AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. _4___ 1.Background Data: a.Effective Date of Owner-Engineer Agreement:October 27, 2020 b.Owner:City of South Bend, Indiana c.Engineer: Black & Veatch Corporation d.Project:North WTP Improvements 2.Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: Task 110 – Pressure Vessel Delisting Assistance Engineer will review the Owner’s pressure vessel permit requirements in relation to the Indiana Boiler and Pressure Vessel Rules and ASME BPVC VIII with information for the five pressure vessels and their ancillary equipment at the North WTP to determine and establish justification for delisting of the vessels from the Indiana Department of Homeland Security’s active list of registered vessels. Engineer will document the status and the request to be removed from the list and provide this letter to the City for transmittal to the Indiana Department of Homeland Security. Engineer will participate in one teleconference with the Owner and Indiana Department of Homeland Security Boiler and Pressure Vessel Section to answer any outstanding questions. b. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: c.The responsibilities of Owner are modified as follows: Owner will work with the Indiana Department of Homeland Security to provide the delisting letter and organize a follow-up call with the Department to answer any questions that may arise. d. For professional services described under Paragraph 2.a. to add additional scope under Task 110, Owner agrees to pay Engineer in accordance with the Agreement for Professional Services on a Lump Sum Basis. The total compensation for Amendment 4 shall increase the lump sum amount by $3,400 and shall not be revised without written authorization. e. The schedule for rendering services is modified as follows: Engineer will submit the final Pressure Vessel Delisting request letter and conduct a follow-up discussion with the Owner and Indiana Department of Homeland Security no later than March 31, 2023. f.
