Zoning an annexation QCommtttee
The August 13, 2001 meeting of the Zoning and Annexation Committee was called to order by its
Vice-Chairperson, Council Member Andrew Ujdak at 3:35 p.m. in the Council Informal Meeting
Room.
Persons in attendance included Council Members: Aranowski, Kelly, Varner, King, Ujdak, and
Pfeifer; Citizen Member Isabele Gonzalez, Building Commissioner Don Fozo, Todd Zeiger,
Rosemarie L. Apple, William J. Lee, Jeff Myers of Area Plan, Jon Hunt, and Nancy Sulok of the
iotttb 364310 Ertl:Mitt and Kathleen Cekanski-Farrand, Council Attorney.
Council Member Ujdak noted that Chairperson Karen L. White received a letter from Mr. John
Oxian, President of the Historic Preservation Commission dated today (copy attached) which
requests that Bill No. 61-01 requesting landmark status for the old Washington School be
continued to August 27th.
The Committee then reviewed substitute Bill No. 46-01 which is a zoning request for the property
located at 4324 S. Main Street(copy attached). Jeff Myers of Area Plan reported that the Area Plan
Commission held a public hearing on this bill on July 17th and sends it to the Council with a
favorable recommendation.
Mr. William J. Lee made the presentation on substitute Bill No. 46-01. He noted that the house on
the property burned down several years ago. There was no one from the public to speak either in
favor or against the measure.
Since a quorum of the Committee was not present,for formal action was taken.
The Committee then reviewed substitute Bill No. 47-01 which is a zoning request for the property
located at 1317 Lincolnway West (copy attached). Jeff Myers of Area Plan reported that the Area
Plan Commission held a public hearing on this bill on July 17th and sends it to the Council with a
favorable recommendation.
Rosemarie L. Apple made the presentation on substitute Bill No. 47-01. She noted that she is
requesting that the property be rezoned to permit a single-family residence since she believes that
this would be the only appropriate use for the property.
Since a quorum of the Committee was not present,for formal action was taken.
Council Member Ujdak noted that Sean Pierre Trotter, the owner and operator of Frankie's BBQ,
Inc. Sent a letter to the City Clerk's Office dated today requesting that Bill Nos. 49-01 and 50-01
be continued until August 27th(copy attached).
Jon Hunt, Chairperson of the Special Advisory Zoning Committee then reviewed the August 13,
2001 "Interim Report"addressing the old Nuner School (copy attached).
The Council Attorney recommended that the interim report be sent to the South Bend Community
School Corporation. Council President Pfeifer agreed with this recommendation and further
recommended that the entire School Board and School Superintendent be sent copies. Mr. Hunt
stated that he would do that.

Council Member King stated that he hoped a positive approach could be made to explore all
with
options p h a 11 parties.
Council Member Kelly noted that he agreed with Council Member King's remarks and the interim
report and hoped that this matter could be amicably resolved. He further noted that he looks
forward to receiving the final advisory report in the next two weeks. He hoped that all would
work together.
There being no further business to come before the Committee, Council Member Ujdak adjourned
the meetin g at 3:57 p.m.
