HomeMy WebLinkAboutResolution No 20-2023 - Adopting Policy for Community Wayfinding SignsPage 1 of 2 RESOLUTION NO. 20-2023 A RESOLUTION OF THE BOARD OF PUBLIC WORKS FOR THE CITY OF SOUTH BEND, INDIANA, ADOPTING A POLICY FOR COMMUNITY WAYFINDING SIGNS (CWS) WHEREAS, the Board of Public Works ("BPW") is a contracting body of the City of South Bend (the "City") and exists and operates under the provisions of I.C. 36-4-9-5, as amended from time to time (the "Act"); and WHEREAS, pursuant to I.C. §36-9-6-2 and I.C. §36-9-6-3, the City of South Bend, Indiana Board of Public Works (“Board”) has authority over the use of public rights of way and is responsible for the supervision of streets, alleys and other property of the City; and WHEREAS, the BPW has received requests from local entities for the installation of wayfinding signs, and WHEREAS, the BPW has determined that in order to provide consistency in signs located in the public right-of-way, a policy for wayfinding signs for local attractions be developed; and WHEREAS, signs located within the City’s right-of-way are to adhere to sound traffic engineering principles, in compliance with the Indiana Manual on Uniform Traffic Control Devices, and be limited in their locations; and WHEREAS, the wayfinding signs should not be used for purposes of advertising a location and are not intended to imply specific routing but rather a marker to indicate the appropriate access from a major route; and WHEREAS, the cost associated with signs made and installed for entities should not be a burden on the citizens of South Bend; and WHEREAS, BPW shall empower the City’s team of engineers, street, and public safety professionals to establish the process for designing, locating, and installing wayfinding signs for local entities. WHEREAS, the foregoing resolution hereby repeals and replaces, it its entirety, any prior existing BPW resolution, relating to wayfinding signs, which may or may not previously exist with the exception of any plans or BPW action authorizing the installation of Tourist- Oriented signage in the public right-of-way. Page 2 of 2 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS THAT: The Board of Public Works for the City of South Bend, under the power vested by the City of South Bend Municipal Code Section 20-3, shall do the following in regards to wayfinding signs: 1.Adopt the Community Wayfinding Sign policy to guide the installation of signs for local attractions in the public right-of-way. 2.Direct the City’s Engineering Division to manage the application process for Community Wayfinding Signs per the procedures represented in Exhibit A. ADOPTED this 25th d a y of April, 2023. April 25, 2023 Page 1 of 3 EXHIBIT A PROCEDURES FOR INSTALLATION OF COMMUNITY WAYFINDING SIGNS (CWS) FOR ENTITIES I.Definitions a. Local attraction: Key civic, cultural and recreational attractions of local or regional significance in the city. Typically, these attractions will have an annual attendance of more than 10,000 but less than 150,000 people. b.Traffic engineer: Authorized personnel in the City’s Engineering division who makes decisions regarding traffic and signage in the public right-of-way. II.In order to objectively and completely consider requests for CWS installation, for entities, the Board of Public Works of the City of South Bend sets forth the following procedures: a.An entity interested in having a wayfinding sign in the public right of way, shall fill out the CWS application available online on the City’s website. The application shall generally include: •Name of entity requesting sign(s) •Name of contact person •Contact information (address, phone, e-mail) •Data for previous year detailing annual attraction attendance for requesting entity. •New attractions may provide projections for annual attendance numbers. •Requested locations for signs (final determination to be made by City Traffic Engineer) •Any other details deemed pertinent to the sign request b.The City Traffic Engineer shall evaluate the request and determine the sign design, location(s) and costs. The sign design shall follow the City standard as shown below: Page 1 of 3 c. The City Traffic Engineer shall evaluate the existing wayfinding signage near the requesting entity location to inform the number of wayfinding signs. Generally, the maximum number of community wayfinding signs for a local attraction shall be based on the entity’s annual attendance, in accordance with the following schedule: Annual Attendance Number of Signs 10,000 to 150,000 Up to 12 150,000 and above Discretion of the Traffic Engineer d. The number of signs will be dependent on the location of the attraction, and its proximity to major roadways. e. In the event that multiple entities request signage in close proximity, each case will be evaluated to determine the appropriate sign configuration. f. The wayfinding sign designs shall be in compliance with the current edition of the Indiana Manual on Uniform Traffic Control Devices. The inclusion of logos or pictographs will evaluated on a case by case basis. g. Upon a request by the City Traffic Engineer, the Bureau of Traffic & Lighting, Streets Division of the Department of Public Works, shall plan to make and install the proposed signs. h. Installation and maintenance of community wayfinding signs: i. The Bureau of Traffic & Lighting shall fabricate and perform all required installation, maintenance, removal and replacement of wayfinding signs that are located within the right-of-way. Private entities may not install or remove any signage in the public right-of-way. ii. A wayfinding sign for an activity or site shall not be installed until the applicant has paid the department the initial fee as set under this Resolution. i. Wayfinding Sign Fees: i. The initial service charge, payable once an application is approved, is $400 per sign. This cost covers the fabrication, installation and maintenance of the sign for a period of 4 years. If a change is made by the applicant that necessitates changes to the sign that are beyond standard maintenance, it is the responsibility of that entity to complete a new application and pay for the replacement. ii. Every 4 years, the City shall assess the condition of the wayfinding sign. If it is determined by the City Traffic Engineer that the sign needs to be replaced, or if the owner’s information or logo has changed, the owner will be charged a full replacement fee as determined by the City for the labor and material costs for making and installing the new sign. j. Wayfinding Sign Removal. i. The City shall have the full right to remove a wayfinding sign if the activity or site no longer qualifies for an attraction. Upon removal of the sign, the applicant may request to keep the sign, or it can be recycled if they do not want it. k. The City shall work with entities that currently have wayfinding signs in the public right-of-way to bring their signs up to the new standard established in this policy. The City may offer relief for such costs of bringing signage up to standard.
