HomeMy WebLinkAbout02-14-00 Zoning & Annexation QCommitttt Attport: The Zoning and Annexation Committee to the common Coma of the City of iioutb O: The February 14, 2000 meeting of the Zoning and Annexation Committee was called to order by its Chairperson, Council Member Karen L. White at 3:30 p.m. in the Council informal meeting room. Persons in attendance included Council Members: Aranowski, Varner, Pfeifer, King, Ujdak, Kelly, Kirsits and White; John Byorni, Ron Johnson, Building Commissioner Don Fozo, Catherine M. Broker, Assistant Zoning Administrator; Jac k Dillon,o , K e vin Butler, Kenneth Fedder, Jim and Tim Sharpe, Elizabeth Horton, Terry Bland, and Kathleen Cekanski-Farrand. Council Member White welcomed everyone to the meeting and introduced the Zoning and Annexation Committee members,namely: Council Members Ujdak,Varner, Coleman and herself. Council Member White noted that the first item on the agenda was Bill No. 92-99 which is a rezoning request for the property located at 912 Oakland and 1408 and 1412 Mishawka Avenue which was continued from the last Council meeting at the request of the Petitioner. Council Member White noted that the Council has received a letter from Mr. Kenneth P. Fedder, Attorney for the Petitioner dated February 10, 2000 noting that he wishes to withdraw Substitute Bill No. 92-99. Council Member White noted that in light of this request that the Bill would be struck from tonight's Council agenda. The Committee then reviewed Bill No. 00-11 which is a request for a special exception for the property located at 912 Oakland. Catherine M.Broker,Assistant Zoning Administrator advised the Committee that the petition is sent from the Board of Zoning Appeals with a favorable recommendation. She then reviewed the BZA report(copy attached). Mr. Kenneth Fedder,the attorney for the Petitioner made the presentation. He noted that in light of his request to have Substitute Bill No. 92-99 struck that he would like to move forward on Bill No. 00-11. The special exception would permit the use of the facility for parking of automobiles and related activities at the site for the accounting office of Christine 'A. Lauber, CPA. Following discussion after the public hearing, Dr. Varner made a motion, seconded by Council Member Ujdak that Bill No. 00-11 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 110-99 which is a rezoning request for the property located at 1129 South Bend Avenue& 1143 South Bend Avenue. Mr. John W. Byorni, Assistant Director of the Area Plan Commission, noted that the Bill comes with favorable recommendations from both the staff and the Commission (APC report attached). He showed the Final Site Plan of the site to the Committee. Kevin Butler, attorney for the petitioner, made the presentation. He introduced Jim and Tim Sharpe who manage A's Rental Services which Specializes in the operation of an equipment in ui ment renta 1 business. Zoning and Annexation Committee February 14, 2000 Page 2 Council Member King noted that the rezoning in question is in his Councilmanic District. He spoke in favor of the Bill and noted that it would be the first development of its kind to further enhance this area of the City. Following discussion, Council Member Ujdak made a motion, seconded by Dr. Varner that Bill No. 110-99 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 111-99 which is a zoning request for the property located at 1701 West Sample. Mr. Byorni noted that this received favorable recommendations from the Area Plan Commission as well as the staff(report attached). Elizabeth Horton, the proposed purchaser for the property made the presentation. She noted that the rezoning is being requested to allow the construction of a single family home. Following discussion, Council Member Varner made a motion, seconded by Council Member Ujdak that Bill No. 111-99 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 00-10 which is a request for a special exception for the property located at 1835 Lincolnway East in order to permit a family restaurant with a lounge area. Catherine M. Bruker, Assistant Zoning Administrator, advised the Committee that the petition is sent from the Board of Zoning Appeals with a favorable recommendation. She then reviewed the BZA report(copy attached). Ron Johnson the petitioner made the presentation. He noted that the family restaurant would specialize in ribs and would be family-oriented. It i s t h e site o f the old Bonanza s restaurant. He plans to park an 1963 antique fire truck in front of the building to advertise the hot sauce for the ribs. Following discussion, Council Member Ujdak made a motion, seconded by Dr. Varner that Bill No. 00-10 be recommended favorably to Council. The motion passed.
