HomeMy WebLinkAbout03282023 Board of Public Works MeetingAGENDA REVIEW SESSION MARCH 23, 2023 52 The Agenda Review Session of the Board of Public Works was convened at 10:31 a.m. on March 23, 2023, by Board President Elizabeth A. Maradik, Vice President Joseph Molnar, and Board Members Gary Gilot, Jordan Gathers, Murray Miller, and Board Attorney Michael Schmidt present. Board of Public Works Clerk, Theresa Heffner, presented the Board with a proposed agenda of items presented by the public and by City Staff. Board members discussed the following item(s) from the agenda. REJECT BIDS AND QUOTATIONS Project Engineer Patrick Sherman was present to discuss item 4.A: Century Center Parking Lot Seal and Stripe. Mr. Sherman explained that they sent the request for quotes to nine (9) different places, but only received one (1) back that will need to be rejected because it did not meet the MWBE requirements. He added that further internal discussions will take place to determine if the job needs to have MWBE goals attached since it is a small company with a small crew. Assistant City Attorney Michael Schmidt noted that it is a small job with one task making it complicated to subdivide the work out to meet MWBE goals. REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS Project Engineer Sherman was present to discuss item 7.B: Martin Luther King Jr. Dream Center Construction Manager as Constructor Services. He explained that he is doing a request for proposals for a construction manager as constructor (CMc) process which is a different project delivery method than we are used to doing in the City. He explained the City of Mishawaka used this method on their City Hall and had a good experience with it. He added that Engineering wanted to be sure that as we bid out this project that we have an awardable project. With the crazy bidding environment that we are dealing with now, this will enable us to do a guaranteed maximum price to ensure we have a project that fits within the budget. Gary Gilot asked if there is anything different about the process regarding the authority of the Board of Public Works to do it alone or does it require a Common Council Resolution. The Director of Public Works, Eric Horvath, explained that it does not require Common Council approval as it will go through an RFP process for the selection. He continued to explain the Board would ratify the selection and at that point we will be working with the CMC and when they go to get bids, they will put them in bid packages to be bid out. He gave the example that the windows might be one (1) bid and the foundation might be one (1) bid and the MWBE goals will be set per bid package. Lastly, Director Horvath noted that the CMC can participate in the bidding process, and they can self-perform up to twenty percent (20%) by statute. Attorney Schmidt explained that the Board will open the individual packages to confirm the individual subcontractor packages will operate similarly to a traditional bid process and there will be goals attached to each task. He expressed that this is a high-profile project so engineering needs to get moving, and this approach will assure that we are not extending the budget and are able to get started in a timely fashion as to assure for the use of goals. Mr. Gilot asked if the constructor is at risk for construction cost overruns or is the Board open to a change order. Director Horvath explained that the there are two CMc processes that will do at-risk. If there is a change where something is being added, then we will do a change order for that because it is outside the scope. Everything in the scope will have a guaranteed maximum price. Mr. Gilot advised that for projects over $5,000,000, it is a good idea to have an independent specialist in value engineering for cost containment. Attorney Schmidt explained that the construction manager comes in in at an earlier point in the scope of the project and allows them to value engineer before finalizing the scope and before getting subcontractors involved. That’s how they are able to do the guaranteed savings because the value engineering occurs a bit more upfront. Mr. Miller asked if using the CMC will add additional costs due to risk. Engineer Sherman stated that engineering believes that potential additional cost is balanced by the lowering of risk. We’ll be able to utilize a guaranteed maximum price and ensure an awardable project. Mr. Miller stated that he is not happy about this approach and asked if each bid package will have a separate MWBE goal attached to it. Director Horvath advised that all of the different elements involved will have an MWBE goal attached. He continued that the goal may be zero (0) if there is no REGULAR MEETING MARCH 28, 2023 53 availability in our geographical marketplace for specific NAICS codes, but they will all have a goal based on the NACIS codes for the particular work element. Mr. Miller noted that it makes more sense to attach goals to the entire project rather than attaching goals to each bid packet. Attorney Schmidt explained that there will be some anticipated hiccups as we try to make sure that we are in full compliance with the MWBE ordinance, and we know that it's important to be in compliance especially in a particularly unique procurement approach like this. VP Molnar noted that the City tore the existing building down, so we have to begin building the new one soon otherwise there will be concerns as to why the old one was torn down when it could have been used. VP Molnar stressed the importance for the City to show the community that this is a priority project. Mr. Miller asked about the timeline. Director Horvath stated that the RFP will take some time, but we are expecting the selection of the CMC by May 9, 2023, and then will start the process right away. Director Horvath noted that the majority of the design is done so they will review the designs and provide feedback and hope to be under construction this summer. PROJECT COMPLETION ADDIFDAVITS Attorney Schmidt shared the MWBE goals with Mr. Miller for item 6.A: South Well Field Backwash Line Relocation. He explained that there was a slight utilization plan change due to trucking. They were not able to provide services for a number of days which amounted to approximately $3,000. They did get about a $1,000 worth of work out of it, but they were not able to get the entire $3,000. RESOLUTIONS Mr. Gilot shared concerns about item 8.B: Approving the trade in of City Owned Property for Twenty-Two (22) Remington Shotguns and Fifteen (15) Smith & Wesson Handguns. He shared reservations about selling weapons to vendors and having them end up back on the street rather than just melting them down, so they do not end up on the street. He also shared his concerns if someone was killed with one of these guns. There isn’t a lot that the City can do to limit the number of guns on the street, but this is a way for the City to think about this process going forward. VP Molnar concurred. RESOLUTIONS Mr. Gilot observed that item 8.C: Disposal of Unfit and/or Obsolete Property for Fort-nine (49) Lifepak 500 AEDs is because officers are being outfitted with a new, modern AED rather than just doing away with them all together. AGREEMENTS/CONTRACTS/PROPOSALS/ADDENDA Mr. Gilot asked about item 9.A: Professional Service Agreement with Black & Veatch. He asked if the annual calibration of water hydraulic models was not being done inhouse because we are paying three (3) times the salary for a consultant to do it. Director Horvath explained that someone does need to do this service a lot to be able to be good at it. He explained that on the sewer department side, a big part of our savings on long term control plan came from getting a hyperactive model as there was no way we could have done it with City staff and so that saved millions of dollars. Maradik in the 13th Floor Conference Room of the County-City Building, 227 W. Jefferson Blvd., South Bend, Indiana. The meeting was also streamed live to the public via Microsoft Teams. Board Clerk Theresa Heffner confirmed the presence of Board President Elizabeth A. Maradik, Vice President Joseph Molnar, and Board Members Gary Gilot, Jordan Gathers (arrived at 9:43 a.m.), Murray Miller, and Board Attorney Michael Schmidt, with a roll call. President Maradik reminded virtual attendees to mute their microphones and turn off their cameras when not speaking, and to save their questions and comments for the Privilege of the Floor. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by VP Molnar, seconded by Mr. Miller and carried by roll call, the minutes for the Agenda Review Session and Regular Meetings of the Board held on March 9, 2023 and March 14, 2023, were approved. Jefferson Blvd. VP Molnar / Mr. Gathers APPROVE/DENY TRAFFIC CONTROL DEVICES Upon a motion made by VP Molnar, seconded by Mr. Gathers and carried by roll call, the following traffic control device request was approved: NEW INSTALLATION: Honorary Street Sign - John Floyd Dr. LOCATION: Intersection of Angela Blvd. and St. Louis Blvd. REMARKS: All Criteria Met RATIFY REDUCED SENIOR TRASH RATE In a memo to the Board, Ms. Kelly Smith, Solid Waste, requested the Board ratify the approval of reduced trash collection rates for the following residents, per Municipal Code 16-6: 1. 3,044 (Total # of Accountholders) as of the 1st Quarter of 2023 In her memo, she stated Water Works customer service staff verified that all of the applicants are head of the households and have submitted proof of age sixty-five (65) or older. There being no further discussion, upon a motion made by VP Molnar, seconded by Mr. Gathers and carried by roll call, the approval of reduced rates was ratified. Therefore, upon a motion by VP Molnar, seconded by Mr. Gathers, and carried by roll call, the Board ratified the preapproved claims payments. PRIVILEGE OF THE FLOOR Board Member Gary Gilot asked if City Legal and Engineering could compile a one (1) page memo explaining the new process to design bid builds so the Board Members understand what they are approving since it is a high profile project. Attorney Schmidt recommended that an action item be placed on the next regular meeting to discuss the Board’s role with the construction manager contract. Attorney Schmidt added that this is not specific to our project but about the process. Director of Public Works, Eric Horvath, added that he is happy to sit down with the Board to explain the process.
