.0% or 40.0% for all dense graded asphalt mixtures, excluding Type C surfaces. In
2016, INDOT revised their specifications to reduce the maximum allowable binder replacement percentage
from 40.0% to 25.0% for all dense graded asphalt mixtures. However, higher RAP/RAS mixtures are more
sustainable and economical. It is NAPA (National Asphalt Pavement Association) and APAI’s positions that
higher binder replacement percentages can be utilized without compromising durability and longevity of
the asphalt pavement when properly designed. The Departments of Transportation for some surrounding
states allow for higher binder replacement percentages than 25.0%. For asphalt projects using this Guide
Specification, the Agency/Owner should use proper engineering judgement on a project-by-project basis
to select the maximum binder replacement in the table above.

HMA Mixtures with a binder replacement greater than 25.0% and less than or equal to 40.0% by weight
of total binder content utilizing RAP or a blend of RAP and RAS shall use a binder grade with the upper
and lower temperature classification reduced by 6° C from the specified binder grade as shown below.

HMA.09 Acceptance of Mixtures
Acceptance will be on the basis of a Type D Certification in accordance with Section 916(d). The HMA
Certification shall be the quality control test representing the material and shall include air voids at Ndesign
and binder content for material supplied to the project. Type D Certification shall be submitted to the
Contracting Agency’s representative each day in which material is received.
The Minimum Testing Frequency for Type D Certification.

CONSTRUCTION REQUIREMENTS
HMA.10 General
Shall be in accordance with Section 402.10.
HMA.11 Preparation of Surfaces to be Overlaid
Milling of an existing surface shall be in accordance with Section 306. Surfaces on which a mixture is
placed shall be free from objectionable or foreign materials at the time of placement.
PCCP, milled asphalt surfaces and asphalt shall be tacked according to Section 406. Contact surfaces of
curbing, gutters, manholes and other structures shall be tacked in accordance with Section 406.
HMA.12 Weather Limitations
HMA courses less than 110 lb/syd are to be placed when the ambient and surface temperatures are 60o F
or above. HMA courses equal to or greater than 110 lb/syd but less than 220 lb/syd are to be placed when
the ambient and surface temperatures are 45o F or above. HMA courses equal to or greater than 220
lb/syd are to be placed when the ambient and surface temperatures are 32o F or above. Mixture shall not
be placed on a frozen subgrade. However, HMA courses may be placed at lower temperatures provided
the density of the HMA course is in accordance with Section 402.16 or if approved by the Contracting
Agency’s representative.
HMA.13 Spreading and Finishing
Shall be in accordance with Section 402.13.
HMA.14 Joints
Shall be in accordance with Section 402.14.

HMA .15 Compaction
The HMA mixture shall be compacted with equipment in accordance with 409.03(d) immediately after
the mixture has been spread and finished. A roller application is defined as one pass of the roller over the
entire mat. Compaction operations shall be completed in accordance with the following table or by the
Low Temperature Compaction Requirements in HMA.16.

Shall be in accordance with Section 402.16. Density test reports shall be furnished to the Contracting
Agency.
HMA.17 Shoulder Corrugations
Shall be in accordance with Section 402.17.
HMA.18 Pavement Smoothness
Shall be in accordance with Section 402.18.
HMA.19 Method of Measurement
Shall be in accordance with Section 402.19, except the Material Adjustment Factor (MAF) shall not apply.
HMA.20 Basis of Payment
The accepted quantities for this work will be paid for at the contract unit price per ton for HMA of the
type and Nominal Maximum Aggregate Size (NMAS) specified, complete in place.
