Zoning an Stititxation (Committee
The November 12, 2001 meeting of the Zoning and Annexation Committee was called to order by
its Chairperson, Council Member Karen L. White 3:55 p.m. in the Council Informal Meeting
Room.
Persons in attendance included Council Members Pfeifer, Kirsits, Aranowski, Kelly, King,
Varner, Ujdak, Coleman, and White; City Controller Frederick O1lett, Michael Danch, Jeff Myers
of Area Plan, Public Works Director Gary Gilot, Terry Bland of the ntl) rihltitu,
and Kathleen Cekanski-Farrand, Council Attorney.
Council Member White noted that the first item on the agenda was to review Bill No. 59-01 which
would annex and bring into the City of South Bend and amend the zoning ordinance for certain
property in Clay Township which is contiguous to the city commonly known as the 17,000 block
of Douglas Road for Jerry and Marguery Macri and Richard and Ann LaFree.
Jeff Myers of Area Plan reported that the Area Plan Commission gave a favorable recommendation
to the proposed annexation and rezoning.
Michael Danch made the presentation on behalf of the petitioners. He provided preliminary site
plans of the area in question (copy attached). He noted that the area in question contains 11.19
acres which would have a large undeveloped buffer zone. Eight (8) buildings would be
constructed with "0" Office land use designations thereby prohibiting any "C" Commercial
developments. In light of concerns raised at the Area Plan meeting, Mr. Danch noted that there
would be no access to McErlain Street.
In response to a question raised by Dr. Varner,Mr. Danch noted that the items raised by the county
residents have been resolved. Mr. Danch further stressed that there would be no direct access into
the residential area to the south and west from the development.
Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill
No. 01-90 be recommended favorably. The motion passed.
Council Member White then called for a presentation on Bill No. 01-90 which is a resolution
adopting a written fiscal plan and establishing a policy for the provision of services to an
annexation area in Clay Township Macri/LaFree II Annexation involved 21 acres. No one from
the Administration was present to make the presentation.
Following discussion, Dr. Varner made a motion, seconded by Council Member Ujdak that Bill
No. 01-90 be sent to the full Council without recommendation in light of the fact that no one was
present at the Committee hearing. The motion passed.
There being no further business to come before the Committee, Council Member White adjourned
the meeting at 4:03 p.m.
